AN ORDINANCE authorizing reimbursement to The
Metropolitan St. Louis Sewer District or to any of its
subdistricts of sums advanced to the Operation, Maintenance and
Construction Improvement Fund of Subdistrict No. 383 (LaVenta-
LaSierra) and transferring any moneys received or to be received
by said Fund to the District or any such subdistrict, and upon
completion of such repayment, then to the Operation, Maintenance
and Construction Improvement Fund, Coldwater Creek Trunk
Subdistrict, to be used within that subdistrict for storm sewer
improvements.
WHEREAS, Subdistrict No. 383 (LaVenta-LaSierra),
created by Ordinance No. 2523, adopted February 13, 1974, and its
Operation, Maintenance and Construction Improvement Fund have
accomplished the purposes for which they were established, but owe
substantial sums advanced by the District or its subdistricts, and
should remain in effect until such sums are repaid; and
WHEREAS, the Coldwater Creek Trunk Subdistrict area
contains the area of said Subdistrict No. 383 (LaVenta-LaSierra),
and its Operation, Maintenance and Construction Improvement Fund
is for the same purpose as that of said Subdistrict No. 383, i.e.,
the construction of stormwater facilities,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That all sums of money in the Operation,
Maintenance and Construction Improvement Fund of Subdistrict No.
383 (LaVenta-LaSierra) are hereby authorized to be reimbursed to
the District or any of its subdistricts, which advanced funds to
said Subdistrict No. 383, and any sums to be received by the said
Operation, Maintenance and Construction Improvement Fund of
Subdistrict No. 383 (LaVenta-LaSierra) derived from the collection
of delinquent taxes or from any other source, are hereby
authorized to be used to repay any such previously advanced funds,
and thereafter to be transferred to the Operation, Maintenance and
Construction Improvement Fund of Coldwater Creek Trunk Subdistrict
to be used for storm sewer improvements within that subdistrict. The foregoing Ordinance was adopted March 22, 1978.
