HomeMy Public PortalAbout03239 O R D I N A N C E NO. 3239 AN ORDINANCE declaring the result of a special election held in St. Louis County, Missouri, on the question of annexing an area of said St. Louis County to The Metropolitan St. Louis Sewer District, held on May 10, 1977, and extending the corporate boundaries of The Metropolitan St. Louis Sewer District to include such area, with an emergency clause. WHEREAS, heretofore, to wit: on the 23rd day of March, 1977, the Board of Trustees of The Metropolitan St. Louis Sewer District did adopt a certain ordinance calling and ordering a special election to be held within an area of St. Louis County, Missouri, as more fully set forth therein, on Tuesday, the 10th day of May, 1977, for the purpose of submitting to the qualified electors of said area the following proposition: PROPOSITION Shall there be annexed to The Metropolitan St. Louis Sewer District that portion of St. Louis County, Missouri, outside the present boundaries of the District as more particularly described in the Notice of Special Election contained in Section of Ordinance No. 3205 of said The Metropolitan St. Louis Sewer District, adopted March 23, 1977? and WHEREAS, the Secretary-Treasurer of this Board acting pursuant to the aforesaid ordinance, did give notice of said special election by advertisement published once a week for at least three (3) consecutive weeks, namely, April 14th, 21st, 28th, and May 5th, 1977, in the St. Louis Globe-Democrat and in the 2 St. Louis Post Dispatch, newspapers of general circulation in The Metropolitan St. Louis Sewer District, the first publication in each of said newspapers having been made at least twenty- one (21) days prior to the date of the election and the last publication in each of said newspapers having been made not more than seven (7) days prior to the date of said election, all as shown by the publishers' affidavits now on file in the office of the Secretary-Treasurer of this Board; and WHEREAS, the said election was duly held on said 10th day of May, 1977, by the Board of Election Commissioners for St. Louis County, Missouri; and WHEREAS, the ballots furnished for and used at the said special election were in substantially the form as set forth in the aforesaid ordinance adopted by this Board; and WHEREAS, the said Board of Election Commissioners of St. Louis County, on the 12th day of May, 1971, did certify to this Board of Trustees the result of the aforesaid election; and WHEREAS, this Board has now canvassed the returns of said election, as certified by the Board of Election Commissioners; and WHEREAS, it appears upon said canvass that at said election there was cast a total of fifteen thousand four hundred twenty-two (15,422) votes on the aforesaid proposition of which thirteen thousand ninety-nine (13,099) votes were cast "FOR THE ANNEXATION OF THE AREA" and two thousand three hundred twenty- 3 three (2,323) were cast "AGAINST THE ANNEXATION OF THE AREA"; and WHEREAS, more than two-thirds of all of the votes cast on the aforesaid proposition were cast in favor thereof; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the following proposition, to wit: PROPOSITION Shall there be annexed to The Metropolitan St. Louis Sewer District that portion of St. Louis County, Missouri, outside the present boundaries of the District as more particularly described in the Notice of Special Election contained in Section of Ordinance No. 3205 of said The Metropolitan St. Louis Sewer District, adopted March 23, 1977? as submitted to the qualified electors of an area of St. Louis County, Missouri, as set forth more particularly in aforesaid Ordinance No. 3205 at a special election held on the 10th day of May, 1977, was assented to by more than two-thirds of the qualified electors of said area voting on said proposition at said election; and that the Board of Trustees of The Metropolitan St. Louis Sewer District is, therefore, authorized to and does declare that the corporate boundaries of The Metropolitan St. Louis Sewer District are hereby extended so as to include such area as described in aforesaid Ordinance No. 3205. Section Two. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis, and the 4 Secretary of State. Section Three. The need to create a subdistrict within the area being annexed in order to accelerate the acquisition of sewers in that subdistrict to protect the public health, creates an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District, and this Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was adopted May 25, 1977.
