The Council of the City of Medina met in regular session on Tuesday, July 21, 1981 at
7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, Ailliam Reiser, Sarah Lutz,
Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator,
JoEllen Hurr; Public Works Director, Ron Duran; Police Chief, Charles Hoover;
Engineer, Dave Hansing; Attorney, Richard Schieffer; Building Inspector Loren

Council agreed to discuss the following additional items:

2. MINUTES OF JTULY 7, 1981
Motion by Reiser, seconded by Scherer to approve minutes of July 7, 1981, as presented.

3, MINUTES OF MAY 5, 1981
Motion.by Scherer, seconded by Crosby to include both September 12 and 13 as dates approved
for Power Boat races on Lake Independence.

4. PUBLIC WORKS DEPARTMENT
Morris Holmberg, Deer Hill Rd.
Morris Holmberg presented a petition requesting that the city grade and out brush on the
dedicated roadway easement beyond the maintained portion of Deer Hill Rd. He stated that
his tenant has difficulty reaching fields through neighboring properties.
Thomas Anderson stated that he had driven on the easement and it appeared to be in driveable
condition.
Wilfred Scherer stated that the easement had been graded recently. -
Mr. Holmberg stated that he would not need the easement snowplowed in the winter.
Thomas Crosby stated that the policy of the city should be to grade the easement whenever
Deer Hill Rd. is graded and thatthecity should also acknowledge that no snowplowing shall
be done in the winter.
Motion by Crosby, seconded 'by Scherer to accept the petition of Mr. Holmberg requesting that
the Deer Hill Rd. easement be graded and brush cut beyond the normally maintained portion.

Hunter Farms Park
Anne Heideman stated that she had not called a meeting of the Park Commission but that Sarah
Lutz, Penny Elsenpeter and she had met with Ron Duran to discuss the plans for the park. She
reported that the CETA Youth Group would be taking down a fence, clearing brush and laying
out a trail in the creek area.
Ron Duran stated that he knew of an individual who would work for-$10, per hour to lay out
ball fields.
Council agreed that the cost for that work should not exceed $240.
Anne Heideman stated that she had not seen plans nor quotes for planting of perimeter trees.
Motion by Crosby, seconded by Reiser to allow up to $5000 for planting and supervision of
ball field layout in the Hunter Farms Park.

Dodge Power Wagon
Motion by Crosby, seconded by Scherer to sell the inoperable Dodge Power -Wagon to John
Gerhardson for $50.00.

. POLICE DEPARTMENT
Independence Beach Picnic
Motion by Reiser, seconded by Scherer to allow Independence Beach residents to barricade a
number -of predesignated streets on Saturday, August 8 th for an area residents picnic.
Motion declared carried
County Road 24 Parking
Charles Hoover discussed the need to post additional "No Parking" signs along County Rd.
24 due to the increased use of Baker Park.
Motion by Scherer, seconded by Reiser to request Hennepin County to post signs along Co.
Rd. 24 to the Ketcher property as suggested by the Chief of Police.

Criminal Justice Council
Motion by Reiser, seconded by Crosby to adopt Resolution 81-28, approving an increase to
six, the number of representatives from the private sector on the Hennepin County Criminal
Justice Coordinating Council
Motion declared carried
6. PLANNING AND ZONING DEPARTMENT
Elm Creek Watershed District Boundaries
Becky Comstock, Attorney for the Elm Creek Watershed Commission, .appeared to explain the:
petition that Medina is being asked to sign regarding a change in district boundaries to
include properties within the area bordered by Medina Rd., Brockton Lane and Hunter Dr.
and a portion north of Co. Rd. 24 near the city hall.
She stated that the State would be scheduling a Public Hearing and if valid data were sub-
mitted for not changing the boundaries the change would not be made.
Motion by Crosby, seconded by -Reiser to authorize the Mayor and Clerk to sign the petition
requesting that certain lands be excluded from the Minnehaha Creek Watershed District and
included in the Elm Creek District.

Elm Creek Watershed District Joint Powers Agreement
Becky Comstock explained changes made in the Joint Powers Agreement and asked if Medina had
comments on the revised agreement.
JoEllen Hurr stated that she had asked Phil Zietlow to review -and comment.
Thomas Anderson asked why the Commission does not tax as the Minnehaha Creek Commission does.
Ms. Comstock explained that EIm Creek has a unique arrangement whereby citizens -help make
decisions and cities, are asked for input in making major decisions. She stated that the
State has reviewed the Elm Creek procedures and will ask the legislature to change the law
so that all commissions are managed through the counties.
Council referred to minutes of the Elm Creek Commission for the month of June and asked that
Ms. Comstock relay Medina's concerns to the Commission regarding the apparent septic problems
in_Plymouth near Elm Creek and -Hwy. 55.
Brett Cook
Motion by Reiser, seconded .by.Crosby to table the setback variance application of Brett
Cook due to the fact that Mr. Cook has not had time to submit the required grading and
drainage plans to the city.

