RESOLUTION NO. 05-01-08
A RESOLUTION APPROVING INCLUSION OF
CERTAIN PROPERTY WITHIN THE BOUNDARIES OF
THE WEST MOUNTAIN METROPOLITAN DSTRICT
WHEREAS, the First Amended and Restated Consolidated Service Plan ("Service Plan')
for West Mountain Metropolitan District ("West Mountain"), West Meadow Metropolitan
District ("West Meadow") and Byers View Metropolitan District (together with West Mountain
and West Meadow, the "Districts") was submitted to and approved by the Board of Trustees of
the Town of Fraser ("Town") by Resolution No. 04-01-05 dated April 6, 2005; and
WHEREAS, Section I of the Service Plan contemplates a future inclusion property,
which property is legally described on Exhibit A attached hereto and incorporated herein by this
reference ("Johns Parcel"), expected to be included within the boundaries of the Districts, subject
to Town approval; and
WHEREAS, the Board of Directors of West Mountain now desires to include Johns
Parcel within the West Mountain boundaries.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSEES OF THE
TOWN OF FRASER, COLORADO:
The Town acknowledges it has reviewed the relevant facts pertaining to the inclusion of
Johns Parcel, and hereby approves of and consents to the inclusion-of Johns Parcel into West
Mountain, in accordance with Section I of the Service Plan.
ADOPTED this 7th day of May, 2008.
