HomeMy Public PortalAbout04153 O R D I N A N C E NO. 4153 AN ORDINANCE, declaring the necessity for the acquisition of certain real property within The Metropolitan St. Louis Sewer District for the purpose of acquiring a portion of the flood plain of Gravois Creek in order to enable the District to relocate the channel of Gravois Creek at this location. WHEREAS, the present channel of Gravois Creek has eroded adjacent to occupied residential property, and WHEREAS, the acquisition of said real property will enable the District to relocate the Gravois Creek channel a safe distance from said residential property, and also to improve the flood characteristics of Gravois Creek, and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by relocating the Gravois Creek channel in said area to relieve and alleviate said erosion conditions, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve and alleviate insanitary and dangerous erosion conditions, it is necessary to appropriate and acquire by the exercise of eminent domain, or otherwise the real property being more particularly described as follows: 2 PARCEL 1 A parcel of ground being part of Blk 7 & 36 of Carondelet Commons, South of the River des Peres, Township 44 North, Range 6 East, St. Louis County, Mo., said parcel being more particularly described as follows: Beginning at the most Southern corner of said Block 7; thence North 54o 07' 00" West 244.89 feet along the Southwest line of said Block 7 to the East line of the Missouri Pacific Railroad Right of Way, 100 feet wide; thence Northwardly along the East line of the Missouri Pacific Railroad Right of Way 1,429.89 feet along a curve to the right, having a radius of 1,382.39 feet to the Southwest line of Mount Olive Road, 30 feet wide; thence South 54o 01' 00" East 769.36 feet along the Southwest line of Mount Olive Road, 30 feet wide, to the center line of Gravois Creek and the most Northern corner of property described in deed to the Santa Maria Country Club, recorded in Book 2927, Page 337 of the St. Louis County Records; thence South 35o 53' 00" West 350.00 feet along the Northwest line of said Santa Maria Country Club property to its most Western corner; thence South 54 01' 00" East 214.00 feet along the Southwest line of said Santa Maria Country Club property to the Northwest line of Diebold Terrace, a subdivision recorded in Plat Book 99, Page 65 of the St. Louis County records; thence South 35o 53' 00" West 404.95 feet along the Northwest line of said Diebold Terrace to a point; thence 3 North 54o 01' 00" West 75.00 feet to the Southeast line of said Block 7; thence South 35o 53' 00" West 438.66 feet along the Southeast line of Block 7 to the point of beginning, and containing 837,219 Square Feet or 19.220 Acres, more or less, according to a survey executed by James B. Becker, Consulting Engineers, during the month of July, 1975. PARCEL 2 A parcel of ground being part of Lots 75 and 76 of Siegerson Nursery Tract in Block 6 of Carondelet Commons South of the River des Peres, together with the Southwestern 10 feet of Roosevelt Avenue vacated by Order of the St. Louis County Court, recorded in Book 354, Page 155 of the St. Louis County records, in Township 44 North, Range 6 East, St. Louis County, Mo., said parcel being more particularly described as follows: Beginning at the point of intersection of the Southwest line of said Lot 75 and the Southeast line of the Missouri Pacific Railroad Right of Way, 100 feet wide; thence along the Southeast line of the Missouri Pacific Railroad Right of Way in a Northeastwardly direction 453.46 feet along a curve to the right, having a radius of 1,382.39 feet to a point of compound curve; thence continuing along said Southeast line in a Northeastwardly direction 463.31 feet along a curve to the right, having a radius of 1,336.19 feet to a point of tangency; thence continuing along said Southeast line North 76o 23' 08" East 363.40 feet to the 4 Southwest line of Roosevelt Avenue, 50 feet wide; thence South 53o 59' 30" East 324.32 feet along the Southwest line of Roosevelt Avenue, 50 feet wide to the Northeast prolongation of the Southeast line of said Lot 76; thence South 36o 00' 30" West 26.60 feet along said Northeast prolongation and along the Southeast line of Lot 76 to the North bank of Gravois Creek; thence North 81o 01' 45" West 116.95 feet along said North bank to an angle point; thence South 53o 53' 35" West 142.51 feet along the Northwest bank of Gravois Creek to the Northwest line of property described in deed to Santa Maria Country Club, recorded in Book 2925, Page 241 of the St. Louis County records; thence in a Southwestwardly direction along the Northwest line of said Santa Maria Country Club property the following courses and distances: South 76o 22' 25" West 168.88 feet, South 75o 16' 25" West 172.11 feet, South 67o 33' 35" West 246.26 feet, South 56o 29' 05" West 231.88 feet, and South 44o 04' 35" West 214.89 feet to the Northeast line of Mount Olive Road 30 feet wide; thence North 54o 01' 00" West 273.97 feet along the Northeast line of Mount Olive Road, 30 feet wide, to the point of beginning and containing 353,610 Square Feet or 8.118 Acres, more or less, according to a survey execute by James B. Becker, Consulting Engineers, during the month of July, 1975. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in 5 condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of the private real property as hereinabove set out. The foregoing Ordinance was adopted September 10, 1980.
