COUNCIL. MINUTES
September 20, 1958
The Council of Bel Harbour Village met at 9:30 a.m.,
Saturday morning, September 20, 1958, at the Village
Hall,
Those present were: Messrs. Brown, Beatty, Broeman,
Faulkner and Hart.
Absent: None.
Also present were W. H. Webb, Village Manager; Mary
T. Wetterer, Village Clerk; and Thomas Anderson, Attorney
for the Village.
The minutes of the regular meeting of July 26, 1958,
were accepted as submitted on motion of Mr. Hart, second—
ed by Mr. Faulkner.
A certificate of honor for no traffic deaths during
1957 was presented by Troopers J. F. Waldron and W. T.
Joyce of the Florida Highway Patrol to the Village of
Bel Harbour, and received by Mayor Brown in behalf of
our Village. Our police department was highly praised
by Trooper Waldron in his presentation speech.
Mr. Fairbrother, Assistant Operations Manager of the
Americana Hotel, appeared before the Council with the re—
quest that the Americana be permitted to use the lower
garage area for exposition purposes for the coming con—
vention of the Institute of Radio Engineers which begins
Monday, September 22, 1958. He said that: they would not
make this request again during 1958, and a motion was
made by Mr. Hart that the Council allow the Americana
to use the garage for one time beginning Monday, Septem—
ber 22. This motion was seconded by Mr. Faulkner and
unanimously passed.
The next order of business was the consideration of
Resolution No. 59 and Ordinance No. 66, prepared by our
Village Attorney at the request of the Village Manager
after the July 26th meeting. Said resolution and ordi—
nance establish the policy of our Village Council with
regard to the participation in the Tri—City Library.
Mr. Anderson explained that it was necessary to pass
this resolution and ordinance in order to set up an
election date, at which time the taxpayers in Bal Har—
bour shall decide whether or not 3a1 Harbour Village

should enter into suusidiziny a public library jointly
with the Town of Bay Harbor Islands and the Town of
Surfside. Thereupon, Mr. Beatty made a motion to
adopt Resolution #59, entitled
"A RESOLUTION OF TEE COUNCIL OF

TO AMEND THE CHARTER OF RAL
HARBOUR VILLAGE"
and Ordinance #66, entitled
"AN ORDINANCE OF RAL HARBOUR VILLAGE,
FLORIDA, SETTING LP AN ELECTION
APRIL 7, 1959 FOR THE PURPOSE OF
AMENDING THE CHAF.T!LR oF THE VILLAGE
TO INT'L'UDE TAX FUNDS FOR A LIBRARY
FUND"
The motion was seconded by Mr. Hart, and unanimously
carried.
The Sinclair Refining Company station's request
to be allowed tc install equipment tr do wheel align-
ment work was then brought before the Council. Mr.
'ehh said it was tabled at the July meeting until he
could make a study of the work involved. He said that
he did not Feel that an amendment to the zoning ordi-
nance would he necessary in order tc permit this. He
said he did not intend for Mr. Brush to go into heavy
front end work but he did feel that wheel alignment
was properly a part of the service that. should be ren-
dered by a gas station. Mr. Brown recommended that the
Sinclair people he allowed to install the necessary
equipment to do this work.
The Village Manayer stated that he had talked
with Mr. Campbell, Dade County Manager, with reference
to the proposed dredging to he done at Baker's Haul -
over, and that Mr. Campbell said the County had re-
ceived all the engineering estimates to replenish the
sand -starved beaches and that 170,000 cubic yards
would be needed but he did not know how much of this
would he used north of the cut and how much south of
the cut. Mr. Campbell said he found out that the County
Park Department had $100,000 to do dredging this year
that was necessary to preserve the county beaches, and
until he has the estimates broken down he cannot tell
how much will be put on our side. He said they are now
advertising for dredging contractors to give them a
figure and when he receives this figure he wants to
discuss with us a scheme for financir,3 our share of it.
Mr. Brown suggested that everything pertaining to the

