HomeMy Public PortalAbout04747 O R D I N A N C E NO. 4747 AN ORDINANCE, declaring the necessity for the acquisi- tion of the fee simple estate and every other estate and interest in certain property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of the Grand Glaize Wastewater Treatment Plant to serve the needs of residents of the Lower Meramec Basin area and authorizing the acquisition of such property by purchase or by the institution of condemnation proceedings, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Meramec Basin wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metro- politan St. Louis Sewer District to protect the public health by constructing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is necessary and in the public interest to appropriate and acquire by purchase or by exercise of eminent domain or otherwise, the fee simple estate and every other estate and interest in certain property for the construction of a sewage treatment and disposal plant and system as hereinafter set forth, said property being more particularly described as follows: A tract of land in SECTION 9, TOWNSHIP 44 NORTH, RANGE 5 EAST, St. Louis County, Missouri, being more particularly described as follows: Beginning at a point in the West line of said SECTION 9, being North 1 degree 25 minutes 22 seconds East 590.20 feet along said West line from the Southwest corner of said Section 9; thence continuing along said West line North 1 degree 25 minutes 22 seconds East 312.90 feet to a point being the intersection of said West line with the Westward prolongation of the Southern line of a tract now or formerly of Albert S. Knorth and wife, by deed recorded in Book 5165 Page 167 of the St. Louis County Records; thence along said Southern line North 71 degrees 39 minutes 59 seconds East 757.56 feet to the Northwest corner of a tract now or formerly of Virgie L. and Dora Birdnow, by deed recorded on Book 6662 Page 1255 of said County Records; thence along the West line of said Birdnow tract, South 1 degree 24 minutes 08 seconds West 237.84 feet to a point; thence Westwardly along the Southern shore-line of the pond on the tract herein described, the following courses and distances; South 84 degrees 08 minutes 20 seconds West 92.25 feet; South 67 degrees 45 minutes 26 seconds West 96.47 feet; North 82 degrees 31 minutes 05 seconds West 100.97 feet; South 53 degrees 00 minutes 16 seconds West 68.08 feet; South 71 degrees 05 minutes 33 seconds West 82.81 feet; South 31 degrees 15 minutes 18 seconds West 112.49 feet; South 71 degrees 36 minutes 41 seconds West 28.46 feet; South 58 degrees 10 minutes 48 seconds West 117.70 feet; North 75 degrees 03 minutes 57 seconds West 85.08 feet; and South 30 degrees 24 minutes 22 seconds West 78.21 feet to the point of beginning. EXCEPTING THEREFROM, A tract of land in SECTION 9, TOWNSHIP 44 NORTH, RANGE 5 EAST, St. Louis County, Missouri, being more particularly described as follows: Commencing at a point in the West line of said Section 9, being North 1 degree 25 minutes 22 seconds East 590.20 feet along said West line from the Southwest corner of said Section 9, thence continuing along said West line North 1 degree 25 minutes 22 seconds East 312.90 feet to a point being the intersection of said West line with the Westward prolongation of the Southern line of a tract now or formerly of Albert S. Knorth and wife, by deed recorded in Book 5165 Page 167 of the St. Louis County Records; thence along said Southern line North 71 degrees 39 minutes 59 seconds East 757.56 feet to the Northwest corner of a tract now or formerly of Virgie L. and Dora Birdnow, by deed recorded in Book 6662 Page 1255 of said County Records, said point also being the point of beginning; thence along the West line of said Birdnow tract, South 1 degree 24 minutes 08 seconds West 237.84 feet to a point; thence in an Westerly direction 230 feet ∀ to a point; thence in an Northerly direction and parallel with the West line of said Birdnow tract 150 feet ∀ to the Southern line of a tract or formerly of Albert S. Knorth and wife, by deed recorded in Book 5165 Page 167 of the St. Louis County Records; thence along said Southern line North 71 degrees 39 minutes 59 seconds East 237.56 feet to the point of beginning. A tract of land in the South 1/2 of SECTION 9-44-5, being, Part of Lots 9 and 10 of the Subdivision by Commissioners of the PETER BREEN ESTATE the plat of which is recorded in Book 376 Page 346 of the Records of the City (former County) of St. Louis, and described as follows: Beginning at the Northwest corner of property conveyed to Phillip G. Moise and wife by deed recorded in Book 6856 Page 1050 of the St. Louis County Records, thence South 01 degrees 22 minutes 8 seconds West, along the West line of said Phillip G. Moise property being also the last line of property of Davey Tree Expert Company, 600 feet to the Southwest corner of said Moise property; thence North 88 degrees 37 minutes 52 seconds West along the South line of Davey Tree Expert Company property, 535.17 feet to the Southwest corner thereof; thence North 01 degree 25 minutes 22 seconds East, along the West line of said Davey Tree Expert Company property, 493.40 feet to a point; thence leaving said west line of Davey Tree Expert Company property and running Northwardly and Eastwardly the following courses and distances: North 30 degrees 24 minutes 22 seconds East, 78.213 feet; South 75 degrees 03 minutes 57 seconds East, 85.08 feet; North 58 degrees 10 minutes 48 seconds East 117.70 feet; North 71 degrees 36 minutes 41 seconds East, 28.46 feet; North 31 degrees 15 minutes 18 seconds East, 112.49 feet; North 71 degrees 05 minutes 33 seconds East, 82.81 feet; North 53 degrees 00 minutes 16 seconds East, 68.08 feet; South 82 degrees 31 minutes 65 seconds East, 100.97 feet North 67 degrees 45 minutes 26 seconds East, 96.47 feet and North 84 degrees 08 minutes 20 seconds East, 98.44 feet to a point in the West line of property now or formerly of Virgil L. Birdnow and wife, by deed recorded in Book 3411 Page 196 of the St. Louis County records; thence South 01 degrees 24 minutes 08 seconds West, 223.59 feet to a point in the North line of property to Moise as aforesaid; thence North 88 degrees 37 minutes 52 seconds West along the North line of said Moise property, 178.58 feet to the point of beginning, containing 8.938 acres, more or less, according to a Survey executed by John C. Bergh and Associates Land Surveyors in December, 1978. 25P 610 078 A tract of land situated in the Southeast part of fractional Section 8, and in U.S. Survey 1970, Township 44 North, Range 5 East, St. Louis County, Missouri, and described as follows to wit: Beginning at an old stone at the Southeast corner of said Section 8; thence North 85 degrees 43 minutes West along the South line of said Section 8, and its prolongation 1347.00 feet to a point in the center line of the St. Louis-San Francisco Railway Co. right of way; thence Northeastwardly along the center line of said Railroad right-of-way on chord measurements as follows; North 51 degrees 23 minutes East 526.00 feet, North 48 degrees 06 minutes East 346.47 feet; North 42 degrees 35 minutes East 371.84 feet, and North 37 degrees 18 minutes East 357.07 feet to a point in the Northwestern line of property conveyed to Albert S. Knorth and wife, thence South 35 degrees 28 minutes East along the Western line of said Knorth property 361.33 feet to a point in the East line of said Section 8, thence South 0 degrees 12 minutes West along said Section line 924.00 feet to the point of beginning. EXCEPTING THEREFROM that portion of the St. Louis-San Francisco Railway Co. right of way as embraced within the above description, containing 16.20 acres, more or less. 25P 520 010 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. Section Three. The immediate construction of said sewage treatment plant being necessary in order to protect the public health within the District, an emergency is hereby declared to exist within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted June 9, 1982.
