HomeMy Public PortalAbout05291 O R D I N A N C E NO. 5291 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of the Creve Coeur Sanitary Interceptor System (Part of Federal Project No. C-291148) to serve the needs of residents of the Lower Missouri River Basin (MSD Northwest Area) and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Missouri River Basin (MSD Northwest Area) wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, 2 determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewer lines as hereinafter set forth, together with temporary easements adjacent to the right-of- way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: JOHN N. LEACH AND MADELEINE LEACH - PARCEL #1 A permanent sewer easement fifteen feet in width across a portion of Lot 23 of Samuel Bonner's Subdivision of Creve Coeur Lake Place in U.S. Survey 3094, Township 46 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, and across property conveyed to John N. Leach and Madeleine Leach, his wife, by Deed recorded in Deed Book 6479, Page 780 of the St. Louis County records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at a point in the northerly line of said property, said point being 13.5 feet southwesterly as measured along the property line from the intersection of said line with the southwesterly right-of-way line of Marine Avenue, 40 feet wide; thence on a line bearing South 23 degrees 30 minutes East a distance of 555.5 feet to a point in the southerly line of said property, said point also being the point of ending. Also, a temporary construction easement for use during installation of said sewer on a strip of land six feet in width along the easterly side and 44 feet in width along the westerly side of and contiguous with the above-described fifteen-foot-wide easement. ST. LOUIS CONSTRUCTION TRAINING AND ADVANCEMENT FOUNDATION - PARCEL #2 A permanent sewer easement fifteen feet in width across a portion of Lot 9 of the Subdivision of the Madden Tract in U.S. Survey 3904, Township 46 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, and across property conveyed 3 to St. Louis Construction Training and Advancement Foundation by Deed recorded in Deed Book 6460, Page 1738 of the St. Louis County records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at a point in the northerly line of said property, also being the northerly line of Lot 9 of the subdivision of the Madden Trace, said point being distant South 77 degrees 49 minutes East, a distance of 55 feet measured along said lot line from the intersection of same with the easterly right-of-way of Creve Coeur Mill Road, 30 feet wide; thence on a line bearing South 11 degrees 36 minutes West a distance of 875.84 feet to a point in the southerly line of said property, said point also being the point of ending. Also, a temporary construction easement for use during installation of said sewer on the strip of land 47.5 feet in width, westerly of and contiguous with the above-described fifteen-foot- wide permanent sewer easement. LAVERA K. RYDER ET. AL. - PARCEL #3 A permanent sewer easement fifteen feet in width located in a part of Lot 6 of C. A. Lorings subdivision in U.S. Surveys 433, Township 46 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, according to Plat recorded in Book 8, Page 143 of the St. Louis County records, and across property described in a Deed recorded in Book 1604, Page 315 of the St. Louis County records. The centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at a point in the North line of said Lot 6 said point being distant North 78 degrees 10 minutes 30 seconds East a distance of 25.26 feet Northeasterly of the intersection of the North line of Lot 6 with the east right-of-way line of Creve Coeur Mill Road; thence on a line bearing South 4 degrees 4 minutes 36 seconds West a distance of 40.84 feet to a point, said point being the end of the first segment of this easement; thence continuing on a line South 4 degrees 4 minutes 36 seconds West a distance of 179.47 feet to a point; thence on a line bearing South 21 degrees 4 minutes 18 seconds East a distance of 11.92 feet to the point of beginning of the second segment of this easement; thence continuing on a line South 21 degrees 4 minutes 18 seconds a distance of 168.62 feet to a point; thence on a line bearing South 48 degrees 59 minutes 33 seconds East a distance of 215.68 feet to a point; thence on a line bearing South 28 degrees 55 minutes 24 seconds West a distance of 16.21 feet to a point in the Northeasterly right-of-way line Creve Coeur Mill Road and the end of the second segment of this easement. Also, from the Northwesterly end of the third-above- 4 described line being 215.68 feet in length; thence on a line bearing South 67 degrees 49 minutes 19 seconds West a distance of 18 feet to a point in the Easterly right-of-way line of Creve Coeur Mill Road and the end of the third segment of this easement. Also, a temporary construction easement for use during installation of the said sewer on a strip of land 60 feet in width along the Easterly side of and contiguous with the above described fifteen-foot-wide permanent sewer easement. Also, that portion of the above described property lying between the above described easement and the Easterly right-of-way line of Creve Coeur Mill Road. LAVERA K. RYDER ET. AL. - PARCEL #4 A permanent sewer easement fifteen feet in width across Lots 43 & 44 of Creve Coeur City Subdivision in US Survey 