Baker's Haulover project remain in status quo for the
time being, and Mr. Wehb said he thinks Mr. Campbell
feels the same way at this time. He said that Mr.
Anderson, the County Engineer, and Mr. Whittaker have
been in contact with each other in this matter. Mr.
Halt brought up the subject of groynes, and asked
whether or not people were to be encouraged to put
them in now. Mr. Webb said that recommendation is
forthcoming and that Mr. Whittaker had intimated that
two groynes should he put in now. This matter was
tabled until the next meeting.
Mr. Wehb then read a letter from Leonard H.
Wolf, of the Robin & Albert Enterprises, which letter
was dated July 28, 1958, and had reference to the re—
moval of the temporary buildings on Tracts "C" and "E"
of the Ocean Front Addition to Ba1 Harbor. This letter
was in reply to Mr. Anderson's legal notice to them.
Mr. Webb said that their architect, Mr. Tr5p Russell,
has been in our office several times with plans, etc.,
and that requirements of all setbacks have been met.
Mr. Broeman said he felt that Mr. Anderson should
write them a letter stating that unless construction
was started at a certain time, the buildings would
have to be removed. Thereupon, Mr. Beatty made a
motion that Mr. Anderson be instructed to write the
principals that unless they take nut a building per—
mit by December 1, 195E, the said buildings would
have to come down, either by them or by us at their
expense. Mr. Brceman seconded the motion and it
passed unanimously.
At this point, Mr. Broeman brought up the sub—
ject of the old building next to the Village Hall
which was formerly used as a Village Ha11. He said
he felt that it was ridiculous to think of going
through another winter with that building standing
there and he suggested that Mr. Webb send a letter
somewhat similar to the other one to Bel Harbour
Shops, Inc., and if they don't get it out of the way
by a certain date, we will tear it down. He then
made a motion that the City Attorney, Mr. Anderson,
notify the parties who are the owners of this build—
ing just adjacent to the City Hall that they have had
more time than necessary to remove this building and
that they have until December 1, 1958, unless a per—
mit is taken out for the shopping center, otherwise
the city will tear it down. Motion was seconded by
Mr. Hart and passed unanimously.
The Village Manager said he had met with the
City Managers of Surfside and Bay Harbor Islands
relative to getting a site for a motor vehicle in—
spection station to comply with the Metro order.

Neither of them was able to come up with a feasible
plan. Mr. Webb said he then made a request to the
Sinclair Refining Company and their Legal Department
in the New York office has come through with an agree—
ment which he sent to Mr. Anderson for his approval.
He said their offer involves a piece of land at the
northwest corner of their property adjacent to the
easement that they have with Whitman's company, and
the Sinclair people would lease us this piece of land
for $1.00 a year, so that the city could operate back
in that corner. Mr. Webb advised the Council that in
his opinion this site was not satisfactory. He said
he had talked with Mr. Campbell to see if it would be
possible to have the county provide land up in the
park north of Baker's Haulover, and that Mr. Campbell
had said to wait until after September 30th. This
was tabled until the October meeting.
A letter to all the voters of the Village,
urging them to vote Yes on the Autonomy Amendment
on September 30th was then brought before the meet—
ing and it was agreed that it shculd be sent out
immediately, and that a second letter reminding
them again should he sent out by the Village Manager
just a few days prior to September 30th. Mayor
Brown then proclaimed that September 30th be de—
clared "Bal Harbour Autonomy Day."
The Village Manager then requested that in
accordance with the Village Chaster, Section 44,
he he allowed to transfer funds from appropriations
in Department 5 in order to balance the budget in
Departments 1, 2, 3 & 6. Mr. Hart moved that Mr.
Webb be allowed to transfer sufficient funds to
the various departments to balance the budget. This
was seconded by Mr. Faulkner and passed unanimously.
Mr. Webb suggested that he be permitted to
proceed to do some capital improvement on 96th
Street alongside the new hotel — to construct some
curb, gutter, and sidewalk from Collins Avenue
down to the ocean, and also to construct a side—
walk from 96th Street on the east side of West Bal
Harbour Boulevard to the north end of the park which
lies north of the Hank. Mr. Faulkner moved that the
City Manager be instructed to have our Village Engi—
neer draw plans for this proposed work. The motion
was seconded by Mr. hart and unanimously carried.
Miss Wetterer then distributed the annual $1.00
salary to each of the councilmen for this fiscal year.

Mr. Faulkner asked the Council whether per—
mission could be granted a political candidate to
erect a sign in Bel Harbour if he had the lot owner's
permission. After discussion, Mayor Brown said he
believed it would be better not to allow such signs
to be erected, as long as it did not conform to our
sign ordinance, and it was the concensus of those
present that this type of sign not he nermitted.
Mr. Beatty then described to the Council the
annual International City Managers' Conference which
will be held in Dallas, Texas, October 19th through
the 22nd. It was pointed out that since the incep—
tion of the Village in 1946 our Manager has never
been sent to this annual conference and he felt that
Bal Harbour should have a representative there; there—
upon, he made a motion that Mr. Webb be authorized to
represent Ba1 Harbour at this meeting, and that travel
and hotel expenses of Mr. and Mrs. Webb be paid by
the Village. Motion was seconded by Mr. Faulkner and
unanimously carried.
There being no further business, the meeting
was adjourned.
