HomeMy Public PortalAbout03799 O R D I N A N C E NO. 3799 AN ORDINANCE, vacating portions of sewer easements in Lots 132, 133, 134, 135, 136, 137, 138, 139 and 140 of Yorkshire Estates No. 27 Subdivision, in St. Louis county, Missouri. WHEREAS, the owners of the subject properties have requested the District to vacate said portions of the subject easements and this District has no further use for said portions of the subject easements, and WHEREAS, the owners of the subject properties have granted alternate easements to the District, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The portions of the sewer easements described below are hereby vacated, to wit: A 2.50 foot wide strip of land in Lots 132, 133, 134, 135, 136, 137, 138 and 139 of "YORKSHIRE ESTATES NO. 27", recorded in Plat Book 181, Page 30, St. Louis County Recorder's Office, being the southern portion or southeastern portion of the existing 10 foot wide sewer easement; said 2.50 foot wide strip being more particularly described as follows: LOT 132 COMMENCING at the point of intersection of the southern line of said Lot 132, with the western line of David Scott Drive, 50 feet wide; thence North 88 degrees 42 minutes 45 seconds West 84.95 feet along the southern line of said Lot 132; thence North 09 degrees 33 minutes 52 seconds East 5.05 feet to the point of 2 beginning of the herein described sewer easement to be vacated; thence continuing North 09 degrees 33 minutes 52 seconds East 83.46 feet along the eastern line of said existing 10 foot wide sewer easement in said Lot 132 to a line distant 5.00 feet south of and parallel with the northern line of said Lot 132; thence North 72 degrees 09 minutes 30 seconds West 2.53 feet along said line parallel with the northern line of said Lot 132 to a line distant 2.50 feet west of and parallel with the eastern line of said existing 10 foot wide sewer easement; thence South 09 degrees 33 minutes 52 seconds West 84.20 feet along said line 2.50 feet west of and parallel with the eastern line of said 10 foot wide sewer easement to a line distant 5.00 feet north of and parallel with the southern line of said Lot 132; thence South 88 degrees 42 minutes 45 seconds East 2.53 feet along said line parallel with the southern line of said Lot 132 to the point of beginning. LOT 133 COMMENCING at the point of intersection of the northeastern line of said Lot 133 with the northwestern line of said David Scott Drive; thence North 55 degrees 36 minutes 30 seconds West 845.95 feet along the northeastern line of said Lot 133; thence South 26 degrees 07 minutes West 5.05 feet to the point of beginning of the herein described sewer easement to be vacated; thence continuing South 26 degrees 07 minutes West 80.93 feet along the southeastern line of said existing 10 foot wide sewer easement in said Lot 133 to the northern line of an irregular 3 shaped sewer easement in said Lot 133; thence North 67 degrees 04 minutes West 2.50 feet along the northern line of said irregular shaped sewer easement to a line distant 2.50 feet northwest of and parallel with the southeastern line of said existing 10 foot wide sewer easement; thence North 26 degrees 07 minutes East 81.44 feet along said line 2.50 feet northwest of and parallel with the southeastern line of said 10 foot wide sewer easement to a line distant 5.00 feet southwest of and parallel with the northeastern line of said Lot 133; thence South 55 degrees 36 minutes 30 seconds East 2.53 feet along said line parallel with the northeastern line of said Lot 133 to the point of beginning. LOTS 134 and 135 COMMENCING at the point of intersection of the southwestern line of said Lot 134 with the northwestern line of said David Scott Drive; thence North 55 degrees 36 minutes 30 seconds West 84.97 feet; thence North 40 degrees 45 minutes 15 seconds East 5.03 feet to the point of beginning of the herein described sewer easement to be vacated; thence continuing North 40 degrees 45 minutes 15 seconds East 79.07 feet along the southeastern line of said existing 10 foot wide sewer easement in said Lot 134 to an angle point; thence North 59 degrees 13 minutes 15 seconds East 98.40 feet along the southeastern line of said existing 10 foot wide sewer easement in said Lot 135 to a line distant 5.00 feet southwest of and parallel with the northeastern line of said Lot 135; thence North 22 degrees 30 minutes 15 seconds West 2.53 feet along said line parallel with the