433, Township 46 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, according to Plat recorded in Book 8, Page 143, of the St. Louis County records, and across property described in Deeds recorded in Book 1566, Page 624, and Book 1604, Page 315, of the St. Louis County records. The centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at a point in the Northwesterly line of Lot 44 of said subdivision, said point being 28.08 feet southwesterly of the most northerly corner of said Lot 44; thence on a line bearing South 20 degrees 28 minutes 36 seconds East a distance of 292.15 feet to a point; thence on a line bearing South 68 degrees 13 minutes 04 seconds East a distance of 100 feet to the centerline of a stream which is also the southerly line of the above described property. Also, a temporary construction easement for use during installation of said sewer on a strip of land 70 feet in width easterly and 30 feet in width westerly of and contiguous with the above described fifteen-foot-wide permanent sewer easement. Also, a temporary construction easement on Lots 10 & 20 of the above-described subdivision in their entirety and the easterly 25 feet of Lots 11 through 19, inclusive. Also, a temporary construction easement 50 feet in width easterly and 25 feet in width westerly of and contiguous with the 40 foot wide right-of-way of Lake Drive, from the northerly end of the above-described temporary easements to the northerly property line of the above-described property, which is also the southeasterly edge of the existing drainage easement adjacent to this property. ARTHUR NOVELL - PARCEL #5 5 A permanent sewer easement fifteen feet in width across a tract of land in subdivision of William Schrader's estate in U.S. Surveys 367 and 923, Township 46 North, Range 5 East of the Fifth Principal Meridian, St" Louis County, Missouri and across property conveyed to Arthur Novell by Deed recorded in Book 148, Page 384 of the St. Louis County records, the centerline of said fifteen-foot- wide easement being more particularly described as follows: Beginning at the point of intersection of the easterly line of Lot 43 of Creve Coeur Creek subdivision, with a the centerline of a stream which is the property line of the above- described tract; thence on a line bearing South 68 degrees 00 minutes 34 seconds East a distance of 49 feet to a point; thence on a line bearing South 23 degrees 28 minutes 32 seconds East a distance of 252.93 feet to a point in a property line of the above described tract, being the end of the first segment of this easement; thence continuing on said line bearing South 23 degrees 28 minutes 32 seconds East a distance of 47.30 feet to a point; thence on a line bearing South 27 degrees 43 minutes 10 seconds West a distance of 124.91 feet; thence on a line bearing South 86 degrees 15 minutes 30 seconds West a distance of 53 feet to the centerline of Creve Coeur Creek which is also a property line of the above-described tract and the beginning point of the second segment of this easement; thence continuing on the line bearing South 86 degrees 15 minutes 30 seconds West a distance of 77 feet to the point of ending of this second segment of the easement. KELLMANN - PARCEL #6 A permanent sewer easement fifteen feet in width across a tract of land in Lots 4 and 5 of Subdivision of William Schrader's Estate in U.S. Surveys 367 and 923, Township 46 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, said property being described in Deed of Trust to Ben Bush Dairy Farm, a co-partnership by Edward F. Kellmann and Elmer Kellmann co- partners: Elmer Kellmann and Margaret Kellmann, his wife; Edward F. LEE HUNTER, TRUSTEE - PARCEL #7 7 A permanent sewer easement fifteen feet in width across a tract of land in U.S. Surveys 109 and 367, and Fractional Section 7, Township 45 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, according to Deed recorded in Book 7428, Page 1725 of the St. Louis County records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at the point of intersection of the southerly right-of-way line of Ladue Road, 60 feet wide, with the southeasterly right-of-way line of Woods Mill Road, 60 feet wide; thence Southwestwardly along said Southeast right-of-way line of Woods Mill Road a distance of 39.61 feet to a point, said point being the beginning of this easement; thence on a line bearing South 63 degrees, 22 minutes, 51 seconds East a distance of 35.65 feet to a point; thence on a line bearing North 26 degrees, 38 minutes East a distance of 772.25 feet to a point; thence on a line bearing North 52 degrees, 42 minutes 33 seconds East a distance of 1096.64 feet to a point; thence on a line bearing North 15 degrees, 37 minutes, 12 seconds East a distance of 553.90 feet to a point on the Northwest property line of the above described tract; thence continuing on said bearing North 15 degrees, 37 minutes, 12 seconds East a distance of 52.50 feet to a point; thence on a line bearing North 1 degree, 11 minutes West a distance of 260.86 feet to a point; thence on a line bearing North 26 degrees, 41 minutes, 39 seconds East a distance of 73.00 feet to a point on the westerly property line of the above-described tract and the beginning point of the second segment of this easement; thence continuing on said bearing North 26 degrees, 41 minutes, 39 seconds East a distance of 185.08 feet to a point; thence on a line bearing North 47 degrees, 39 minutes, 30 seconds East a distance