AN ORDINANCE TO AMEND SECTION PAD.12 OF SECTION 3 OF THE TIFFIN
ZONING ORDINANCE TO MODIFY THE TIME REQUIREMENTS FOR THE
PLANNING AND ZONING COMMISSION TO REVIEW AND TAKE ACTION ON
PAD APPLICATIONS.
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to amend section PAD.12 of Section 3
of the Tiffin Zoning Ordinance in order to alter application submission processes and time
requirements.
Section II. Amendment: Subsection PAD.12 of Section 3 of the Tiffin Zoning Ordinance is
hereby amended as follows:

PAD
.12 PAD APPLICATIONS:
A. PAD Request shall follow the same requirements of any other re-zoning request.
B. A PAD Application must follow all time requirements of a Rezoning request and in
addition any PAD Application submitted will be reviewed at two regular meetings of the
Planning and Zoning Commission, and no action will be taken by the Planning and Zoning
Commission on the application prior to the second regular meeting. Any applicant is
encouraged to bring any preliminary proposal to the P&Z for comment and review prior to
formal application.
C. An application must be in writing; and include the following:
1. Payment of fees as set by resolution of the Council
2. List of all items in conflict with zone regulations and design standards and
including reasons for the conflicts.
3. Twenty copies of platting plans, construction plans, building and drainage
plans, all drawn to scale
4. Name and contact information for the engineer or planner
5. Twenty copies of covenant documents or any other relevant information
requested by the P&Z or City Council.
6. A list of all title holders and their current addresses of all property owners
located within 200' of the proposed PAD area.
7. The owners and developers names and contact information.
8: The legal description of the area being addressed in the application
9. A Landscaping Plan.
Section III. Repealer. All ordinances or parts of ordinance in conflict with the provisions of
this Ordinance are hereby repealed.
Section IV. Severability Clause. If any section, provision or part of this Ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance
as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section V. When Effective. This Ordinance shall be in effect after its final passage, approval,
and posting as provided by law.
On the 26th day of March 2014, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2014-353, and moved that it be given its first
reading. The motion was seconded by Councilperson Kahler.
Ayes: Kahler, Ryan, Petersen, Bartels, Upton
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared
the motion carried, and Ordinance No. 2014-353, was read the first time, discussed, and placed on
record.
On the 09th day of April 2014, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2014-353, and moved that.it.be given its second
reading. The motion was seconded by Councilperson Upton.
Ayes: Kahler, Ryan, Petersen, Bartels, Upton
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared
the motion carried, and Ordinance No. 2014-353, was read the second time and discussed and
placed on record.
On the 23rd day of April 2014, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2014-353, and moved that it be given its third and
last reading. The motion was seconded by Councilperson Upton.
Ayes: Kahler, Ryan, Petersen, Bartels, Upton
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared
the motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2014-353 be adopted and signified his
approval of same by fixing his signature thereto. Passed by the Council on the 23rd day of April
2014 and approved by the Mayor on the 28th day of April 2014.

23rd day of April 2014, and signed by the Mayor on the 28th day of April 2014, and published on the
28th day of April 2014, by posting copies thereof in three public places within the limits of the City
of Tiffin, Iowa. That I posted copies of Ordinance No. 2014-353 in the following places:
