HomeMy Public PortalAbout05666 O R D I N A N C E NO. 5666 AN ORDINANCE, authorizing and directing the Executive Director to grant to Mississippi River Transmission Corporation the right to construct, operate and maintain a gas transmission system consisting of mains and appurtenances thereto over and across certain property of the District known as the River des Peres Drainage Channel, in the City of St. Louis, Missouri, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, the Mississippi River Transmission Corporation has asked the District for the right to construct, operate and maintain said gas transmission system, over and across certain hereinafter described real property of the District known as the River des Peres Drainage Channel, and the District is desirous of granting such right for the good of the general public, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the Mississippi River Transmission Corporation the right to construct, operate and maintain a gas transmission system consisting of mains and appurtenances thereto over and across certain real property of the District as hereinafter described in the City of St. Louis, Missouri, such property being described as follows: 2 Beginning at a concrete monument marking the most Northerly corner of Bitucote Products Company property as described in General Warranty Deed dated April 1, 1977, as shown of record in the office of the recorder of deeds for the City of St. Louis, Missouri, in Book 119, Page M 410; thence South 50 degrees 50 minutes West a distance of fifteen and 45/100 feet (15.45') to a point on Mississippi River Transmission Corporation's natural gas pipeline; thence along the pipeline centerline North 25 degrees 18 minutes West a distance of seventeen and 45/100 feet (17.45') to a point; thence North 36 degrees 16 minutes West a distance of seventy two feet (72') to a point; thence North 39 degrees 44 minutes West a distance of sixty six feet (66') to a point; thence North 40 degrees 56 minutes West a distance of forty seven feet (47') to a point; thence North 65 degrees 36 minutes West a distance of four and 6/10 feet (4.6') to the point of beginning; said point of beginning being the intersection of the Southerly property line of the Metropolitan St. Louis Sewer District and the centerline of the easement herein granted; thence continuing North 65 degrees 36 minutes West a distance of one hundred seventy nine and 26/100 feet (179.26') to a point in the Northerly property line of the Metropolitan St. Louis Sewer District. Section Two. The rights herein granted are limited to such rights as the District may have in the premises concerned and the Mississippi River Transmission Corporation shall secure such permission as may be necessary on account of any other existing rights. Section Three. Grantor's right to the use of such property for sewer and drainage purposes is hereby reserved. Section Four. Grantee shall at its own sole cost and expense relocate, change or adjust such portion of its gas transmission system as is reasonably necessary in order to avoid interference with construction and operation of Grantor's facilities in aforesaid property. Section Five. Grantee shall agree to indemnify the 3 Grantor against any claim or damage arriving out of the use of the rights hereby granted. Section Six. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Sections One, Two, Three, Four, and Five hereof. 4 The foregoing Ordinance was adopted June 27, 1984.
