HomeMy Public PortalAbout04401 O R D I N A N C E NO. 4401 AN ORDINANCE, authorizing the Executive Director and the Secretary-Treasurer of The Metropolitan St. Louis Sewer District to purchase from the owners thereof certain real property in St. Louis County, Missouri, for right-of-way purposes to straighten Gravois Creek, and provide flood and erosion control. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and the Secretary- Treasurer of the District are hereby authorized to purchase from the owners thereof, the following real property in St. Louis County, Missouri, for right-of-way purposes to straighten Gravois Creek, and provide flood and erosion control, at a price not to exceed Two Hundred Seven Thousand Dollars ($207,000.00), said property to be free from all encumbrances, said property described as follows: PARCEL 1. A parcel of ground being part of Block 7 of CARONDELET COMMONS, South of the River des Peres, Township 44 North, Range 6 East, St. Louis County, Missouri, said parcel being more particularly described as follows: Beginning at the point of intersection of the Northwest line of the Missouri Pacific Railroad right of way, 100 feet wide, with the Northeast line of Sherwood Forest Estates, a Subdivision recorded in Plat Book 128 Page 1 of the St. Louis County Records; thence North 54 degrees 05 minutes 30 seconds West 302.01 feet along the Northeast line of said Sherwood Forest Estates to the Southeast line of Union Road, 40 feet wide; thence North 36 degrees 27 minutes 30 seconds East 285.64 feet to the Southwest line of Mount Olive Road, 30 feet wide; thence South 54 degrees 01 minutes 00 seconds East 274.29 feet along the Southwest line of said Mount Olive Road to the Northwest line of said Missouri Pacific Railroad right of way; thence in a Southwestwardly direction along said right of way 286.81 feet, along a curve to the left, having a radius of 1,482.39 feet to the point of beginning and containing 80,926 Square Feet or 1.858 Acres, more or less. A parcel of ground being part of Lots 75 and 76 of Sigerson Nursery Tract in Block 6 of CARONDELET COMMONS, South of the River Des Peres, together with the Southwest 10 feet of Roosevelt Avenue, vacated by Order of the St. Louis County Court, recorded in Book 354 Page 155 of the St. Louis County Records, all in Township 44 North, Range 6 East, St. Louis County, Missouri, said parcel being more particularly described as follows: Beginning at the most Western corner of said Lot 75; thence North 36 degrees 27 minutes 50 seconds East 168.81 feet along the Northwest line of Lot 75 to the Southeast line of Interstate Route 55, as conveyed by deed recorded in Book 4443 Page 33 of the St. Louis County Records; thence North 50 degrees 37 minutes 50 seconds East 387.32 feet along the Southeast line of said Interstate Route 55 to an angle point therein; thence continuing along said Southeast line North 56 degrees 54 minutes 30 seconds East 614.18 feet to the Southwest line of Roosevelt Avenue, 50 feet wide; thence South 53 degrees 59 minutes 30 seconds East 360.39 feet along the Southwest line of said Roosevelt Avenue to the North line of the Missouri Pacific Railroad right of way, 100 feet wide; thence South 76 degrees 23 minutes 08 seconds West 278.36 feet along the North line of the Missouri Pacific Railroad right of way to a point of curve; thence continuing along said North line in a Westwardly direction 203.25 feet along a curve to the left, having a radius of 1,436.19 feet to the most Eastern corner of property described in deed to Clinton R. Schattgen, recorded in Book 6398 Page 1341 of the St. Louis County Records; thence South 79 degrees 14 minutes 38 seconds West 300.00 feet along the North line of said Clinton R. Schattgen property to the Northwest line of the Missouri Pacific Railroad right of way, 100 feet wide; thence in a Southwestwardly direction 484.04 feet a long a curve to the left, having a radius of 1,482.39 feet to the Northeast line of Mount Olive Road, 30 feet wide; thence North 54 degrees 01 minutes 00 seconds West 153.82 feet along the Northeast line of said Mount Olive Road to the point of beginning, and containing 216,006 Square Feet or 4.959 Acres, more or less. A parcel of ground being part of Block 7 and 36 of CARONDELET COMMONS, South of the River Des Peres, Township 44 North, Range 6 East, St. Louis County, Missouri, said parcel being more particularly described as follows: Beginning at the most Southern corner of said Block 7; thence North 54 degrees 07 minutes 00 seconds West 244.89 feet along the Southwest line of said Block 7 to the East line of the Missouri Pacific Railroad right of way, 100 feet wide; thence Northwardly along the East line of the Missouri Pacific Railroad right of way 1,429.89 feet along a curve to the right, having a radius of 1,382.39 feet to the Southwest line of Mount Olive Road, 30 feet wide; thence South 54 degrees 01 minutes 00 seconds East 769.36 feet along the Southwest line of Mount Olive Road, 30 feet wide, to the center line of Gravois Creek and the most Northern corner of property described in deed to the Santa Maria Country Club, recorded in Book 2927 Page 337 of the St. Louis County Records; thence South 35 degrees 53 minutes 00 seconds West 350.00 feet along the Northwest line of said Santa Maria Country Club property to its most Western corner; thence South 54 degrees 01 minutes 00 seconds East 214.00 feet along the Southwest line of said Santa Maria Country Club property to the Northwest line of Diebold Terrace, a subdivision recorded in Plat Book 99 Page 65 of the St. Louis County Records; thence South 35 degrees 53 minutes 00 seconds West 404.95 feet along the Northwest line of said Diebold Terrace to a point; thence North 54 degrees 01 minutes 00 seconds West 75.00 feet to the Southeast line of said Block 7; thence South 35 degrees 53 minutes 00 seconds West 438.66 feet along the Southeast line of Block 7 to the point of beginning and containing 837,219 Square Feet or 19.220 Acres, more or less. Upon execution and delivery to them by said owner of a General Warranty Deed in proper form, being free from liens and encumbrances, conveying title to the said land to The Metropolitan St. Louis Sewer District, the Executive Director and the Secretary-Treasurer shall be and are hereby authorized and directed to pay to said owners, for the said land, the total sum of Two Hundred Seven Thousand Dollars ($207,000.00). The foregoing Ordinance was adopted June 10, 1981.