of 235.00 feet to a point on the Northerly property line of the above-described tract. Also, a temporary construction easement for use during installation of said sewer on a strip of land 80 feet in width along the Northwesterly side and 20 feet in width along the Southeasterly side of an contiguous with the last-above-described line of the first-above-described permanent easement, said line being 553.90 feet in length. Also, a temporary construction easement for use during installation of said sewer on a strip of land 20 feet in width along the Northwesterly side and 80 feet in width along the Southeasterly side of and contiguous with the second segment of the first-above-described permanent easement. HUNTER ENGINEERING COMPANY - PARCEL #8 A permanent sewer easement fifteen feet in width across a tract of land in U.S. Survey 367, Township 45 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, according to Deed recorded in Book 6347, Page 246 of the St. Louis County records, the centerline of said fifteen-foot-wide easement more particularly described as follows: Beginning at the point of intersection of the Southerly right-of-way line of Ladue Road, 60 feet wide, with the Southeasterly right-of-way line of Woods Mill Road, 60 feet wide; thence Southwestwardly along said Southeast right-of-way line of Woods Mill Road a distance of 39.61 feet to a point; thence on a line bearing South 63 degrees, 22 minutes, 51 seconds East a distance of 35.65 feet to a point; thence on a line bearing North 26 degrees, 38 minutes East a distance of 772.25 feet to a point; thence on a line bearing North 52 degrees, 42 minutes, 33 seconds East a distance of 1096.64 feet to a point; thence on a line bearing North 15 degrees, 37 minutes, 12 seconds East a distance of 553.90 feet to a point on the Southeasterly property line of the above described tract and the beginning of this easement; thence 9 continuing on said bearing North 15 degrees, 37 minutes, 12 seconds East a distance of 52.50 feet to a point; thence on a line bearing North 1 degree, 11 minutes West a distance of 260.86 feet to a point; thence on a line bearing North 26 degrees, 41 minutes, 39 seconds East a distance of 73.00 feet to a point on the Northerly property line of the above-described tract. NARYKA - PARCEL #9 A permanent sewer easement fifteen feet in width across a tract of land in U.S. Survey 109, Township 45 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, said tract being property conveyed to Dolores R. B. Naryka by Deed recorded in Book 6658, Page 628 of the St. Louis County Records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at a point in the northeasterly line of said tract, said point being the centerline of a stream which crosses Woods Mill Road 280 feet, more or less, southwesterly of the intersection of Woods Mill Road and Ladue Road, and said beginning point being 35.65 feet southeasterly of the southeasterly right-of- way line of Woods Mill Road, measured perpendicularly thereto; thence on a line bearing South 26 degrees 38 minutes West a distance of 42 feet to a point; thence on a line bearing South 79 degrees 44 minutes 12 seconds West, a distance of 38 feet to a point of ending of this easement. Also, a temporary construction easement for use during installation of said sewer on a strip of land 20 feet in width along the southeasterly side of and contiguous with the above- described fifteen-foot-wide permanent sewer easement. Also, a temporary easement on the portion of the above-described tract located northwesterly of the above-described permanent easement to the southeasterly right-of-way line of Woods Mill Road and the centerline of the stream which is the northeasterly line of said property. VILLAGE OF GREEN TRAILS PARK TRUSTEES - PARCEL #10 10 A permanent sewer easement fifteen feet in width across a portion of Ladue Trails Plat One in U.S. Survey 109 and 1911 Township 45 North, Range 4 and 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, according to Plat thereof recorded in Plat Book 114, Page 12 and 13, and across property conveyed to Village of Green Trails Park Trustees by Deed recorded in Book 5598, Page 628 of the St. Louis County records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at the point of intersection of the northwesterly line of Woods Mill Road right-of-way, with the centerline of Ladue Road; thence Southwestwardly along said northwest line of Woods Mill Road right-of-way a distance of 86 feet to a point, said point being the beginning of this easement; thence on a line bearing North 63 degrees, 54 minutes 49 seconds West a distance of 257 feet to a point, being the end of the first segment of this easement; thence continuing on said bearing North 63 degrees 54 minutes 49 seconds West a distance of 111 feet to a point; thence on a line bearing North 69 degrees 25 minutes 22 seconds West a distance of 62 feet to a point which is the beginning point of the second segment of this easement; thence continuing on said bearing North 69 degrees 25 minutes 22 seconds West a distance of 54 feet to a point; thence South 36 degrees 10 minutes 50 seconds West a distance of 151.39 feet to a point; thence on a line bearing South 39 degrees 53 minutes 56 seconds West a distance of 242.62 feet to a point, said point being on a property line of above-described tract and the ending point of this second segment of the easement. Also, a temporary construction easement for use during