AN ORDINANCE, authorizing and directing the Executive
Director and Assistant Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to enter into an Agreement
with Gateway Properties, wherein the District agrees to contribute
one-half (1/2) of the difference between Gateway Properties
construction costs for a detention facility and a storm sewer
which will be utilized to prevent basement flooding conditions in
Mackenzie Hills Subdivision in St. Louis County, Missouri.
WHEREAS, the design and construction of said sewer by
Gateway Properties in accordance with District requirements and
needs will permit the District to eliminate the aforementioned
basement flooding conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Assistant
Secretary-Treasurer are hereby authorized and directed on behalf
of The Metropolitan St. Louis Sewer District to enter into an
Agreement with Gateway Properties, wherein the District agrees to
contribute one-half (1/2) of the difference between Gateway
Properties construction costs for a detention facility and a storm
sewer which will be utilized to prevent basement flooding
conditions in Mackenzie Hills Subdivision in St. Louis County,
Missouri.
Section Two. The Agreement authorized in Section One
of this Ordinance shall be comprised of such terms and conditions
as are approved by the Director of Legal Services of the District.
The foregoing Ordinance was adopted August 12, 1981.
