AN ORDINANCE, appropriating Sixteen Million Eight
Hundred Ninety-six Thousand Dollars ($16,896,000.00) from the
Mississippi River Construction Fund to pay for the construction of
Lemay Wastewater Treatment Plant - Aeration Tanks, Service
Building and Instrumentation, Contract PA-62, in St. Louis County,
Missouri.
WHEREAS, the United States Environmental Protection
Agency has agreed to a seventy-five percent (75%) grant in aid of
construction, upon receipt of such funds from said source, they
shall be placed in the Mississippi River Construction Fund and are
hereby appropriated to pay the costs incurred by said Contract PA-
62; and
WHEREAS, the Missouri Department of Natural Resources
has agreed to a fifteen percent (15%) grant in aid of
construction, upon receipt of such funds from said source, they
shall be placed in the Mississippi River Construction Fund and are
hereby appropriated to pay the costs incurred by said contract PA-
62; and
WHEREAS, the District is obligated to pay ten percent
(10%) of the estimated total construction costs of said project,
the general conditions of which require that interest be paid on
any payment for construction made more than thirty (30) days after
the approval by the engineers; and
WHEREAS, to avoid paying said interest, it is deemed
advisable to appropriate from District funds sixty (60) days' pay-
ments in excess of the ten percent (10%) the District is obligated
to pay, which sum is Four Million Dollars ($4,000,000.00);
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Four Million Dollars
($4,000,000.00) is hereby appropriated from the Mississippi River
Construction Fund to pay the District's share for the construction
of Lemay Wastewater Treatment Plant - Aeration Tanks, Service
Building and Instrumentation, Contract PA-62, and to be used as
needed as an advance payment to the contractor of amounts due and
owing under such contract, but not yet received from aforesaid
grants in aid of construction.
Section Two. The sums of money to be received from the
United States Environmental Protection Agency for its seventy-five
percent (75%) grant and the Missouri Department of Natural
Resources fifteen percent (15%) grant for this project shall be
placed in the Mississippi River Construction Fund and are hereby
appropriated to pay the costs incurred by Contract PA-62, the
estimated total cost of which is Sixteen Million Eight Hundred
Ninety-six Thousand Dollars ($16,896,000.00). Such funds shall
also be used to repay the District for any sums advanced by it
over and above its share of such costs.
Section Three. This ordinance, being an appropriation
ordinance, shall become effective immediately upon its enactment. The foregoing Ordinance was adopted November 23, 1977.
