PRESENT: Chairman Melanie Shirling, Member Dee Johnson, Member Michael Thompson, Member Jake Lindsay, and City Clerk Shara Roberts. ABSENT: Member Shane Harrigfeld and Member John Lott. VISITORS: Austin Catlin and Austin Carlisle. Chairman Melanie Shirling welcomed everyone led with the Pledge of Allegiance. Approval of Minutes: Member Johnson moved to approve the minutes for October 12, 2016. Member Lindsay seconded the motion. All in favor, motion carried. Items of Business: Reappointment of Chairman Melanie Shirling — Clerk Roberts: Clerk Roberts reported the City Council approved Chairman Melanie Shirling to serve for another three (3) year term to the Planning and Zoning Commission as of October 18t, 2016. Her term will expire October 18th, 2019. Welcome New Member — Michael Thompson: Chairman Melanie Shirling welcomed newest member Michael Thompson to the Planning and Zoning Commission as of October 18th, 2016. His term will expire October 18th, 2019. Code Changes to allow for Accessory Buildings and RV Parking in R-T Zoning — Austin Catlin: Visitor Austin Catlin explained his new home is currently being built on the last corner lot in the Country Haven Subdivision. In an effort to plan ahead, he contacted Building Inspector Allen Eldridge to ask about what requirements existed under the city code to construct a recreational vehicle (RV) pad and a small shed. He explained his intention is to make the garage space more usable, and park both of his vehicles in the garage. He explained Mr. Eldridge informed him based on the zoning of his residence neither of those were allowable. Mr. Catlin further explained when he approached the City Council about his proposal during October's City Council meeting they indicated they were experiencing issues with on -street parking in that particular subdivision. He explained from his perspective the issues with on -street parking is due to residents using their garages for storage, and as a result has pushed increased parking onto the streets. He further explained his intention is to try and work with the Commission and the Council to amend the verbiage to allow for an accessory building which doesn't cover more than a certain percentage of the lot size. From his perspective, the ability to have a small shed will help to alleviate storage issues for most residents. Mr. Catlin explained in relation to the RV Pad, his proposed verbiage would allow for the storage of an RV as long as it was behind the fence, and perhaps only be allowed on lots with a certain minimum lot size. 1 Clerk Roberts also noted during October's meeting the Council discussed since Mr. Catlin has a corner lot a variance could be applicable. However, it was brought up that, perhaps the code should be revamped to help alleviate the overflow on -street parking issues and amend the code to meet people's needs opposed to opening up Pandora's Box of variances. She further expressed the Council's intention behind the code is to avoid neighbors infringing on each other's property, and concerns with fire protection. Members discussed with Mr. Catlin what the definition of "patio home" is and Mr. Catlin indicated his lot size is 4,000 square feet short of a 1/3 of an acre. Chairman Shirling indicated she was in support of the verbiage which Mr. Catlin drafted, but feels it needs a few more tweaks. She recommended the verbiage includes a stipulation which limits the allowance of an accessory building and/or RV pad based on a certain lot size. Member Thompson indicated he was in support of the accessory buildings, but he was concerned with infringing on neighboring properties when it comes to RV pads. After further discussion, the Planning and Zoning Commission recommended to the City Council they felt it is appropriate to revisit this code to see if they can come up with a workable resolution to try and accommodate the storage and parking issues which are occurring. Additionally, Chairman Shirling asked Mr. Catlin to do more research in regards to all of the lot sizes in the subdivision which are currently zoned as R-T (Residential Townhouse). Accessory Buildings in R-T Zone — Austin Carlisle: Clerk Roberts reported Mr. Carlisle has constructed an accessory building, which is non -compliant with city code. She further explained she invited Mr. Carlisle to the meeting to explain his situation, and for the opportunity to listen to the dialogue regarding the proposed verbiage changes presented by Mr. Catlin so he could make an informed decision on his next steps. Citizen Austin Carlisle residing at 5113 Ryanne Way explained he lives on a slightly smaller lot in comparison to Mr. Catlin. He estimated it between 8,500 to 8,600 square feet. He explained Chief Bowcutt visited him approximately a week ago while he was in the process of doing the finishing touches on his shed. He expressed the intention for the shed is for storage only, such as his lawn equipment and snowmobile so he can utilize his garage for parking his vehicles. Clerk Roberts asked if the code was to be amended, how difficult it would be for Mr. Carlisle to move the shed from the side of his home to the rear of the home. He indicated it would be very difficult. After further discussion, the Planning and Zoning Commission recommended Mr. Carlisle go ahead and begin the variance process. Discussion of Comprehensive Plan: Members discussed the need to update the comprehensive plan. Clerk Roberts reported the City Council is potentially looking at organizing a committee to conduct a city wide survey and revamp the Comprehensive Plan. Discussion of the Area of Impact Agreement: Members also discussed the need to begin work again on approaching Bonneville County to adjust the City's Area of Impact Agreement, and discussed working with Kim Ryan to accomplish these efforts via a presentation to Bonneville County's Planning and Zoning Commission during one of their meetings. 2 Reports: AIC Fall District Workshop Training: Chairman Shirling reported all of the slides and information regarding the training today are available on the website, and explained to Member Thompson how to access the information. Member Dee Johnson inquired if the City has an Annexation Plan. Clerk Roberts was unsure, and indicated she would look into it. Update on Discussions with Kim Rvan — Dee Johnson: Not much to report on this item other than continuing conversations with Kim Ryan to assist in getting the City's Area of Impact updated. Fair Housing Act — Clerk Roberts: Clerk Roberts reported she shared information via email regarding the Fair Housing Act to be taken into consideration for future conversations regarding the potential Rehabilitation Center.
