HomeMy Public PortalAbout04037 O R D I N A N C E NO. 4037 AN ORDINANCE, vacating sewer easements in Parkwood Acres in St. Louis County, Missouri, WHEREAS, the owner of the subject property has requested the District to vacate the subject easements and this District has no further use for the subject easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sewer easements in Parkwood Acres in St. Louis County, Missouri as described below are hereby vacated, to wit: A tract of land being Lots 32, 34, 35, 36, 37, 38, 39, and part of Lot 33, and part of Parkwood Court North, 50 feet wide, of "Parkwood Acres Plat Three", a subdivision according to the plat thereof recorded as Daily Number 125 on January 2, 1952 in St. Louis County Records in Township 46 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as: Beginning at the Northeast corner of "Colonial Manor Plat Five", a subdivision according to the plat thereof recorded as Daily Number 31 on June 1, 1965 in the St. Louis County Records, said point being also a point on the West line of "Parkwood Acres Plat Two", a subdivision according to the plat thereof recorded as Daily Number 196 on September 6, 1949 in the St. Louis County Records; thence Westwardly along the North line of "Colonial Manor Plat Five", "Colonial Manor Plat Two", and property now or formerly of Ira N. Merrel and wife as described in the deed recorded in Book 6754, page 1211 of the St. Louis County Records North 89 degrees 53 minutes 30 seconds West 1,573.59 feet to a point on the East line of Interstate Highway 270; thence Northwardly along said East line North 10 degrees 22 minutes East 37.46 feet to a point on the boundary line of said "Parkwood Acres Plat Three"; thence along the boundary line of said "Parkwood Acres Plat Three" the following courses and distances: North 67 degrees 40 minutes East 822.15 feet to a point; thence North 22 degrees 32 minutes West 737.77 feet to a point; thence North 52 degrees 01 minute East 836.76 feet to a point; thence South 41 degrees 25 minutes 15 seconds East 284.33 feet to a 2 point on the Northwest line of Parkwood Court North, 50 feet wide; thence Northeastwardly along said Northwest line North 48 degrees 34 minutes 45 seconds East 255.45 feet to a point; thence South 41 degrees 25 minutes 15 seconds East 50 feet to a point on the Southeast line of Parkwood Court North, 50 feet wide; thence Southwestwardly along said Southeast line South 48 degrees 34 minutes 45 seconds West 254.53 feet to a point on the boundary line of aforesaid "Parkwood Acres Plat Three"; thence along the boundary line of said "Parkwood Acres Plat Three" the following courses and distances: South 41 degrees 25 minutes 15 seconds East 178.83 feet to a point; South 48 degrees 13 minutes East 418.48 feet to a point; South 25 degrees 41 minutes 51 seconds West 444.49 feet to a point on the North right-of-way line of Parkwood Court East, 50 feet wide; thence along the said right-of-way line of Parkwood Court East the following courses and distances: North 64 degrees 16 minutes West 66.42 feet to a point; thence along a curve to the left whose radius point bears South 25 degrees 44 minutes West 50 feet from the last mentioned point, a distance of 209.44 feet to a point; thence along a curve to the right whose radius point bears South 34 degrees 15 minutes 58 seconds East 50 feet from the last mentioned point, a distance of 52.36 feet to a point on the aforesaid West line of "Parkwood Acres Plat Two"; thence Southwardly along said West line South 3 degrees 44 minutes 56 seconds West 401.95 feet and South 0 degrees 14 minutes West 30.20 feet to the point of beginning. According to calculations from a Survey made by Volz Engineering & Surveying, Inc. on April 18, 1978. A tract of land being part of Lots 1, 2, 3, 4, 5, 9, and 10 of "Parkwood Acres", a subdivision according to the plat thereof recorded as Daily Number 151 on March 15, 1948 in the St. Louis County Records in Township 46 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as: Beginning at the intersection of the East line of Interstate Highway 270 with the West line of said Lot 1 of "Parkwood Acres"; thence along the right-of-way line of said Interstate Highway 270 the following courses and distances: North 18 degrees 57 