HomeMy Public PortalAbout06079 O R D I N A N C E NO. 6079 AN ORDINANCE, vacating portions of a sewer easement in Lots 1, 2, 5, 6, 13, 14 and 15 of Emerson Court, Lot 10 of Studt's Home Place and Lot 10 of Lake House Farm Subdivision, in St. Louis County, Missouri, WHEREAS, the owner of the subject property has granted to the District a suitable alternate easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of a sewer easement are hereby vacated, to wit: Seven parcels of land located in part of Lot 10 of Studt's Home Place, a subdivision according to the plat thereof recorded in Plat Book 7, Page 38 of the St. Louis County Records in Section 3, Township 45 North - Range 5 East St. Louis County, Missouri. The seven parcels being part of five foot (5') and ten foot (10') wide easements recorded in Book 5994, Page 593; Book 5973, Page 283; Book 5973, Page 285; Book 5994, Page 595; Book 5994, Page 591 and Plat Book 68, Page 43 of the St. Louis County Records. Three parcels of land located in part of Lot 10 of Lake House Farm Subdivision, a subdivision according to the plat thereof recorded in Plat Book 9, Page 74 of the St. Louis City (formerly County) Records in Section 3, Township 45 North - Range 5 East, St. Louis County, Missouri. The three parcels being part of five foot (5') and ten (10') wide easements recorded in Book 5973, Page 289; Book 6336, Page 2588 and Plat Book 68, Page 43 of the St. Louis County Records. Parcel 1 - Part of an easement originally recorded in Deed Book 5994, Page 593 of the St. Louis County Records and also a tract of land being part of said Lot 10 of Studt's Home Place and described as: Beginning at a point on the East line of Lot 2 of Emerson Court, a subdivision according to the plat thereof recorded in Plat Book 68, Page 43 of the St. Louis County Records; said beginning point being distant North 0 degrees 09 minutes 00 seconds East five and 03/100 feet (5.03') from the Southeast corner of said Lot 2 of Emerson Court; thence Northwardly along said East line of Lot 2 of Emerson Court North 0 degrees 09 minutes 00 seconds East a distance of sixty-eight and 55/100 feet (68.55') to a point; thence South 89 degrees 51 minutes 00 seconds East a distance of five feet (5') to a point; thence South 0 degrees 09 minutes 00 seconds West a distance of sixty-eight and 47/100 feet (68.47') to a point; thence South 89 degrees 20 minutes 26 seconds West a distance of five feet (5') to the point of beginning. Parcel 2 - Part of an easement originally recorded in Deed Book 5973, Page 283 of the St. Louis County Records and also a tract of land being part of said Lot 10 of Studt's Home Place and described as: Beginning at the Northeast corner of Lot 2 of Emerson Court, a subdivision according to the plat thereof recorded in Plat Book 68, Page 43 of the St. Louis County Records; thence Eastwardly along the South line of Lot 1 of said Emerson Court South 89 degrees 51 minutes 00 seconds East a distance of forty-eight and 24/100 feet (48.24') to a point; thence South 0 degrees 09 minutes 00 seconds West a distance of six and 23/100 feet (6.23') to a point; thence South 79 degrees 50 minutes 43 seconds West a distance of forty-three and 94/100 feet (43.94') to a point; thence South 0 degrees 09 minutes 00 seconds West a distance of sixty and 91/100 feet (60.91') to a point; thence North 89 degrees 51 minutes 00 seconds West a distance of five feet (5') to a point on the East line of said Lot 2 of Emerson Court; thence Northwardly along said East line of Lot 2 of Emerson Court North 0 degrees 09 minutes 00 seconds East a distance of seventy-five feet (75') to the point of beginning. Parcel 3 - Part of an easement originally recorded in Deed Book 5973, Page 285 of the St. Louis County Records and also a tract of land being part of said Lot 10 of Studt's Home Place and described as: Beginning at the Northeast corner of Lot 1 