HomeMy Public PortalAbout03729 O R D I N A N C E NO. 3729 AN ORDINANCE, amending Section Two of Ordinance No. 3359, as adopted November 9, 1977, by revising the boundaries of Subdistrict No. 439 (Tanzberger Drive) of The Metropolitan St. Louis Sewer District, and repealing Ordinance No. 3450, as adopted February 8, 1978, and Ordinance No. 3525, as adopted June 16, 1978, both of which previously amended the boundaries of said subdistrict, with an emergency clause. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 3450, as adopted February 8, 1978, is hereby repealed. Section Two. Ordinance No. 3525, as adopted June 16, 1978, is hereby repealed. Section Three. Ordinance No. 3359, as adopted November 9, 1977, is hereby amended by revising the boundaries of Subdistrict No. 439 (Tanzberger Drive), as set forth in Section Two thereof, to exclude an area described as follows: Beginning at a point in the south line of Cliff Cave Road, said point being 840'∀ east of the east line of Telegraph Road 60' wide, said point also being the northwest corner of Lot 28 of E. Tanzberger Subdivision, a subdivision as per plat thereof recorded in Plat Book 42, Page 40, of the St. Louis County Recorder's Office, St. Louis County, Missouri; thence southwardly along the west line of said Lot 28 to a point, said point being distant 100' northwardly of the 2 southwest corner of said Lot 28; thence south 83Ε 58' east along a line, said line being parallel to the south line of Lot 28, to a point, said point being in the eastern line of said Lot 28, said point also being distant 99.95' northwardly of the southeast corner of said Lot 28; thence northwardly along the eastern line of said Lot 28 to a point in the south line of Cliff Cave Road, said point being also the northeast corner of said Lot 28; thence westwardly along the south line of Cliff Cave Road to the point of beginning. for the reason that the Board of Trustees, pursuant to an engineering investigation, finds that such excluded area is not described by deed or record and the exclusion of such is more equitable, relative to said Subdistrict No. 439. Section Four. Section Two of said Ordinance No. 3359, as hereby amended, shall read as follows: "Section Two. The boundaries of Subdistrict No. 439 (Tanzberger Drive) shall be as follows: 3 TANZBERGER DRIVE Beginning at the northwest corner of Lot 24 of E. Tanzberger Sub- division, a subdivision as per plat thereof recorded in Plat Book 42, Page 40, St. Louis County, Mo. Recorder's office; thence east- erly along the north line of said Lot 24 and the prolongation thereof to the northwest corner of Lot 25 of said subdivision; thence southerly along the western line of said Lot 24 to the southwest corner thereof; thence easterly along the south line of Lots 25, 26, and 27 of said subdivision to the southwest corner of Lot 28 of aforementioned subdivision; thence northwardly along the western line of Lot 28 distant 100' to a point; thence easterly south 83Ε 58' east along a line, said line also being parallel to the south line of said Lot 28, to a point in the eastern line of said Lot 28, said point also being in the eastern line of said E. Tanzberger Subdivision; thence southwardly along the eastern line of said E. Tanzberger Subdivision to the southeast corner of Lot 14 of said E. Tanzberger Subdivision; thence north 83Ε 58' west along the south line of Lots 14, 13, 12 and 11 of said subdivision to a point in the south line of Lot 11, said point being 125.15' east of the centerline of Fremont Lane; thence southwardly along a line parallel to and a distance of 125.15' east of the centerline of Fremont Lane a distance of 175' to a point, said point lying within the property conveyed to Verland A. Lappe and Naomi L. 4 Lappe, his wife, by deed recorded in Book 2794, Page 402, St. Louis County Recorder's office; thence north 83Ε 58' west a distance of 250.30' to a point, said point lying within the property conveyed to Frank W. Fenton and Dolores A. Fenton, his wife, by deed recorded in Book 2801, Page 300, St. Louis County Recorder's office; thence northwardly along a line parallel to and a distance of 125.15' west of the centerline of Fremont Lane a distance of 175' to a point, said point being in the south line of Lot 8 of E. Tanzberger Subdivision; thence north 83Ε 58" west along the south line of Lots 8, 7, 6 and 5 of said subdivision to a point, said point being 175' east of the east line of Telegraph Road, 60' wide; thence southwardly along a line parallel to and a distance 175' east of the east line of Telegraph Road, 60' wide, a distance of 100' to a point, said point being on the south line of property conveyed to Paul T. Bles and Marilyn Bles, his wife, by deed recorded in Book 6643, Page 1161, St. Louis County Recorder's office; thence westwardly along the south line of said Bles property 175' to a point, said point being in the east line of Telegraph Road, 60' wide; thence northwardly along the east line of Telegraph Road, 60' wide, to the point of beginning. Section Five. The need for sanitary sewer projects for the protection of public health in Subdistrict No. 439 (Tanzberger Drive), the boundaries of which are hereby amended, has created an emergency within the meaning of the plan; accordingly, this Ordinance shall take effect immediately upon its enactment. 5 The foregoing Ordinance was adopted February 28, 1979.
