HomeMy Public PortalAbout03381 O R D I N A N C E NO. 3381 AN ORDINANCE, authorizing the Executive Director and the Secretary-Treasurer of The Metropolitan St. Louis Sewer District to purchase from the owners thereof certain real property in St. Louis County, Missouri, for the purpose of right-of-way along Maline Creek, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and the Secretary- Treasurer of the District are hereby authorized to purchase from the owners thereof, the following real property in St. Louis County, Missouri, for the purpose of right-of-way along Maline Creek, at a price not to exceed Five Thousand Five Hundred Dollars ($5,500.00), said property to be free of all encumbrances, and described as follows: A tract of land partly in fractional Section 8 and partly in U.S. Survey 111, Township 46 North, Range 7 East being that parcel described and conveyed to Noel R. Essman and wife by deed recorded in Book 6923, Page 200 of the St. Louis County Records. EXCEPTING THEREFROM the following described parcel: Beginning at the intersection of the western line of Halls Ferry Road as condemned and widened by Cause #290114 of the Circuit Court of St. Louis County, Missouri, and the northern line of property conveyed to Noel R. Essman and wife by deed recorded in Book 6923, Page 200, of the St. Louis County records; thence leaving said road line and running along said northern line South 76 degrees 46 minutes 20 seconds West 145.47 feet to a point; thence, South 24 degrees 13 minutes 55 seconds East 119.14 feet to a point; thence, South 67 degrees 13 minutes 25 seconds East 66.64 feet to a point; thence, North 69 degrees 46 minutes 20 seconds East 87.81 feet to the western line of Halls Ferry Road as widened; thence, Northwestwardly along the West line of said Halls Ferry Road along the arc of a curve to the right, having a radius of 5,775 feet, a distance of 66.68 feet; thence, West-wardly, radially, a distance of 5.00 feet; thence, Northwestwardly along the arc of a curve to the right, having a radius of 5,780 feet, a distance of 50.44 feet; thence, Eastwardly radially, a distance of 5.00 feet; thence Northwardly, along the arc of a curve to the right, having a radius of 5,775 feet a distance of 29.52 feet to the point of beginning. The foregoing conveyed property and the exception therefrom are subject to the easement to The Metropolitan St. Louis Sewer District recorded in Book 3823, Page 221 of the St. Louis County records. Section Two. Upon the execution and delivery to them by said owner of a Special Warranty Deed in proper form, being free from liens and encumbrances, conveying title to the said land to The Metropolitan St. Louis Sewer District, the Executive Director and the Secretary-Treasurer shall be and are hereby authorized and directed to pay to said owner, for said land, the total sum of Five Thousand Five Hundred Dollars ($5,500.00).
