AN ORDINANCE, declaring the necessity for the
acquisition of the fee simple estate and every other estate of
interest in certain property within The Metropolitan St. Louis
Sewer District for the purpose of permitting construction of the
Vance Road Pump Station (Part of Federal Project No. C-290875) to
serve the needs of residents of the Lower Meramec River Basin area
and authorizing the acquisition of such property by purchase or by
the institution of condemnation proceedings.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area known as the Lower Meramec River Basin area
wherein live and work numerous people; and
WHEREAS, the present means for treating and disposing
of sanitary sewage gathered from such area are or will soon be
inadequate, and such inadequacy will constitute a menace to the
health and welfare of the general public and the residents of The
Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by constructing sewage treatment and disposal plants and systems
in said area in order to relieve and alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Board of Trustees hereby finds,
determines, and declares that in order to protect the public
health and relieve insanitary and dangerous conditions, it is
necessary and in the public interest to appropriate and acquire by
purchase or by the exercise of eminent domain or otherwise, the
fee simple estates and every other estate in interest in certain
properties for construction of a sewage pump station and system as
herein after set forth, said property being more particularly
described as follows:

Part of Lot 16 of MERAMEC PACIFIC RAILROAD SUBDIVISION, in U. S. Survey 2999, alias 2004, described as: Beginning at a point in the center line of Vance Road, the Southwestern corner of a tract described in deed recorded in Book 2852 Page 144 of the St. Louis County Records; thence along the center line of Vance Road, North 74 degrees 14 minutes West 97.80 feet and South 72 degrees 32 minutes West 131.40 feet; thence along the center line of Fishpot Creek the following courses and distances: North 36 degrees 14 minutes West 72.22 feet; North 84 degrees 59 minutes West 273.14 feet; North 4 degrees 36 minutes West 94.33 feet; North 57 degrees 40 minutes East 222.64 feet; North 40 degrees 21 minutes East 61.30 feet; North 21 degrees 56 minutes East 85.89 feet and North 27 degrees 41 minutes West 94.43 feet; thence leaving said creek line and running North 88 degrees 44 minutes East 429.60 feet; thence North 88 degrees 32 minutes East 55.31 feet to the Northwest corner of property described in the aforementioned deed; thence along the West line of tract described in said deed South 17 degrees 32 minutes West 527.81 feet to the point of beginning, containing 5.24 acres, according to survey executed by Elbring Surveying Company on August 1, 1951.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to acquire by purchase
if possible or to institute and prosecute an action in
condemnation pursuant to the provisions of the Plan of The
Metropolitan St. Louis Sewer District and the laws of the State of
Missouri for the appropriation of private property as hereinabove
set out.
The foregoing Ordinance was adopted January 11, 1984.
