RFP/build out and data synthesis, Scope—VHB, GHD, CDM, SEA, Horsely Whitten. Submissions and Proposals by 6/8/11. Storm water Mapping — Sue met with the SEA consultant. It has been difficult for Bob Bersin the consultant and Sue to meet. Hughes, J is concerned that this is taking a long time to resolve. Ed Lewis expressed concern as well. Joanne shared a map—easement drain. Blueberry Pond. Ponds Work— Contract and Scope at UMass for approval. Field work to start soon. r.>. �,. Hughes asked the committee to send written comments to Leven by the end of the week. Skidmore said he would like to see a purpose written out. He would like to see the goal of the plan... Phase I accomplished "this" and Phase II is going to"...." Page 4 deliverables— Successful consultant shall provide updates by email at regular intervals "Successful consultant shall provide CWPC with monthly contract status reports by email or in person" Item B—Build out analysis (Separate?) He thinks this is confusing. (Hughes, J agrees). A separate RFP Hughes, P stated that Phase II is an integration of this data Hughes, P - Page 2 number 2, review Brewster zoning and by-laws...CDM did not do this Skidmore— Review by-laws specifically related to wastewater, CDM did not complete this Water supply: "Brewster Water Company", all public and private? What is the scope? The committee discussed"public water supply"-There is a map GIS layer that shows public water supply. Pat Hughes asked members to send written comments to Leven Hughes suggested giving respondents a month to respond. Hughes J mentioned it says 7/18 in the draft proposal. There were some questions about build out completion and complete funding. Bennett asked about timing and completion of the bridge projects.The committee discussed further. Yt...`�,."a A .O �"�, � a r , Update on Namskaket Marsh — CCC DRI review of Orleans OCWMP Pat Hughes provided an update. Pat Hughes, Charlie Sumner, Ed Lewis and Sue Leven attended a meeting with Town of Orleans officials at the CCC May 12th . Attendees from Orleans included George Meservey, Margie Fulcher, John Kelley, and CWPC 5-23-11.doc Page 2 of 6 Audio recording—CWPC_052311_Aaudiominutes,CWPC_052311_baudiominutes Brian Dudley from DEP. The purpose was to get the towns together to discuss Brewster's concern about the marsh. (shared water shed) They suggested that the Town of Brewster propose language to be included in the CCC findings, for the OCWMP. A copy of the draft letter was sent to the group. The group asked that they make a finding that this is a shared resource. Brewster has a shared interest in protecting the marsh and requests conditions. 1) Establishing technical review committee 2) Ground water discharge permit. BOS met last Wednesday and adopted the letter. Peter Norton (BOS Chair) signed it and it was sent to the CCC last week. Hughes, J asked if the commission was sympathetic to Brewster's concerns. Hughes, P explained that Paul Niedzwiecki wanted to see a good resolution. This is an issue that will come up with other towns. Mr. Dudley indicated that the State felt they did not need to step in. He thinks the towns should work it out. Mr. Meservey drafted some language concerning the conditions. This was based on conservations with Leven. He understood that we want to be a part of making the decision. Mrs. Fulcher appreciated where we were coming from. It was positive. CCC will integrate this letter into the work their committee is doing. Taylor mentioned the public hearing tomorrow and asked if anyone was attending. Bennett asked if there has been a letter written to request the data we want from tri town. He explained that we did get some data. An annual update is requested. He asked for a copy of the discharge permit, plan, tabulated data and a map showing monitoring wells. Hughes, J stated that we clearly asked Leven to get this information. Dave sent Sue an email message. He did not receive a response. Hughes, P thinks Charlie Sumner needs to call Jay Burgess. The committee discussed what to do next. Hughes will follow up with Leven. Schell shared comments regarding adaptive management and the plant. Is the letter enough? How will adaptive management do anything else with that effluent? He is concerned that the old questions are still unresolved. There are divided theories about where the water goes. This letter will be an enclosure with the CCC findings. Schell thinks the Town has lost an opportunity to acquire a real standing with this marsh. How much is the discharge capability for Brewster and Orleans? Hughes re-stated the purpose of the meeting. It will be included in the regulatory decision. Evans asked for clarification regarding the other small system mentioned earlier tonight. Hughes P explained there is a 20 to 30 year phased development for town of Orleans. Some sections on satellite section, step system, others. Some areas are not proposed to be sewered. There was discussion about possible alternatives (phases) Hughes, J said the letter great. If the science is wrong, Brewster is in compliance with what Orleans is saying and following the DRI. She is concerned about using up the capacity of Namskaket Marsh. Lewis stated there may be a misconception. The CCC arranged a meeting of cooperation with the two towns. Brewster has an opportunity to disagree. We explained that Brewster wants to be part of the decision making process. We have a chance to contribute at the planning