Home My Public Portal About05908 O R D I N A N C E NO. 5908 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer to convey certain real property belonging to The Metropolitan St. Louis Sewer District in St. Louis County, Missouri, along with a temporary Slope and Construction License, to St. Louis County, Missouri, and to execute and deliver a General Warranty Deed for said real property and license. WHEREAS, St. Louis County, Missouri requires said real property for the eastward extension of Hoffmeister Avenue, and WHEREAS, the conveyance of said real property will not interfere with District operations, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer are hereby authorized and directed to convey certain real property belonging to The Metropolitan St. Louis Sewer District in St. Louis County, Missouri, along with a temporary Slope and Construction License, to St. Louis County, Missouri, said real property being described as follows: Part of a tract of land in St. Louis County, Missouri, being partly in U.S. Survey 904, Township 44 North, Range 7 East and partly in Carondelet Commons, also being part of Allen's Subdivision in the Chouquette Tract as recorded in Plat Book 3, page 60 of the St. Louis County Records, and being more particularly described as follows: Beginning at the point of intersection of the southwest line of property conveyed to the St. Louis Metropolitan Sewer District, a public corporation, by instrument recorded in Deed Book 6305, page 1288 of the St. Louis 2 County Records with the southeast line of Broadway Avenue (Missouri State Route 231) (60 feet wide); thence North 53 degrees 51 minutes 45 seconds East along said southeast line of Broadway Avenue, a distance of 73.11 feet to a point; thence South 82 degrees 00 minutes 08 seconds East, a distance of 44.48 feet to a point in the southeast line of Hoffmeister Avenue (60 feet wide); thence South 37 degrees 51 minutes 48 seconds East along said southeast line of Hoffmeister Avenue, a distance of 24.32 feet to a point; thence North 56 degrees 09 minutes 24 seconds East, a distance of 60.15 feet to a point in the northeast line of Hoffmeister Avenue, as aforesaid; thence North 37 degrees 51 minutes 48 seconds West along said northeast line of Hoffmeister Avenue, a distance of 16.96 feet to a point; thence North 07 degrees 59 minutes 58 seconds East, a distance of 56.77 feet to a point in the southeast line of Broadway Avenue, as aforesaid; thence North 53 degrees 51 minutes 45 seconds East along said southeast line of Broadway Avenue, a distance of 508.32 feet to a point; thence South 51 degrees 00 minutes 00 seconds West, a distance of 330.41 feet to a point in a line 16.50 feet southeast of and parallel to the southeast line of Broadway Avenue; thence South 53 degrees 51 minutes 45 seconds West along said parallel line, a distance of 177.37 feet to a point of curvature; thence southwestwardly along an arc of a curve to the left having a radius of 40.00 feet and a chord bearing South 07 degrees 59 minutes 59 seconds West 57.41 feet, an arc distance of 64.04 feet to a point in the northeast line of Hoffmeister Avenue, as aforesaid; thence South 56 degrees 09 minutes 24 seconds West, a distance of 60.15 feet to a point in the southwest line of Hoffmeister Avenue; thence northwestwardly along an arc of a curve to the left having a radius of 40.00 feet and a chord bearing North 82 degrees 00 minutes 01 seconds West 55.71 feet, an arc distance of 61.63 feet to a point of tangency in a line 16.50 feet southeast of and parallel to the southeast line of Broadway Avenue as aforesaid; thence South 53 degrees 51 minutes 45 seconds West along said parallel line, a distance of 65.91 feet to a point in the southwest line of the Metropolitan Sewer District property, as aforesaid; thence North 35 degrees 43 minutes 00 seconds West along said southwest line of the Sewer District property, a distance of 16.50 feet to the point of beginning and containing 7,431 square feet, more or less. 3 Together with the following grant by the party of the first part to the party of the second part. A Temporary Slope and Construction License for the purpose of making cuts, fills, and sloping embankment, constructing drives, sidewalks, etc., if any, providing working room and implementing any and all related construction items over the following described property, to wit: Two parts of a tract of land in St. Louis County, Missouri, being partly in U.S.Survey 904, Township 44 north, Range 7 East and partly in Carondelet Commons, also being part of Allen's Subdivision in the Chouquette Tract as recorded in Plat Book 3, page 60 of the St. Louis County Records, and being more particularly described as follows: Part 1. Part 2. The southwest 15.00 feet of the southeast 140.00 feet lying parallel and adjacent to the northeast line of Hoffmeister Avenue (55 feet wide) of property conveyed to the Metropolitan St. Louis Sewer District by instrument recorded in Deed Book 6305, page 1288 of the St. Louis County Records and containing 2,100 square feet, more or less. The last described license is for temporary purposes only and shall therefore terminate upon completion of the contemplated improvement of Hoffmeister Extension, Phase II, St. Louis County Project No. AR-148 by the party of the second part. Section Two. The Executive Director and Secretary- 5 Treasurer are hereby authorized and directed to execute and deliver a General Warranty Deed to St. Louis County, Missouri for the above-described real property and license, upon the receipt of Fifteen Thousand Dollars ($15,000.00) from St. Louis County, Missouri for the purchase of said real property. The foregoing Ordinance was adopted March 13, 1985.
