HomeMy Public PortalAbout05155 O R D I N A N C E NO. 5155 AN ORDINANCE, declaring the necessity for the acquisi- tion of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permit- ting construction of the Grand Glaize Interceptor System (part of Federal Project No. C-290875) to serve the needs of residents of the Lower Meramec Basin area and authorizing the acquisition of such easements by purchase or by the institution of condemna- tion proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Meramec Basin wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropoli- tan St. Louis Sewer District to protect the public health by con- structing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, de- termines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is necessary 2 to appropriate and acquire by the exercise of eminent domain or otherwise easements for the use of sewer lines as hereinafter set forth, together with temporary easements adjacent to the right-of-way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly de- scribed as follows: George William Fenimore and Margaret Rubright Fenimore Parcel #1 A permanent sewer easement ten feet in width across a tract of land in U. S. Survey 1970, Township 44 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, and across property conveyed to George William Fenimore and Margaret Rubright Fenimore by deed recorded in Book 7245, Page 2042 of the St. Louis County Records, the centerline of said ten feet wide easement being more particularly described as follows: Commencing at the intersection of the Eastern line of said U. S. Survey 1970 and the Northern right of way line of the Burlington Northern Railroad, said part being the Northeastern corner of said Fenimore property; thence Southwestwardly along said Northern right of way line a distance of 71.15 feet to the actual point of beginning of said ten feet wide easement; thence Northwestwardly a distance of 135.99 feet to its intersection with the Northwestern line of said Fenimore property, said Northwestern line being the Southern right of way line of the Missouri Pacific Railroad, said intersection point being distant Southwestwardly along said Southern line a distance of 105.40 feet from the Eastern line of said U. S. Survey 1970, said intersection point being the point of ending of said ten foot wide easement. Also, temporary construction easements for use during installation of said sewer on strips of land 15 feet in width along the Southwesterly side and 15 feet in width along the 3 Northeasterly side and contiguous with the above described ten foot wide permanent sewer easement. George F. Heege and Clara K. Heege, his wife. Parcel #2 A permanent sewer easement ten feet in width across portions of Lot 8 of the Subdivision by the Commissioners in partition of the Peter Breen Estate, being Cause No. 91 of the October term 1860 of the St. Louis Land Court styled James H. Russell, et al., vs. Betsy Ann Breen, et al., according to the plat thereof attached to said Commissioner's report recorded in Book 376, Page 346 of the St. Louis City (former County) Recorder's Office, said ten foot wide easement being located in U. S. Survey 1970 and Section 8, Township 44 North, Range 5 East, of the Fifth Principal Meridian, St. Louis County, Missouri, said ten foot wide easement being also located across property conveyed to George F. Heege and Clara K. Heege, his wife, by deed recorded in Book 2427, page 488 of the St. Louis County Recorder's Office, the centerline of said ten feet wide easement being more particularly described as follows: Commencing at the intersection of the centerline of Quinette Road, 40 feet wide, and the East line of said U. S. Survey 1970; thence along said centerline of Quinette Road, North 72 degrees 00 minutes West, a distance of 97.87 feet to a point; thence North 20 degrees 43 minutes 32 seconds East, a distance of 20.02 feet to a point in the North line of said Quinette Road; 40 feet wide, said point being the actual point of beginning of said ten foot wide easement; thence continuing North 20 degrees 43 minutes 32 seconds East, a distance of 463.69 feet to a point of curvature of a curve to the left having a radius of 110.0 feet; thence Northwestwardly along said curve to the left having a central angle of 40 degrees 15 minutes 46 seconds, a distance of 77.30 feet to a point of tangency; thence North 19 degrees 32 minutes 14 seconds West, a distance of 52.07 feet to the Southerly line of Big Bend Road, 80 feet wide; thence continuing North 19 degrees 32 minutes 14 seconds West and excepting the area within the right of way of said Big Bend Road, a distance of 80.76 feet to the Northerly line of said Big Bend Road, 80 feet wide; thence continuing North 19 degrees 32 minutes 14 seconds West, a distance of 69.01 feet to a point; thence North 19 degrees 32 minutes 17 seconds West, a distance of 795.96 feet to a point of curvature of a curve to the right having a radius of 114.52 feet; thence Northwestwardly, Northwardly and Northeastwardly along said curve to the right having a central angle of 47 degrees 56 4 minutes 32 seconds, a distance of 95.82 feet to a point of tangency; thence North 28 degrees 24 minutes 15 seconds East, a