MEDINA CITY COUNCIL MEETING MINUTES OF JULY 20, 2010
The City Council of Medina, Minnesota met in special session on July 20, 2010 at 6:04
p.m. in the Medina City Hall.
I. Call to Order
Members present: Weir, Crosby, Siitari, Smith (arrived at 6:11 p.m.)
Members absent: Johnson
Also present: City Administrator Chad Adams, City Planner Dusty, City
Attorney Ron Batty, and City Management Intern Dale Cooney
II. Storm Water Utility (SWU) Charges and Closed Landfill
Adams provided a background of the issues pertaining to the payment of storm water
utility charges for the Woodlake Sanitary closed landfill owned by the Minnesota
Pollution Control Agency (MPCA). Adams discussed the potential options staff is
seeking for Council direction.
Batty discussed his memo provided in the packet and the options the City may pursue
Smith arrived at 6:11 p.m.
Discussion was held on the options to pursue, similar types of land classification, the
amount of fees, and how any fee reduction would impact the SWU budget.
The Council agreed to direct the City Staff to review options and make a recommendation
for a possible land -use classification for the landfill and to report back to the Council
prior to meeting with the MPCA.
III. Ag Preserve and Payment in Lieu of Taxes (PILOT)
Batty provided an overview of his memo in the packet on the use of PILOT for Ag
Preserve requests. He stated there exists no legal authority to condition approval of Ag
Preserve status upon agreement regarding PILOT.
Discussion took place as to whether a voluntary offer by an applicant might be
accommodated and that such an offer would be considered in more detail if it presented
itself.
The Council agreed that the legal counsel's opinion was legally correct and desired to
address the use of PILOT further if applications to Ag Preserve are made to the City.
IV. 2010 Law Summaries Update

Batty highlighted a few changes to the 2010 Jobs Bi11 that pertained to energy
assessments and Tax Increment Financing (TIF) from the 2010 legislative session.
Discussion was held on the options to both use or promote the changes to the TIF
regulations.
The Council agreed to direct Staff to distribute a mailing to key parcels in the TIF 1-9
District to provide awareness of the TIF changes.
V. Minnehaha Creek Watershed District (MCWD)— Memorandum of
Understanding
Adams stated Staff has been working with the MCWD staff to amend the language,
which the City believes to be to restrictive. Adams reviewed the language.
The Council agreed to direct Staff to soften the language more than proposed by the
MCWD.
VI. GreenStep Cities
Adams referenced the handout in the packet and requested direction to pursue the
Minnesota GreenStep Cities Program further.
The Council agreed to direct Staff to invite a GreenStep representative to attend a
Council meeting and provide a presentation.
VII. Adjournment
Weir moved, Smith seconded, to adjourn the meeting at 6:55 p.m. Motion passed
unanimously.
