HomeMy Public PortalAbout05147 O R D I N A N C E NO. 5147 AN ORDINANCE, declaring the necessity for the acquisi- tion of the fee simple estate and every other estate and interest in certain property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of the Grand Glaize Wastewater Treatment Plant (Part of Federal Project No. C- 290875) to serve the needs of residents of the Lower Meramec Basin area and authorizing the acquisition of such property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Meramec Basin wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metro- politan St. Louis Sewer District to protect the public health by constructing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is 2 necessary and in the public interest to appropriate and acquire by purchase or by exercise of eminent domain or otherwise, the fee simple estate and every other estate and interest in certain property for the construction of a sewage treatment and disposal plant and system as hereinafter set forth, said property being more particularly described as follows: A parcel of land in the South 1/2 of Section 9, Township 44 North, Range 5 East, being part of Lots 9 and 10 of the Subdivision by Commissioners of the PETER BREEN ESTATE, in St. Louis County, Missouri, the plat of which is recorded in Book 376 Page 346 of the Records of the City (former County) of St. Louis, the beginning point of which is described as: Commencing at the intersection of the South line of said Section 9 with the East line of property conveyed to George W. Baumhofff by deed recorded in Book 237 Page 522 of the St. Louis County Records; thence North 0 degrees 09 minutes East 95.43 feet to a point; thence North 89 degrees 51 minutes West 1758.00 feet to a point and this is the point of beginning and the Southeast corner of the parcel of land hereinafter described; thence North 89 degrees 51 minutes West 436.08 feet to a point; thence North 0 degrees 09 minutes East 600.00 feet to a point; thence South 89 degrees 51 minutes East 436.08 feet to a point; thence South 0 degrees 09 minutes West 600.00 feet to the point of beginning, according to a survey thereof executed by Associate Surveyors on September 2 and 4, 1951. Together with all improvements thereon known as and numbered 13405 Westerman Road. A tract of land in Section 17, Township 44 North, Range 5 Eat, St. Louis County, Missouri, being more particularly described as follows: Beginning at a point in the east line of said Section 17 being the southeast corner of a tract now or formerly of Harry Richards as described in instrument recorded in Book 6505 Page 2162 of the St. Louis County Records, said point being also the northeast corner of a tract now or formerly of Harold L. Rue and Ethel I. Rue, his wife, by instrument recorded in Book 7336 Page 1561 of said County Records; thence northwardly along said east line of said Section 17 being also the east line of said Richards 3 tract North 1Ε30' East 942.5 feet more or less to the northeast corner of said Richards tract and being also the southeast corner of a tract now or formerly of the City of Valley Park by deed recorded in Book 4610 Page 428 of said County Records; thence westwardly along the north line of said Richards tract South 76Ε20' West 155.41 feet to a point; thence southwardly along a line 150 feet west of and parallel with the aforementioned east line of Section 17, South 1Ε30' West 942.5 feet more or less to the intersection of said line with the north line of the aforementioned Rue tract; thence eastwardly along said north line North 76Ε20' East 155.41 feet to the point of beginning. A tract of land in Section 17, Township 44 North, Range 5 East, St. Louis County, Missouri, being more particularly described as follows: Beginning at an old stone at the northeast corner of said Section 17, being also the northeast corner of a tract now or formerly of the City of Valley Park of Valley Park by deed recorded in Book 4610, Page 428 of the St. Louis County Records; thence southwardly along the east line of said tract and said Section 17 South 1Ε30' West 825.5 feet more or less to the southeast corner of said City of Valley Park tract and being also the northeast corner of a tract now or formerly of Harry Richards as described in instrument recorded in Book 6505 Page 2162 of said County Records; thence westwardly along the north line of said Richards tract South 76Ε20' West 207.22 feet to a point; thence northwardly along a line 200 feet west of and parallel with the aforementioned east line of Section 17 North 1Ε30' East 893.75 feet more or less to the intersection of said line with the north line of said Section 17; thence eastwardly along said north line of Section 17 South 84Ε29' East 200.49 feet to the point of beginning. A tract of land in Section 17, Township 44 North, Range 5 East, St. Louis County, Missouri, being more particularly described as follows: Beginning at an old concrete monument at the intersection of the north line of St. Louis Ave., 60 feet wide, with the east line of said Section 17 said point being also the southeast corner of a tract now or formerly of Harold L. Rue and Ethel I. Rue, his wife, by instrument recorded in Book 7336 page 1561 of the St. Louis County Records; thence northwardly along the east line of said Section 17, being also the east line of said Rue tract North 1Ε30' East 770 feet more or less to the northeast corner of said Rue 4 tract and being also the southeast corner of a tract now or formerly of Harry Richards as described in instrument recorded in Book 6505 page 2162 of said County Records; thence westwardly along the north line of said Rue tract South 76Ε20' West 139.87 feet to a point; thence southwardly along a line 135 feet west of and parallel with the aforementioned east line of Section 17, South 1Ε30' West 123 feet to a point; thence South 43Ε30' East 35.36 feet to a point; thence southwardly along a line 110 feet west of and parallel with the aforementioned east line of Section 17, South 1Ε30' West 567.21 feet to the intersection of said line with the aforementioned north line of St. Louis Ave., 60 feet wide, thence eastwardly along said north line of St. Louis Ave. along a curve to the right having a radius of 985.4 feet an arc distance of 111.55 feet to the point of beginning. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible or to institute and prosecute an action in condemnation pursuant to the provisions of the plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted June 22, 1983.
