HomeMy Public PortalAbout2017-10-161 REGULAR COUNCIL MEETING, OCTOBER 16, 2017 CALL TO ORDER The Regular Council Meeting of October 16, 2017, was convened at 6:03 P.M. by Mayor Carrie Tergin. ROLL CALL The f ollowing Council Members were present for the roll call: Present: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward and Wiseman Absent: None A quorum was declared present. ADOPTION OF THE AGENDA A motion was made by Councilman Henry, seconded by Councilman Graham, to adopt the agenda as discussed in the Pre-Meeting to recognize Officer Shawn Dumsday’s receipt of a Mothers Against Drunk Driving (“MADD”) award under Miscellaneous Agenda Items. Motion to adopt as amended was approved unanimously. MISCELLANEOUS AGENDA ITEMS City Administrator Steve Crowell made a presentation and introduced Ms. Angie Haslag, Public Works Administrative Assistant, as recipient of the Outstanding Employee of the Year for 2017. Following Mr. Crowell’s presentation, Mayor Tergin congratulated Ms. Haslag and thanked her for her outstanding work. Mayor Tergin presented Ms. Haslag with a presentation version of Resolution RS2017-12, and announced that the Council would take up the associated Resolution. RS2017-12, sponsored by Council Members Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward and Wiseman, entitled: A RESOLUTION OF THE CITY OF JEFFERSON RECOGNIZING ANGIE HASLAG AS 2017 OUTSTANDING EMPLOYEE. 2 REGULAR COUNCIL MEETING, OCTOBER 16, 2017 A motion was made by Councilman Mihalevich, seconded by Councilwoman Ward, for adoption of Resolution RS2017-12 as presented. The motion was approved unanimously by the following roll-call vote: Aye: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None Mr. David Silvester, Missouri Department of Transportation (MoDOT) made a presentation and distributed information regarding “Buckle Up / Phone Down Day.” He invited everyone to attend an event that would be held on October 20, at 11:00 a.m. in the dining room at the main Central Bank. He stated Missouri was one of few states that didn’t have a primary safety belt law and did not have an ‘all texting’ ban while operating a motor vehicle. He provided statistics on fatal car crashes. He noted the City and County had endorsed the “Buck Up / Phone Down” initiative. He explained how citizens and business can take the “Buckle Up / Phone Down” pledge online at www.MoDOT.org. Mayor Tergin thanked Mr. Silvester for providing the information. Mayor Tergin recognized Boy Scouts in the audience and asked them to come forward to identify their school and the badge on which they were working. The Scouts were students at St. Joseph Cathedral School and St. Martins C atholic School, and were either working towards their Citizenship in the Community badges or had not yet decided which badge they were working towards. Mayor Tergin welcomed them and wished them well in their endeavors. Mayor Tergin recognized Officer Shawn Dumsday for his service to the Jefferson City Police Department and the community. She noted Officer Dumsday recently received an award at the Mothers Against Drunk Drivers (“MADD”) dinner. Officer Dumsday explained the award was started three years ago and that officers from each agency with the most DWI arrests for 2016 were recognized. Mayor Tergin thanked Officer Dumsday for his commitment to this cause and for his service, and stated she was honored that he received this award two years in a row. PUBLIC HEARINGS There were no public hearings scheduled at this time. APPOINTMENTS BY THE MAYOR 3 REGULAR COUNCIL MEETING, OCTOBER 16, 2017 The following appointment to City boards and commissions was recommended by Mayor Tergin for Council approval: Board or Commission Recommended appointment Expires Status Environmental Quality Commission Jeanne Jacobek Nov 2022 Full A motion was made by Councilman Prather for approval of the appointment as presented, seconded by Councilman Graham, and approved unanimously. Human Resources Director Gail Strope provided an update on the Human Relati ons Commission and explained its role. The board had been inactive for several years due to a lack of interest. Mayor Tergin noted the status of this board came up during a town hall meeting on October 10 and stated people could apply for this and other City boards and commissions. Mayor Tergin noted additional town hall meetings would be held on October 24 and November 7 and 8. Ms. Strope answered a question from Councilman Graham. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Mr. Frank Rycyk provided information on the Evening Rotary Club’s 12 th Annual Spaghetti Dinner on November 3 from 4:30 p.m. to 7:00 p.m. at Grace Episcopal Church. He stated the Rotary Club was an international service organization that eradicated polio worldwide, and worked with local organizations. He recognized Councilman Hussey and Mayor Tergin as fellow Rotarians. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF Mayor Announcements and Events Mayor Tergin provided details of the following activities and events in which she had recently participated, and events which would occur in the near future:  Boss’s Day  CSPAN at the State Capitol and visit to local schools  Proclamation in honor of locally filmed movie “Darkness Reigns”  NAACP dinner at Lincoln University  Governor’s Mansion’s Fall into History event  Lincoln University Tigers’ Pink Game and Ride for the Ribbon event 4 REGULAR COUNCIL MEETING, OCTOBER 16, 2017  Belair Elementary School’s 50th anniversary  Quinn Chapel AME Church’s reading room dedication in honor of Dr. Carolyn Atkins  Tom Henke Golf Classic with Charley Pride  Special Olympics opening ceremony and announcement that the games would be held in Jefferson City for the next four years  Recognition of Southside Plan  Capital Arts fundraiser “CelebArty”  Wearing pink in support of Breast Cancer Awareness month Staff Announcements:  Larry Burkhardt introduced and recognized members of the Building Code Ad Hoc Steering Committee  Chief Schofield stated open burning season would start November 1 and run until March 1. He encouraged everyone to talk with their neighbors before burning. Open burning is allowed only during daylight hours, and must be attended at all times, with the means to extinguish a fire close by. He stated that October is Fire Prevention Month, with a theme of “Every Second Counts, Plan Two Ways Out”. Handouts were provided and Chief Schofield stated that information was also available at fire stations, the Fire Administration office, on the City website. Chief Schofield also shared photos of the fire safety trailer and noted fire safety awareness measures offered in the community.  Sonny Sanders noted a public meeting would be held October 17, from 3:00 to 6:00 p.m. in the Boone Bancroft Room at City Hall regarding the JEFFTRAN assessment and recommended changes. He stated that a public meeting would also be held October 24, from 3:00 to 6:00 p.m. in the Boone Bancroft Room at regarding prioritizing strategies for the Public Transit-Human Services Transportation Plan. Informational handouts about the meetings were provided.  Jayme Abbott stated Project Home Connect would be held October 20, from 9:00 a.m. to 2:00 p.m. at the 300 block of East Capital Avenue , hosted by three churches to assist individuals at immediate risk of becoming homeless. 5 REGULAR COUNCIL MEETING, OCTOBER 16, 2017 PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS Mr. Dirk Protzman, President of Jefferson City Professional Firefighters Local 671, thanked everyone who took time to talk to their members regarding Bill 2017-74. CONSENT AGENDA The following items were brought before the Council for approval by Consent: a. Minutes of City Council Meetings: October 2, 2017 b. Renewal (Year 3) Contract with Lamberson Lawn Care , LLC for Cemetery Maintenance Services c. Accepting Bid for Excess Workers’ Compensation and Property Insurance A motion for approval of the Consent Agenda as presented was made by Councilman Henry, seconded by Councilwoman W ard, and approved unanimously. BILLS INTRODUCED 2017-77 sponsored by Councilman Henry, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE 2017 2018 BUDGET BY AUTHORIZING A $640,000.00 SUPPLEMENTAL APPROPRIATION WITHIN THE GENERAL FUND FOR THE DOWNTOWN STREETSCAPE REPAIR AND ELECTRIC PROJECT. 2017-78 sponsored by Councilwoman Wiseman, entitled: AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO THE CULTURAL ARTS COMMISSION MEMBERS TO CORRECT A TYPOGRAPHICAL ERROR. 2017-79 sponsored by Councilman Henry, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A $338,694.60 AGREEMENT WITH GWH LANDSCAPE CONTRACTING, LLC, FOR THE SOUTH LINCOLN STREET PROJECT; 6 REGULAR COUNCIL MEETING, OCTOBER 16, 2017 AND AMENDING THE 2017-2018 BUDGET BY AUTHORIZING A SUPPLEMENTAL APPROPRIATION FROM THE GENERAL FUND. Councilman Henry requested that the rules be suspended and Bill 2017 -79 placed on final passage. There were no objections to the request for suspension of the rules. Councilman Mihalevich made a motion to accept Substitute #2 to Bill 2017-74 previously distributed. The motion was seconded by Councilman Hussey, and approved by the following roll-call vote: Aye: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None Councilman Mihalevich then made a motion to amend substitute #2 to Bill 2017-74 by deleting the phrase “or more” in paragraph (a), as follows: Section 11-2. Floating Holidays (a) Al l full-time and part-time with benefits employees employed on November 1 of each year shall be credited with one or more floating holidays per fiscal year. The motion was seconded by Councilman Prather and approved by the following roll- call vote: Aye: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None Councilman Mihalevich then made a motion to further amend substitute #2 to Bill 2017-74 by changing “12” to “24.25”, and by deleting the last sentence in paragraph (b), as follows: (b) Fire service personnel assigned to fire suppression duty will receive 12 24.25 hours per floating holiday. Police personnel in patrol and communications assigned to 10 hour shifts will receive 10 hours per floating holiday. Part-time with benefits employees will receive 4 hours per floating holiday. All other full-time employees will receive 8 hours per floating holiday. The City Administrator may determine the number of floating holidays provided each year. GO INTO CLOSED SESSION Mayor Tergin stated that, pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion to go into Closed Session to discuss the following: a. Hiring, Firing, Disciplinary, or Promoting of Particular Employees [Sec. 610.021(3)] A motion was made by Councilman Hussey to go into Closed Session for the above-stated reason, seconded by Councilman Mihalevich, and approved by the following roll-call vote at 8:06 P.M.: Aye: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None RECONVENE IN OPEN SESSION Following the Closed Session, the Council reconvened in Open Session at 8:21 P.M. with the following Council Members present: Present: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, Ward and Wiseman Absent: None A motion was made by Councilman Prather to appoint Emily Donaldson as Deputy City Clerk starting in November, and as City Clerk upon the retirement of Phyllis Powell, with pay at the starting pay range of the City Clerk with all standard employee benefits.