minutes 45 seconds East 185.26, North 50 degrees 49 minutes 44 seconds East 223.44 feet, North 10 degrees 22 minutes East 150 feet, North 24 degrees 13 minutes 32 seconds West 176.14 feet and North 28 degrees 36 minutes 27 seconds East 132.25 feet to a point on the Southeast line of McKelvey Road; thence Northeastwardly along said Southeast line North 56 degrees 43 minutes 37 seconds East 65.59 feet to a point; thence South 37 degrees 59 minutes East 285.33 feet to a point; thence North 48 degrees 37 minutes 29 seconds East 189.21 feet to a point; thence South 41 degrees 23 minutes East 430.27 feet to a point; thence North 48 3 degrees 37 minutes East 65.86 feet to a point; thence South 41 degrees 25 minutes 15 seconds East 319.09 feet to a point on the Northwest line of Parkwood Court North, 50 feet wide; thence Southwestwardly along said Northwest line South 48 degrees 34 minutes 45 seconds West 255.45 feet to a point; thence North 41 degrees 25 minutes 15 seconds West 284.33 feet to a point; thence South 52 degrees 01 minute West 836.76 feet to the most Southern corner of said Lot 1 of "Parkwood Acres"; thence Northwardly along aforesaid West line of Lot 1 North 22 degrees 32 minutes West 338.39 feet to the point of beginning. A tract of land being part of Lots 11, 12, 13, 14, and 15 of "Parkwood Acres", a subdivision according to the plat thereof recorded as Daily Number 151 on March 15, 1948 in the St. Louis County Records in Township 46 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as: Beginning at the most Western corner of said Lot 11 of "Parkwood Acres", said point being also a point on the Southeast line of Parkwood Court North, 50 feet wide; thence Northeastwardly along said Southeast line of Parkwood Court North, 50 feet wide North 48 degrees 34 minutes 45 seconds East 254.53 feet to a point; thence South 41 degrees 25 minutes 15 seconds East 162.50 feet to a point; thence North 44 degrees 54 minutes 31 seconds East 145.48 feet to a point; thence South 48 degrees 15 minutes 58 seconds East 336.25 feet to a point; thence North 41 degrees 44 minutes 07 seconds East 133.76 feet to a point; thence South 48 degrees 13 minutes East 329 feet to a point on the Southeast line of said Lot 15; thence Southwestwardly along said Southeast line South 41 degrees 41 minutes 15 seconds West 506.78 feet to a point; thence North 83 degrees 14 minutes 23 seconds West 47.40 feet to a point; thence North 48 degrees 13 minutes West 649 feet to a point; thence North 41 degrees 25 minutes 15 seconds West 178.83 feet to the point of beginning. A tract of land being part of Parkwood Court North, 50 feet wide, as shown on the plat of "Parkwood Acres Plat Three", a subdivision according to the plat thereof recorded as Daily Number 125 on January 2, 1952, in the St. Louis County Records in Township 46 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as: 4 Beginning at the most Southern corner of Lot 10 of "Parkwood Acres", a subdivision according to the plat thereof recorded as Daily Number 151 on March 15, 1948, in the St. Louis County Records, said point being also a point on the Northwest line of said Parkwood Court North, 50 feet wide; thence Northeastwardly along said Northwest line of Parkwood Court North, 50 feet wide, North 48 degrees 34 minutes 35 seconds East 255.45 feet to a point; thence South 41 degrees 25 minutes 15 seconds East 50 feet to a point on the Southeast line of said Parkwood Court North, 50 feet wide; thence along the right-of-way line of said Parkwood Court North, 50 feet wide, the following courses and distances: South 48 degrees 34 minutes 45 seconds West 539.30 feet to a point; thence along a curve to the left whose radius point bears South 41 degrees 25 minutes 15 seconds East 50 feet from the last mentioned point, a distance of 36.14 feet to a point; thence along a curve to the right whose radius point bears North 82 degrees 49 minutes 50 seconds West 50 feet from the last mentioned point, a distance of 229.35 feet to a point; thence along a curve to the left whose radius point bears North 0 degrees 00 minutes 40 seconds West 50 feet from the last mentioned point, a distance of 36.14 feet to a point; thence North 48 degrees 34 minutes 45 seconds East 283.85 feet to the point of beginning.
