HomeMy Public PortalAbout05460 O R D I N A N C E NO. 5460 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St.Louis Sewer District for the purpose of permitting construction of the Kiefer Creek, Fishpot Creek and Grand Glaize Creek Interceptor System (Part of Federal Project No. C-290875) to serve the needs of residents of the Lower Meramec River Basin area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Meramec River Basin wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is 2 necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements for the use of sewer lines as hereinafter set forth, together with temporary easements adjacent to the right-of-way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: PARCEL NO. 1 (HUFFMAN, ROY L. & ALICE M.) PERMANENT EASEMENT 10 FEET WIDE A tract of land in Suttons Estate Partition of Mason Tract in U.S. Survey 128, Township 45 North, Range 5 East in St. Louis County, Missouri, and described as follows: A tract of land 10 feet in even width lying 5 feet on either side of a line described as follows: Commencing at a point in the Southerly line of U.S. Survey 128 four hundred twenty and twenty two hundredths (420.22) feet, Northeastwardly of the Southwest corner of U.S. Survey 128; thence continuing Northeastwardly along said Southerly line a distance two hundred forty nine and sixty eight hundredths (249.68) feet to a point that is the Southwest corner of a tract of land described in Deed Book 1376, Page 2, St. Louis County Records; thence Northwestwardly along the Westerly line of last said tract a distance of four hundred twenty two and ninety eight hundredths (422.98) feet, more or less, to a point that is the Northwest corner of a tract of land described in Deed Book 2145, Page 403, St. Louis County Records; thence Northeastwardly along the Northern line of last said tract, a distance of one hundred thirty nine and nine hundredths (139.09) feet, more or less, to the beginning of said 10 foot wide permanent easement; thence Northwesterly along the centerline of said easement, a distance of 132.77 feet; thence Southwesterly along the centerline of said 3 easement 252.33 feet to the westerly line of the Huffman Property, said point being Northwesterly a distance of 436.14 feet from the Southwesterly corner of said Huffman Property. A temporary construction easement, for use during the construction or reconstruction of any sewer in the above described permanent sewer easement on a strip 25 feet wide along the Northerly side and 10 feet wide along the Southerly side of the above described permanent easement. PARCEL NO. 2 (JOHN R. PATTON, TRUSTEE) PERMANENT EASEMENT 10 FEET WIDE Part of lot 3 of Sutton Estate partition of the Mason tract in U.S. Survey 128, Township 45 North, Range 5 East, and described as follows: A tract of land 10 feet wide in even width lying 5 feet on either side of a line described as follows: Commencing at the Southwest corner of said Survey 128; thence North 68 degrees East along the south line of said survey, 420.22 feet; thence North 22 degrees West, 436.14 feet to the beginning of said 10 foot wide permanent easement; thence South 60 degrees 50 minutes 21 seconds West along the centerline of said 10 foot wide easement a distance of 185.06 feet; thence South 67 degrees 52 minutes 10 seconds West along said centerline a distance of 236.61 feet to the Westerly property line of said Patton property. A temporary construction easement, for use during the construction or reconstruction of any sewer in the above described permanent sewer easement on a strip 25 feet wide along the Northerly side, and 10 feet wide along the Southerly side of the above described permanent easement. PERMANENT EASEMENT 10 FEET WIDE Part of Sections 31 and 32, Township 45 North, Range 5 East, St. Louis County, Missouri and being more particularly described as follows: A tract of land 10 feet wide in even width lying 5 feet on either side of a line described as follows: Commencing at a point on the line dividing lots 3 and 4 of the Benjamin Lacy Estate said point being on the South line of Manchester Road, as widened, thence along the South line of Manchester Road, North 70 degrees 56 minutes East 805.29 feet to a point, said point being the Northwest corner of a tract of land now or formerly conveyed to William T. A temporary construction easement for use during the construction or reconstruction of any sewer line in the above described 5 permanent sewer easement on a strip 25 feet Wide along the Southerly side of the above described permanent easement, a strip 20 feet Wide along the Northerly side beginning at the easterly property line and extending 325 feet in a Westerly direction parallel to the above described permanent easement and a 20 foot Wide strip beginning at a point 70 feet East of the Westerly property line and extending in a Westerly direction parallel to the above described permanent easement to the Westerly property line of the above described tract. Survey 2999 alias 2004, T.44N. - R.5E., in the City of Valley Park, St. Louis County, Missouri, and more particularly described as follows: 15 Beginning at a point in the East line of Meramec Station Road, at its intersection with the dividing line between Lots 17 and 18 of said Block and subdivision; Thence South along the East line of Meramec Station Road, 10.54 feet; Thence Easterly, 15.36 feet to the dividing line between said Lots 17 and 18; Thence North 47 degrees 31 minutes West along said dividing line 18.59 feet to the point of beginning.
