HomeMy Public PortalAbout04885 AMENDED 10/16/85 BY ORDINANCE NO. 6215 O R D I N A N C E NO. 4885 AN ORDINANCE, declaring the necessity for the acquisi- tion of the fee simple estate and every other estate and interest, and the acquisition of an easement, in certain property within The Metropolitan St. Louis Sewer District, for the purpose of operating and maintaining the Carman Road Wastewater Treatment Plant to serve the needs of residents of the Lower Meramec Basin area and authorizing the acquisition of such property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Meramec Basin wherein live and work numerous people; and WHEREAS, it is the purpose and design of The Metro- politan St. Louis Sewer District to protect the public health by operating and maintaining sewage treatment and disposal plants and systems in said area; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is necessary and in the public interest to appropriate and acquire by purchase or by exercise of eminent domain or otherwise, the fee simple estate and every other estate and interest, and an easement 2 for the use of sewer lines, in certain property, within The Metropolitan St. Louis Sewer District, for the operation and maintenance of a sewage treatment and disposal plant and system as hereinafter set forth, said property and said easement being more particularly described as follows: A tract of land being part of Lot 11 of the Subdivision by the Commissioners in partition of the Peter Breen Estate, being Cause No. 91 of the October term 1860 of the St. Louis Land Court styled James H. Russell et al. vs. Betsy Ann Breen et al., according to the plat thereof attached to said Commissioners' report recorded in Book 376, Page 346 of the St. Louis City (former County) Recorder's Office, said tract of land being located in Sections 8 and 9, Township 44 North, Range 5 East and being more particularly described as follows: Commencing at the intersection of the southern line of said Lot 11 with the eastern line of Dougherty Ferry Road, 40 feet wide; said intersection being the southwestern corner of property conveyed to Rowland Investment Company by deed recorded in Book 6323, Page 368 of the St. Louis County Recorder's Office; thence along said eastern line of Dougherty Ferry Road, North 28 degrees 06 minutes 00 seconds East a distance of 887.02 feet to the point of beginning of the tract of land to be described; thence continuing along said eastern line of Dougherty Ferry Road the following courses and distances, North 28 degrees 06 minutes 00 seconds East a distance of 254.28 feet; thence North 31 degrees 27 minutes 47 seconds East a distance of 86.52 feet; thence leaving said eastern line of Dougherty Ferry Road, South 57 degrees 24 minutes 00 seconds East a distance of 305.00 feet; thence South 12 degrees 24 minutes 00 seconds East a distance of 120.21 feet; thence South 32 degrees 36 minutes 00 seconds West a distance of 255.00 feet; thence North 57 degrees 24 minutes 00 seconds West a distance of 368.33 feet to the point of beginning and containing 2.8914 acres, more or less. A permanent sewer easement, 15 feet wide, across a portion of Lot 11 of the Subdivision by the Commissioners in partition of the Peter Breen Estate, being Cause No. 91 of the October term 1860 of the St. Louis Land Court styled James H. Russell et al. vs. Betsy Ann Breen et al., according to the plat thereof attached to said Commissioners' report recorded 3 in Book 376, Page 346 of the St. Louis City (former County) Recorder's Office, said permanent sewer easement being located in Section 9, Township 44 North, Range 5 East, the centerline of said permanent sewer easement being more particularly described as follows: Commencing at the intersection of the southern line of said Lot 11 with the eastern line of Dougherty Ferry Road, 40 feet wide; said intersection being the southwestern corner of property conveyed to Rowland Investment Company by deed recorded in Book 6323, Page 368 of the St. Louis County Recorder's Office; thence along said eastern line of Dougherty Ferry Road, North 28 degrees 06 minutes 00 seconds East a distance of 887.02 feet; thence leaving said eastern line of Dougherty Ferry Road, South 57 degrees 24 minutes 00 seconds East a distance of 368.33 feet; thence North 32 degrees 36 minutes 00 seconds East a distance of 144.90 feet to the point of beginning of the centerline of said permanent sewer easement, 15 feet wide, to be described; thence South 56 degrees 06 minutes 07 seconds East a distance of 328.38 feet, more or less, to the point of ending of said centerline of said permanent sewer easement, 15 feet wide, said point of ending being in the eastern line of the aforementioned Lot 11, said point also being in the centerline of Grand Glaize Creek. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by pur- chase, if possible, or to institute and prosecute an action in condemnation, pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinabove set out. 4 The foregoing Ordinance was adopted November 10, 1982.
