HomeMy Public PortalAbout04689 O R D I N A N C E NO. 4689 AN ORDINANCE, declaring the necessity for the acquisi- tion of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of per- mitting construction of sewers therein to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County, Missouri, known as the Lower Caulks Creek Watershed of The Metropolitan St. Louis Sewer District wherein there live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metro- politan St. Louis Sewer District to protect the public health and welfare by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or 2 otherwise easements for the use of sewer lines as hereinafter set forth, together with temporary easements adjacent to the right-of- way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: A permanent sewer easement 10 ft. in width across a tract of land in U.S. Survey 2031, Township 45 North, Range 4 East and as conveyed to ADOLPH F. HANSER and THOMAS H. BIGGS, a Partnership, doing business as Chesterfield Mobile Homes Park by deed recorded in Deed Book 6805, page 1698 of the St. Louis County records, the centerline of said easement being more particularly described as follows: Beginning at a point in the northerly right-of-way line of Chesterfield Airport Road (formerly Olive St. Rd.) said point being 168.06 ft. easterly of the southwesterly corner of said tract; thence, on a line bearing N. 2o 25' 47" W. a distance of 63.00 ft. to a point; thence, on a line bearing S. 84o 22' 59" E. a distance of 120.58 ft. to a point; thence, on a line bearing N. 66o 59' 13" E. a distance of 564.39 ft. to a point; thence, on a line bearing N. 39o 33' 55" E. to the southerly right-of-way line of U. S. Rte. 40, a distance of 218.05 ft.; thence, along said Rte. 40 right-of-way line bearing N. 43o 39' 05" W. a distance of 4.05 ft. to a point; thence on a line bearing N. 80o 26' 05" W. a distance 116.47 ft. to a point; thence, on a line bearing N. 88o 24' 53" W. to the northwesterly line of said tract, a distance of 102.36 ft. A temporary construction easement, for use during installation of the above described sewer, on a strip 15 ft. wide along the northerly side and 3 ft. wide along the southerly side of the above described permanent easement. Also, a permanent sewer easement 10 ft. in width over a tract of land in U.S. Survey 2031, Township 45 North, Range 4 East and as conveyed to ADOLPH F. HANSER and THOMAS H. BIGGS, A Partnership, doing business as Chesterfield Mobile Homes Park by deed recorded in Deed Book 6805, page 1698 of the St. Louis County records, the centerline of said easement being more particularly described as follows: Beginning at a point in the northerly right-of-way line of 3 Chesterfield Airport Road, said point being 82.22 ft. easterly of the southwesterly corner of said tract; thence, on a line bearing N. 38o 11' 05" E. to the northwesterly line of said tract, a distance of 209.20 ft. A temporary construction easement, for use during installation of the above described sewer, on a strip 15 ft. wide along the northwesterly side and 30 ft. wide along the southeasterly side of the above described permanent easement. A permanent sewer easement 10 ft. in width across a portion of Lot 2 of Wild Horse Ridge Resubdivision of Lot 4 according to the plat thereof recorded in Plat Book 171, page 49 of the St. Louis County records and as conveyed to TOM DIMITRIADES by deed recorded in Deed Book 6981, page 1686 of said records, the centerline of said easement being more particularly described as follows: Beginning at a point in the westerly line of said tract, said point being 251.34 ft. northerly of the southwest corner of the tract; thence, on a line bearing N. 34o 25' 00" E. a distance of 365.92 ft. to a point, thence, on a line bearing N. 83o 29' 22" E. to the easterly line of said tract, a distance of 141.28 ft. A temporary construction easement, for use during installation of the above described sewer, on a strip 33 ft. wide along the northwesterly side and 20 ft. wide along the southeasterly side of the above described permanent easement. A permanent sewer easement 10 ft. in width across a tract of land in Section 9, Township 45 North, Range 4 East and as conveyed to ELMER RICHMAN by deed recorded in Deed Book 3575, page 367 of the St. Louis County records, the centerline of said easement being more particularly described as follows: Beginning at a point in the westerly line of said tract, said point being 294.94 ft. northerly of the southwest corner of the tract; thence on a line bearing S. 52o 03' 03" E. a distance of 128.22 ft. to a point; thence; on a line bearing S. 42o 13' 45" E. a distance of 106.45 ft. to a point; thence on a line bearing S. 83o 57' 17" E. a distance of 138.82 ft. to a point; thence, on a line bearing S. 51o 44' 50" E. a distance of 177.18 ft. to a point; thence, on a line bearing S. 60o 35' 20" E. to the southerly line of said tract, a distance of 20.04 ft. 4 A temporary construction easement, for use during installation of the above described sewer, on a strip 25 ft. wide each side of the above described permanent easement. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemna- tion pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted April 14, 1982.
