AN ORDINANCE, declaring the necessity for the
acquisition of easements within certain existing property within
The Metropolitan St. Louis Sewer District for the purpose of
permitting construction of sanitary sewers in the project known
as River Valley Apartments (P-11359) to serve the needs of
residents of the area and authorizing the acquisition of such
easements by purchase or by the institution of condemnation
proceedings.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area of St. Louis County within the Creve Coeur
Creek Watershed wherein live and work numerous people; and
WHEREAS, sanitary sewage gathered from such area will
have no alternative means of disposition to crossing said property
and will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
and welfare by constructing sanitary relief sewers over and across
said area in order to relieve and alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve insanitary and dangerous conditions, it is necessary to
appropriate and acquire by the exercise of eminent domain or
otherwise easements for the use of sewer lines as hereinafter set
forth, and the right of ingress and egress over the premises
sought to be condemned for access to such easements, said
permanent easements being more particularly described as follows:
Theodore Holt and Mary Holt Parcel #1 The centerline of a 10-foot easement strip of land in U. S. Survey 207, Township 46 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as follows: Beginning at a point on the South line of property conveyed to Theodore Holt and wife as described in the deed recorded in Book 4902, page 383 of the St. Louis County Records, being distant North 64 degrees 12 minutes 00 seconds West 85.77 feet from the Southeast corner of said Holt property; thence North 22 degrees 28 minutes 36 seconds East 107.89 feet across said Holt property to a point on the South line of Lot 8 of "River Valley Court", a subdivision according to the plat thereof recorded as Daily Number 532 on August 11, 1978 in the St. Louis County Records being also the point of ending of the aforesaid 10-foot strip. Additional space adjacent to the right-of-way easement strip as described above is required for working room during the construction period. This additional space shall be an area 20 feet wide adjacent to and parallel to both sides of the 10-foot easement strip. The centerline of the 10-foot easement strip with a 20-foot working room area on each side of the 10-foot easement strip is described in the foregoing legal description.
William G. Kelly, Betty J. Jackson, and Donald N. Kelly Parcel #2 The centerline of a 10-foot easement strip of land in U. S. Survey 207, Township 46 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as follows: Beginning at a point on the South line of property conveyed to William G. Kelly, etal, as described in the deed recorded in Book 7231, page 1541 of the St. Louis County Records; said beginning point being distant North 64 degrees 12 minutes 00 seconds West 70.07 feet from the Southeast corner of said Kelly property; thence North 42 degrees 23 minutes 44 seconds East 118.02 feet to a point on the North line of said Kelly Property being the point of ending of the aforesaid 10 foot strip. Additional space adjacent to the right-of-way easement strip as described above is required for working room during the construction period. This additional space shall be an area 20 feet wide adjacent to and parallel to both sides of the 10-foot easement strip. The centerline of the 10-foot easement strip with a 20-foot working room area on each side of the 10-foot easement strip is described in the foregoing legal description.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to acquire by purchase
if possible, or to institute and prosecute an action in
condemnation Pursuant to the provisions of the Plan of The
Metropolitan St. Louis Sewer District and the laws of the State of
Missouri for the appropriation of private property as hereinabove
set out.
The foregoing Ordinance was adopted August 22, 1984.
