HomeMy Public PortalAbout03278 O R D I N A N C E NO. 3278 AN ORDINANCE calling and providing for the holding of a Special Election in the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District, for the purpose of submitting to the qualified electors thereof a proposal for the issuance of revenue bonds payable solely from the revenues to be derived from the operation of the sewerage facilities of said Subdistrict to provide funds for the acquisition of a sanitary trunk sewer system and a sewage treatment facility for said Subdistrict. WHEREAS, it has become necessary to acquire a sanitary trunk sewer system and a sewage treatment facility for the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District; and WHEREAS, the Board of Trustees of the said Metropolitan t. Louis Sewer District does now find and determine that the cost o purchasing the said sanitary trunk sewer system and sewage treatment facility, as shown by an estimate made by competent engineers, is Twelve Million Dollars $12,000,000,.00); and WHEREAS, Fee Fee Trunk Sewer, Inc. has agreed with the District that its trunk sewer system and treatment plant would be acquired by the District for the total sum of Twelve Million Dollars ($12,000,000.00), subject to voter approval of a Ten Million Dollar ($10,000,000.00) revenue bond issue, which is to form a part of such purchase price. The balance of Two Million Dollars ($2,000,000.00) is to be paid primarily from connection 2 fees for new connections made to such sewer system; and WHEREAS, under the Plan of The Metropolitan St. Louis Sewer District, the funds required as aforesaid may be obtained through the issuance of revenue bonds payable solely from the revenues to be derived from the operation of the sewerage facilities of the aforesaid Subdistrict, provided the proposition to issue such bonds be assented to by four-sevenths of the qualified electors of said Subdistrict voting thereon at an election held for that purpose; and WHEREAS, the aforesaid Subdistrict at this time has no outstanding indebtedness of any kind or character; and WHEREAS, it is the opinion of this Board that bonds of said Subdistrict should be issued at this time in the amount of Ten Million Dollars ($10,000,000.00) to provide funds for the purposes hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That a special election be and the same is hereby called and ordered to be held within the boundaries of the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District on Tuesday, the 30th day of August, 1977, for the purpose of submitting to the qualified electors of said Subdistrict the following proposition: 3 PROPOSITION Shall the revenue bonds of the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District be issued in the amount of Ten Million Dollars ($10,000,000.00) to provide funds for the acquisition of a sanitary trunk sewer system and a sewage treatment system for said Subdistrict, including all expenses necessarily incidental thereto? Section Two. That said special election shall be held at the polling places in said Subdistrict as set forth and described in the notice of election as contained in Section Four of this ordinance. The polls of said election shall be opened at the hour of 6:00 o'clock A.M. Central Daylight Saving Time and shall remain open until the hour of 7:00 o'clock P.M. Central Daylight Saving Time on the aforesaid date. Section Three. That the ballots to be used at said special election, subject to such adaptations as may be necessary where the electronic voting system is to be used, shall be in substantially the following form, to wit: OFFICIAL BALLOT FEE FEE TRUNK SEWER SUBDISTRICT OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT, STATE OF MISSOURI SPECIAL BOND ELECTION Tuesday, the 30th day of August, 1977 4 PROPOSITION Shall the revenue bonds of the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District be issued in the amount of Ten Million Dollars ($10,000,000.00) to provide funds for the acquisition of a sanitary trunk sewer system and a sewage treatment system for said Subdistrict, including all expenses necessarily incidental thereto? FOR THE BOND ISSUE AGAINST THE BOND ISSUE Section Four. That the Secretary-Treasurer be and he is hereby directed to give notice of said special election by advertisement published once a week for at least three (3) consecutive weeks in the St. Louis Globe-Democrat and in the St. Louis Post-Dispatch, newspapers of general circulation in The Metropolitan St. Louis Sewer District, the first publication in each of said newspapers to be made at least twenty-one (21) days prior to the date of the election and the last publication to be made not more than seven (7) days prior to the date of said election. The said notice shall be in substantially the following form, to wit: NOTICE OF SPECIAL ELECTION FEE FEE TRUNK SEWER SUBDISTRICT OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT, STATE OF MISSOURI 5 Notice is hereby given to the qualified electors of the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District, State of Missouri, that a special election will be held in said Subdistrict on Tuesday, the 30th day of August, 1977 commencing at 6:00 o'clock A.M. Central Daylight Saving Time and closing at 7:00 o'clock P.M. By order of the Board of Trustees of The Metropolitan St. Louis Sewer District, this 13th day of July, 1977. Charles Clardy Secretary-Treasurer Section Five. That, as provided by Section 10.010 of the Plan of The Metropolitan St. Louis Sewer District, the said 14 special election shall be held and conducted and the returns thereof made, examined, and cast up in the same manner and in all respects as provided by law for the election of state and county officers. All registered voters residing within said Subdistrict shall be entitled to vote at said election. Section Six. That the Secretary-Treasurer of this Board shall be and he is hereby directed to file a certified copy of this ordinance with the Board of Election Commissioners for St. Louis County, Missouri, as and for the warrant and authority of the said Board to hold and conduct the special election herein provided for; and the said Board of Election Commissioners is hereby requested to do all things and take all proceedings necessary to the holding and conducting of the said special election. Section Seven. That all ordinances or parts of ordinances which in any manner conflict with the provisions of this ordinance shall be and the same are hereby repealed, insofar as they may so conflict. The foregoing Ordinance was adopted July 13, 1977.
