HomeMy Public PortalAbout04163 O R D I N A N C E NO. 4163 AN ORDINANCE, declaring the necessity for the acquisition of the fee simple estate and every other estate and interest in certain property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of a sewage treatment and disposal plant and system to serve the needs of residents of the Meramec Basin area and authorizing the acquisition of such property by purchase or by the institution of condemnation proceedings, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Meramec Basin wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is necessary and in the public interest to appropriate and acquire by purchase or by exercise of eminent domain or otherwise, the fee simple estate and every other estate and interest in certain property for the construction of a sewage treatment and disposal plant and system as hereinafter set forth, said property being more particularly described as follows: A. Property now or formerly of NORMAN B. HEIMOS, more particularly described as follows: (1) A tract of land in U.S. Survey 3051, Townships 42 and 43 North, Range 6 East and being part of Share 2 of the Subdivision of the Bryan Mullanphy Estate, in the County of St. Louis, Missouri, and described as: Beginning at an iron pipe set in the line dividing U.S. Surveys 50 and 3051 at the corner common to Shares 2 and 3 of said subdivision and being distant North 27 degrees West 1,207.52 feet from the most Eastern corner of said Share 3; thence along the line dividing U.S. Surveys 50 and 3051, North 27 degrees West 1,377.61 feet to a stone; thence along the Southeast line of a 10 acre tract conveyed to Point Anglers, a corporation, by deed recorded in Book 503, Page 85, South 62 degrees 45 minutes West 825 feet, more or less, to the Meramec River; thence along the Meramec River in a general Southern direction to the line dividing Shares 2 and 3 of said Mullanphy Estate Subdivision; thence along said dividing line North 63 degrees 4 minutes East 1842 feet, more or less, to the beginning containing 42.48 acres, as per survey thereof executed by Elbring Surveying Company. (2) A tract in U.S. Survey 50, Township 43 North, Range 6 East in St. Louis County, Missouri, described as follows: Beginning at the point in intersection of the North line of property now or formerly of F. W. A. Vesper with the West line of Survey 50; thence North 63 degrees 23 minutes East 2044.20 feet to an iron rod; thence North 27 degrees 6 minutes West 1080 feet to an old stone; thence South 63 degrees 1 minute West 2042.20 feet to an old stone set in the West line of said Survey 50; thence South 27 degrees East 1066.75 feet to the place of beginning, EXCEPTING that part of above described property lying East of the centerline of Fine Road. (3) Part of Lot or Share 3 of Bryan Mullanphy's Estate or Subdivision in U.S. Survey 3051, Townships 42 and 43 North, Range 6 East in the County of St. Louis, 3 Missouri, and more particularly described as follows: Beginning at an old iron pipe in the East line of U.S. Survey 3051 at its intersection with the South line of tract conveyed to Frederic A. Luyties, Jr. by deed recorded in Book 1683, Page 129 of the St. Louis County records; thence along the East line of U. S. Survey 3051, South 27 degrees 0 minutes East 339.77 feet to an old stone; thence leaving said survey line and running South 63 degrees 04 minutes West 2115 feet, more or less, to a point in the East water's edge of the Meramec River from which point an iron pipe bears North 63 degrees 04 minutes East 129 feet; thence North along the East water's edge of the Meramec River to a point from which the point of beginning bears North 63 degrees 04 minutes East 1863 feet; thence North 63 degrees 04 minutes East along the South line of tract conveyed by above mentioned deed a distance of 1863 feet to the place of beginning, containing 15.51 acres, according to survey thereof executed by Elbring Surveying Company on May 23, 1941. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. Section Three. The immediate construction of said sewage treatment and disposal plant and system being necessary in order to protect the public health within the District, an emergency is hereby declared to exist within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. 4 The foregoing Ordinance was adopted September 17, 1980.