phase. Evans and Schell discussed options to go back and build. (Effluent numbers, DEP allowances, option to take more nitrogen out later.) Schell is concerned with nitrogen assimilative capacity per square meter. Evans shared an opinion. If the treatment facility is built, is there no recourse to the problems? There was a lengthy discussion. Hughes, P participated too. Schell said the Committee is asking the right questions. Orleans is recognizing Brewster has questions and concerns. They are not saying they are going to do anything about the concerns. Schell explained we had our opportunity to comment by a certain date. He explained the process further. Hughes, P summarized that we (Brewster)want to take every opportunity to point out that we believe it is in the best interest of all involved to have better information about where the plume is going to be. Identify potential impact on the marsh. A contingency plan is required if there are adverse environmental impacts. Bennett asked if the final environmental impact report was approved. Schell stated yes and it is available on the Web. Schell said it was as if Brewster doesn't exist. Hughes, P commented further regarding data. There was a discussion of the data, modeling, and the Orleans DRI application. Is it based on computer model or historic data?There was a discussion regarding the plume. It is a critical question that we don't have data on. Hughes explained further. At the meeting there was no long term discussion about the modeling. Monitoring, plume, long term environmental impacts were not discussed. Schell questioned what transformation or change of attitude would influence it? Implement adaptive management features? Hughes, P explained that Orleans is entering into a multi year plan. She thinks there will be opportunity to discuss issues further. This committee needs to read the final environmental impact report to be able to discuss this subject further. We need to be well informed and educated to participate in this type of discussion. We need a consultant to help us. Any member of the committee is welcome to attend the public hearing tomorrow. Taylor will check to see when the public hearing is tomorrow and will follow up with Leven. Hughes, P will ask Leven to go to the hearing tomorrow. What does the committee want to communicate? Committee Concerns: Hughes, J said contingency plans should be discussed. Bennett suggested calling attention to the letter. Hughes, J is concerned about huge amounts of fresh water being poured into the marsh. She asked Bennett if this is a concern. Skidmore asked about impact to the aquifer itself? Bennett is concerned that science supports this project but science is not driving it. He is concerned that the data is not being offered to review. The committee discussed effluent numbers, expense, treatment, ground water discharge permits, other permits, exemptions, (Orleans is an exempt area). Bennett explained further to the committee. Bennett and Hughes, P asked if the committee should be more involved in a technical review or is that the consultant's responsibility? Phase II consultant responsibility?What does Charlie or the Town receive from Tri Town? Do we receive anything from Orleans planning (as an abutter)? There was a lengthy discussion. Question for Charlie Sumner: Sumner joined the meeting. He is on the Board of the Tri Town Plant. Hughes, P explained that the committee asked for data on the tri town monitoring. Bennett explained further. He is asking for tabulated information in Excel. He wants tabulated ground water data. It is just a matter of getting the records. Charlie will follow up with Sue and call Jay. Charlie asked Jay to send Dave the data. No BOS attending public hearing tomorrow. Hughes expressed that there is a long term concern for a contingency plan. Sumner said that Orleans will have to go to Brewster Conservation for an order of conditions. The committee discussed the issue in the past between Orleans and the Brewster Conservation Commission. Charlie asked for the end result of that process. Hughes P suggested calling Mr. Henchy. Miller suggested a joint committee between the towns -- have a few members from the Conservation Commission Bennett explained that we can review the decision once it is filed. Notification from the Town of Orleans before it is filed? There were further questions about tri town dismantling possibly 2014, 2015. Sumner—Current permit expires 2012, negotiate continuation. Sumner explained Orleans wants Brewster and Eastham to be involved. Sumner said that we don't know our needs yet. He suggested that this committee should work with our consultant to define Brewster's needs. He said we need to move forward and it needs to be a priority in Phase II work. Find out the advantages of Brewster being involved in the Orleans Wastewater Management Plan. Orleans is going for design funds in May 2012. Hughes, P summarized bridge projects RFP's sooner than later. Hughes, J mentioned the Orleans CWMP: Capacity of Namskaket would not accommodate all of Orleans. J The final report excluded Brewster. Sumner suggested there is not enough capacity in the marsh. Hughes P explained there is not enough design capacity of the waster water facility. Discussion continued with the committee. Hughes, J read from the 2009 report. Sumner says conversations recently say there is capacity. Hughes, P -Alternative decentralized options?There might be options.
