HomeMy Public PortalAbout05604 O R D I N A N C E NO. 5604 AN ORDINANCE, declaring the necessity for the acquisi- tion of an easement within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permit- ting construction of the Grand Glaize Creek Interceptor System (Part of Federal Project No. C-290875) to serve the needs of residents of the Lower Meramec River Basin area and authorizing the acquisition of such easement by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Lower Meramec River Basin wherein live and work numerous people; and WHEREAS, the present means for treating and disposing of sanitary sewage gathered from such area are or will soon be inadequate, and such inadequacy will constitute a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metro- politan St. Louis Sewer District to protect the public health by constructing sewage treatment and disposal plants and systems in said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines, and declares that in order to protect the public health and relieve insanitary and dangerous conditions, it is 2 necessary to appropriate and acquire by the exercise of eminent domain or otherwise an easement for the use of sewer lines as hereinafter set forth, together with a temporary easement adjacent to the right-of-way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easement, said permanent and temporary easements being more particularly described as follows: (JAN R. NIEZING & URSULA F. NIEZING) PERMANENT EASEMENT 10 FEET WIDE Part of Lots 7, 8, and 9 in Block 8 of Triplett's addition to Manchester and also part of a tract of land located in Section 36 Township 45 North, Range 4 East as described in Book 6762 Page 1065 of the St. Louis County Records and is more particularly described as follows: A tract of land 10 feet in even width lying 5 feet on either side of a line described as follows: Commencing at a point in the Eastern line of Sulphur Springs Road at the Northwest corner of a tract acquired by Marvin A. Spears and wife, by deed recorded in Book 3772 Page 322 of the St. Louis County Records; Thence Southerly along the Easterly R.O.W. line of said Sulphur Springs Road a distance of 165.3 feet to the beginning of a 10 foot wide permanent easement; Thence Easterly along the centerline of said 10 foot wide easement which lies 5 feet Northerly and parallel with the Northerly property line of a tract conveyed to St. Louis County of Jehovah's Witness as recorded in Book 3428 Page 212 of the St. Louis County Records: a distance of 161.43 feet; Thence Southeasterly along said centerline a distance of 28.9 feet to the Northerly R.O.W. line of First Street (40 feet wide) said point also being 3.4 feet Westerly of the Southeasterly corner of Lot 7 of said Block 8. A temporary construction easement for use during the construction or reconstruction of any sewer in the above described permanent sewer easement on a strip 20 feet wide along the Northerly side of the above described permanent easement. 3 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible or to institute and prosecute an action in condem- nation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out.