northeastern line of said Lot 4 135 to a line distant 2.50 feet northwest of and parallel with the southeastern line of said existing 10 foot wide sewer easement; thence South 59 degrees 13 minutes 15 seconds West 89.22 feet along said line 2.50 feet northwest of and parallel with the southeastern line of said existing 10 foot wide sewer easement to an angle point, said angle point being in the southwestern line of said Lot 135; thence South 47 degrees 40 minutes 15 seconds West 26.20 feet to a line distant 2.50 feet northwest of and parallel with the southeastern line of said existing 10 foot wide sewer easement in said Lot 134; thence South 40 degrees 45 minutes 15 seconds West 63.20 feet along said line 2.50 feet northwest of an parallel with the southeastern line of said existing 10 foot wide sewer easement in said Lot 134 to a line distant 5.00 feet northeast of and parallel with the southwestern line of said Lot 134; thence South 55 degrees 36 minutes 30 seconds East 2.52 feet along said line parallel with the southwestern line of said Lot 134 to the point of beginning. LOTS 136, 137, 138 AND 139 COMMENCING at the point of intersection of the southwestern line of said Lot 136 with the northwestern line of said David Scott Drive; thence North 22 degrees 30 minutes 15 seconds West 84.95 feet along the southwestern line of said Lot 136; thence North 59 degrees 13 minutes 15 seconds East 5.05 feet to the point of beginning of the herein described sewer easement to be vacated; thence continuing North 59 degrees 13 minutes 15 seconds East 41.20 feet along the southeastern line of said existing 10 foot 5 wide sewer easement in said Lot 136 to an angle point; thence North 85 degrees 08 minutes 30 seconds East 291.70 feet along the southern line of said existing 10 foot wide sewer easement in said Lots 136, 137, 138 and 139 to the eastern line of said Lot 139; thence North 04 degrees 51 minutes 30 seconds West 2.50 feet along the eastern line of said Lot 139 to a line distant 2.50 feet north of and parallel with the southern line of said existing 10 foot wide sewer easement; thence South 85 degrees 08 minutes 30 seconds West 280.37 feet along said line 2.50 feet north of and parallel with the southern line of said existing 10 foot wide sewer easement in said Lot 136 to an angle point; thence South 75 degrees 21 minutes 15 seconds West 18.51 feet to a line distant 2.50 feet northwest of and parallel with the southeastern line of said existing 10 foot wide sewer easement in said Lot 136; thence South 59 degrees 13 minutes 15 seconds West 34.35 feet along said line 2.50 feet northwest of and parallel with the southeastern line of said existing 10 foot wide sewer easement to a line distant 5.00 feet northeast of and parallel with the southwestern line of said Lot 136; thence South 22 degrees 30 minutes 15 seconds East 2.53 feet along said line parallel with the southwestern line of said Lot 136 to the point of beginning. LOT 140 A 2.50 foot wide strip of land in Lot 140 of "YORKSHIRE ESTATES NO. 27", recorded in Plat Book 181, Page 30, St. Louis County Recorder's Office, being the southern portion of the exist- ing 10 foot wide sewer easement in said Lot; said 2.50 foot wide 6 strip being more particularly described as follows: COMMENCING at the point of intersection of the western line of said Lot 140 with the northern line of David Scott Drive, 50 feet wide; thence North 04 degrees 51 minutes 30 seconds West 90.00 feet along the western line of said Lot 140 to the southern line of said existing 10 foot wide sewer easement; thence North 85 degrees 08 minutes 30 seconds East 72.00 feet along the southern line of said existing 10 foot wide sewer easement in said Lot 140 to a line distant 8.00 feet west of and parallel with the eastern line of said Lot 140; thence North 04 degrees 51 minutes 30 seconds West 2.50 feet along said line parallel with the eastern line of said Lot 140 to a line distant 2.50 feet north of and parallel with the southern line of said existing 10 foot wide sewer easement; thence South 85 degrees 08 minutes 30 seconds West 72.00 feet along said line 2.50 feet north of and parallel with the southern line of said existing 10 foot wide sewer easement in said Lot 140 to the western line of said Lot 140; thence South 04 degrees 51 minutes 30 seconds East 2.50 feet along the western line of said Lot 140 to the point of beginning. 7 The foregoing Ordinance was adopted June 27, 1979.