distance of 77.17 feet to a point in the North line of said Lot 8 of the Peter Breen Estate, said point being the point of ending of said ten foot wide easement, said point also being distant along said North line of Lot 8, South 82 degrees, East a distance of 52.90 feet from the centerline of Dougherty Ferry Road, 40 feet wide. Also, temporary construction easements for use during installation of said sewer on strips of land 20 feet in width along the Westerly side and 35 feet in width along the Easterly side and contiguous with the above described ten foot wide permanent sewer easement. Joe B. Teston Parcel #3 A permanent sewer easement ten feet in width across a portion of Lot 5 of Richard Low's Estate Subdivision in U. S. Survey 1928, Township 44 North, Range 5 East of the Fifth Principal Meridian in St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 3, Page 122 of the St. Louis City (former County) Records and being across property conveyed to Joe B. Teston (in Parcel 2) by deed recorded in Book 7178, Page 234 of the St. Louis County Records, the centerline of said ten foot wide easement being more particularly described as follows: Commencing at the Southernmost corner of Parcel 2 of said Teston property; thence North 89 degrees 20 minutes East, a distance of 166.26 feet to the actual point of beginning of said ten foot wide easement; thence North 17 degrees 43 minutes 54 seconds West, a distance of 345.32 feet to a point in the North line of Lot 5 of said Richard Louis' Estate Subdivision, said point being the point of ending of said ten foot wide easement, said point being distant along said North line of Lot 5, South 83 degrees 14 minutes East, a distance of 218.89 feet from the Northwesternmost corner of said Lot 5. Also, temporary construction easements for use during installation of said sewers on strips of land 20 feet in width along the 5 Southeasterly side and 35 feet in width along the Northeasterly side and continuous with the above described ten foot wide permanent sewer easement. Sherwood Nurseries, Inc. Parcel #4 A permanent sewer easement ten feet in width across a tract of land in the Northwest quarter of Fractional Section 4, Township 44 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, and across property conveyed to Sherwood Nurseries, Inc. by deed recorded in Book 7241, Page 70 of the St. Louis County Records, the centerline of said ten foot wide easement being more particularly described as follows: Commencing at the Westernmost corner of property conveyed to Joe B. Teston in Parcel 1 by deed recorded in Book 7178, Page 234 of the St. Louis County Records, said point being in the North line of U. S. Survey 1928; thence along said North line of U. S. Survey 1928, North 82 degrees 15 minutes West, a distance of 658.13 feet to the actual point of beginning of said ten foot wide easement; thence North 16 degrees 31 minutes 38 seconds West, a distance of 177.23 feet to a point in the Northerly line of the aforementioned Sherwood Nurseries, Inc. property, said point being the point of ending of said ten foot wide easement, said point being distant along the Northerly line of said Sherwood Nurseries,Inc. property, South 72 degrees 18 minutes 42 seconds West, a distance of 654.48 feet from the Southwestern line of Barrett Station Road, 40 feet wide. Also, temporary construction easements for use during installation of said sewers on strips of land 20 feet in width along the Southwesterly side and 35 feet in width along the Northeasterly side and contiguous with the above described ten foot wide permanent sewer easement. 6 Joseph B. Teston Parcel #5 A permanent sewer easement ten feet in width across a tract of land in Section 4, Township 44 North. Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri and across property conveyed to Joseph B. Teston by deed recorded in Book 7277, Page 2389 of the St. Louis County Records, the centerline of said ten foot wide easement being more particularly described as follows: Commencing at the Southwesternmost corner of said Teston property; thence along the Southeastern line of said Teston property, North 72 degrees 18 minutes 42 seconds East, a distance of 174.38 feet to the actual point of beginning of said ten foot wide easement; thence leaving said Southeastern line, North 16 degrees 41 minutes 10 seconds West, a distance of 143.49 feet to a point of curvature of a curve to the left having a radius of 248.738 feet; thence along said curve to the left and having a central angle of 6 degrees 33 minutes 25 seconds, a distance of 28.47 feet to a point in the Northwestern line of said Teston property, said point being the point of ending of said ten foot wide easement, said point being distant along said Northwestern line, South 72 degrees 18 minutes 42 seconds West, a distance of 614.98 feet from the Northernmost corner of said Teston property. Also, temporary construction easements for use during installation of said sewers on strips of land 20 feet in width along the Southwesterly side and 35 feet in width along the Northeasterly side and contiguous with the above described ten foot wide permanent sewer easement. 7 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted July 13, 1983.