7. BARN BUILDING PERMITS
Loren Kohnen asked for Council direction regarding the issuance of building permits for
barns. He stated that the State Building Code does not r8quire permits for farm buildings
and he asked for a definition of a farm under the Zoning rdinance.
JoEllen Hurr stated that by not issuing permits setback regulations could be violated and
perhaps a site evaluation permit should be required.
Richard Schieffer stated that he would work with Loren Kohnen and JoEllen Hurr to arrive
at a workable solution.
8. SEPTIC SYSTEM PERMITS
Loren Kohnen asked that septic -system permit fees be increased to $35.00 for conventional
systems and $50.00 for innovative systems due to the fact that two inspections are made on
conventional and three are made on innovative systems.
Motion by Crosby, seconded by Lutz to increase fees to $35.00 and $50.00, as suggested.

9. ENGINEER, LYLE SWANSON
Ron Duran requested that the city provide some recognition for the engineering service that
Lyle Swanson has provided the city for a number of years, in view of the fact that he will be
leaving McCombs Knutson and Associates.
Motion by Crosby, seconded by Lutz to provide a suitable memento to Lyle Swanson at the
August 4th meeting.

10. INDEPENDENCE BEACH SEWER CONNECTIONS
Discussion of the cabins and houses that have not been connected to the sewer in the Indepen-
dence Beach area.
Richard Schaeffer reviewed the agreements that have been signed by cabin owners stating that
they will connect to the sewer at such time as they begin to use on a permanent basis. He
stated that Jim Victorson has sent a letter indicating that he will not connect to the sewer
and Arnold Ostlund has not signed the easement agreement allowing the city onto his property
to install a lift station.
Motion by Reiser, seconded by Scherer to approve signing of agreements with cabin owners
Brede, Olson and Andrews et al.
Motion declared carried
Donna Roehl stated that William Rock and Don Braunwarth also had cabins that were not connected
Richard Schieffer stated that he would contact Mr. Ostlund and would handle the Victorson
matter.
11. INDEPENDENCE BEACH TAX FORFEIT LOTS
Discussion of making a determination as to buildability of tax forfeit lots in the Indepen-
dence Beach area and how to deal with assessments.
Richard Schieffer stated that to remove assessments may cause problems in the future as some
of the lots may be buildable at a future date.
JoEllen Hurr stated that she would work with Richard Schieffer on the entire matter.

12. WEST HENNEPIN HUMAN SERVICES
Donna Roehl was asked to insert a news article in the local newspaper requesting response
from any interested citizens who might wish to serve on the West Hennepin Human Services.
13. JIM LUTZ SIGN
Donna Roehl presented request from Jim Lutz to allow a sign to be placed on his property on
Hamel Rd. regarding "No Dumping."
Council asked that Dave Hansing have Victor Carlson and Son cover up the sidewalk debris so
that others would not continue to dump on the property.
Motion by Crosby, seconded by Reiser to allow temporary "No Dumping" signs to remain on the
property for 30 days, at no charge.

14. ATTORNEY CHARGES, LOYAL HOSETH
Richard Schieffer reviewed letter he had prepared to send to the Minnesota Humane Society
requestin reimbursement of a portion of the $1500 attorney fees incurred, to date, to pro-
secute the Hoseth animal neglect case.
Motion by Reiser, seconded by Scherer to direct Richard Schieffer to send the letter as
written.

15. BILLS
Motion by Crosby, seconded by Reiser to pay the bills; Order Checks # 9648-9652 in the
amount of $3088.29 and Payroll Checks # 6303-6313 in the amount of $5124.98.

16. MEDINA MORNINGSIDE WATER AND SEWER
Discussion of payment to Water Supply Co. for the Medina Morningside water system with
Richard Schaeffer to negotiate with the owners for the $5000 repair amount.
Motion by Crosby, seconded by Reiser to authorize Richard Schaeffer to discuss bonding
with the Hamel Bank and negotiate with members of the Water Supply Co. the amount to be paid.
Motion declared carried
Dave Hansing stated that final plan approval from PCA should be forthcoming and advertisement
for bids could be published immediately after that approval.
Motion by Reiser, seconded by Crosby to hold a special meeting on Thursday, July 23, 1981
at 5:00 P.M. to work with Karen Olson on police policy and to adopt resolution regarding
bidding on the Medina Morningside sewer project if approval is received by that date.

Specifications for Medina Morningside improvements and Ordering Bids to be taken on
August 20, 1981 at 11:00 A.M.