installation of said sewer on a strip of land 20 feet in width Southerly and contiguous with the first segment of above-described fifteen-foot-wide permanent easement. Also on a strip of land bounded on the Southwest by the North line of the first segment and the first line of the second segment of above-described fifteen- foot-wide permanent easement and the Southwest property line of above-described tract, from the end of the first segment to the beginning of the second segment of the above-described fifteen- foot-wide permanent easement; said strip bounded on the Northeast by the Southeast line of the Ladue Road right-of-way. Also, a temporary construction easement for use during installation of said sewer on a strip of land 20 feet in width Southeasterly and 70 feet in width Northwesterly and contiguous with the second segment of the above-described fifteen-foot-wide permanent easement, said 70-foot-wide strip extended Northeasterly to the Southerly right-of-way line of Ladue Road, 60 feet wide. Also, a fifteen-foot-wide permanent easement across :he above-described tract and located as follows: from the Northeasterly end of the last-described line of the second segment 11 of the above-described fifteen-foot-wide easement, said line being 242.62 feet in length; thence on a line bearing North 76 degrees 4 minutes 27 seconds West a distance of 75 feet. NARYKA - PARCEL #11 A permanent sewer easement fifteen feet in width across a tract of land in U.S. Survey 109, Township 45 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri and across property conveyed to Dolores R. Naryka by Deed recorded in Book 7249, Page 1282 of the St. Louis County records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at the point of intersection of the Northwesterly line of the right-of-way of Woods Mill Road, with the centerline of Ladue Road; thence Southwestwardly along said northwest right-of-way line of Woods Mill Road a distance of 86 feet to a point; thence on a line bearing North 63 degrees 54 minutes 49 seconds West a distance of 257 feet to a point; said point being the beginning of this easement, thence continuing on said bearing North 63 degrees 54 minutes 49 seconds West a distance of 111 feet to a point; thence on a line bearing North 69 degrees 25 minutes 22 seconds West to a point in the Westerly property line of the above-described tract. Also, a temporary construction easement for use during installation of said sewer on a strip of land 70 feet in width Southerly and contiguous with the above-described fifteen-foot-wide permanent easement. Also, a temporary construction easement for use during installation of said sewer on a strip of land bounded on the South by the Northeasterly line of the above-described permanent easement, and bounded on the North and Northeast by the property line of the above-described tract. SHIRLEY M. WILSON - PARCEL #12 A permanent sewer easement fifteen feet in width across a tract of land in U.S. Survey 366 and 369, Township 45 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, said tract being property conveyed to Shirley M. Wilson by instrument recorded in Book 7367, Page 1027 of the St. Louis County records, the centerline of said fifteen-foot-wide easement being more particularly described as follows: Beginning at a point in the westerly line of said property, said point being 442.10 feet northerly of the intersection of said westerly property line with the centerline of Conway Road, 40 feet wide; thence on a line bearing North 46 degrees 03 minutes 51 seconds East a distance of 325.24 feet to a 12 point; thence on line bearing North 5 degrees 31 minutes East a distance of 94.18 feet to a point in the easterly line of said property. Also, from the above-described point, which is 325.24 feet northeasterly of the point of beginning, on a line bearing South zero degrees 33 minutes 55 seconds East a distance of 215 feet to-the point of ending of this line. Also, a temporary construction easement for use during installation of said sewer on a strip of land 50 feet in width along the northwesterly side and 20 feet in width along the southeasterly side of the first and second above-described lines and 50 feet in width along the westerly side and 20 feet in width along the easterly side of the third above-described line, all contiguous with the above-described fifteen-foot-wide permanent sewer easement. Neary and Arlene D. LOUIS KRAUS AND ANITA KRAUS - PARCEL #20 A temporary sewer easement one hundred and eighty feet in length and one hundred and sixty feet in width in a part of Lot 3 of Samuel Conway's Subdivision in U.S. Survey 366, Township 45 North, Range 5 East of the Fifth Principal Meridian, St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 181, Pages 6 and 7, of the St. Louis County records and in the Southeast corner of property conveyed to Louis Kraus and Anita Kraus by Deed recorded in Book 3589, Pages 208 and 209 of the St. Louis County records, the said temporary 180-foot by 160-foot easement being more particularly described as follows: A temporary construction easement for use during installation of a sewer, said easement being 160 feet in width along the Northerly side of and contiguous with the U.S. Highway 40 right-of-way Westerly, from the Easterly property line of the above-described tract, a distance of 180.0 feet along said right- of-way line. 18 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted October 26, 1983.