of Emerson Court, a subdivision according to the plat thereof recorded in Plat Book 68, Page 43 of the St. Louis County Records; thence South 89 degrees 51 minutes 00 seconds East a distance of five feet (5') to a point; thence South 0 degrees 09 minutes 00 seconds West a distance of forty-four and 79/100 feet (44.79') to a point; thence North 89 degrees 51 minutes 00 seconds West a distance of five feet (5') to a point on the East line of said Lot 1 of Emerson Court; thence Northwardly along the said East line of Lot 1 of Emerson Court North 0 degrees 09 minutes 00 seconds East a distance of forty-four and 79/100 feet (44.79') to the point of beginning. Parcel 4 - Part of an easement originally recorded in Deed Book 5994, Page 595 of the St. Louis County Records and also a tract of land being part of said Lot 10 of Studt's Home Place and described as: Beginning at the Northeast corner of Lot 15 of Emerson Court, a subdivision according to the plat thereof recorded in Plat Book 68, Page 43 of the St. Louis County Records; thence South 89 degrees 16 minutes 00 seconds East a distance of seven feet (7') to a point; thence South 0 3 degrees 54 minutes 25 seconds West a distance of one hundred fifty-one and 36/100 feet (151.36') to a point; thence North 89 degrees 51 minutes 00 seconds West a distance of five feet (5') to the Southeast corner of said Lot 15 of Emerson Court; thence Northwardly along the East line of said Lot 15 of Emerson Court North 0 degrees 09 minutes 00 seconds East a distance of one hundred fifty-one and 42/100 feet (151.42') to the point of beginning. Parcel 5 - Part of an easement originally recorded in Deed Book 5994, Page 591 of the St. Louis County Records and also a tract of land being part of said Lot 10 of Studt's Home Place and described as: Beginning at a point of the East line of Lot 14 of Emerson Court, a subdivision according to the plat thereof recorded in Plat Book 68, Page 43 of the St. Louis County Records; said beginning point being distant North 0 degrees 09 minutes 00 seconds East thirty-four and 42/100 feet (34.42') from the Southeast corner of said Lot 14 of Emerson Court; thence Northwardly along the said East line of Lot 14 of Emerson Court North 0 degrees 09 minutes 00 seconds East a distance of fourteen and 15/100 feet (14.15') to a point; thence South 44 degrees 53 minutes 53 seconds East a distance of sixty-nine and 46/100 feet (69.46') to a point on the North line of Lot 15 of said Emerson Court; thence Westwardly along the said North line of Lot 15 of Emerson Court North 89 degrees 16 minutes 00 seconds West a distance of fourteen and 30/100 feet (14.30') to a point; thence North 44 degrees 53 minutes 53 seconds West a distance of forty-nine and 23/100 feet (49.23') to the point of beginning. Parcel 9 - A tract of land being part of said Lot 10 of Studt's 5 Home Place and described as: Beginning at the Northeast corner of Lot 5 of Emerson Court, a subdivision according to the plat thereof recorded in Plat Book 68, Page 43 of the St. Louis County Records; thence Southwardly along the East line of said Lot 5 of Emerson Court South 0 degrees 09 minutes 00 seconds West a distance of five feet (5') to a point; thence North 89 degrees 51 minutes 00 seconds West a distance of twenty and 55/100 feet (20.55') to a point on the East right-of-way line of Interstate Highway I-270 (formerly I-244); thence Northwardly along the said East line of Interstate Highway I-270 (formerly I-244) North 2 degrees 21 minutes 36 seconds West a distance of ten and 01/100 feet (10.01') to a point; thence South 89 degrees 51 minutes 00 seconds East a distance of twenty and 98/100 feet (20.98') to a point of the East line of Lot 6 of said Emerson Court; thence Southwardly along the East line of Lot 6 of Emerson Court South 0 degrees 09 minutes 00 seconds West a distance of five feet (5') to the point of beginning.
