AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A $60,000 AGREEMENT WITH LINDA AND
GENE WISEMAN FOR THE PURCHASE OF LAND FOR A SANITARY SEWER WET
WEATHER STORAGE FACILITY
WHEREAS, Linda and Gene Wiseman have agreed to sell land to the City for Sanitary
Sewer Improvements
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized to execute an
agreement with Linda and Gene Wiseman for the Sale of Real Estate.
Section 2. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

CITY OF JEFFERSON EXHIBITA
AGREEMENT FOR THE SALE OF REAL ESTATE
THIS AGREEMENT, made and entered into the date last executed by a party as indicated
below, by and between Linda T. and Gene Wiseman, referred to herein as the Sellers, and the City
of Jefferson, a municipal corporation, referred to herein as the Buyer.
IN CONSIDERATION of the mutual promises and covenants and obligations of the
parties set out herein, the parties agree as follows:
1. Sellers agree to sell and convey to the Buyer and the Buyer agrees to purchase from the
Sellers, on the terms and conditions hereinafter set forth, the following described real estate
(including all improvements located thereon) situated in the County of Cole, State of Missouri,
to -wit:
Part of Inlot 102, in the City of Jefferson, Cole County, Missouri, being more
particularly described as follows:
From the most westerly corner said Inlot 102, being the most westerly corner of the
property described in Book 412, page 251, Cole County Recorder's Office; thence
N41144'06"E, along the northwesterly line of said Outlot 102, being the northwesterly
boundary of said property described in Book 412, page 251, 257.94 feet to the most westerly
corner of the property described in Book 476, page 703, Cole County Recorder's Office;
thence along the boundary of said property described in Book 476, page 703 the following
courses: S48°24'11"E, 46.80 feet; thence S86028'50"E, 134.58 feet; thence S72°26'16"E,
68.55 feet; thence N10041'29"E, 58.90 feet; thence N40031'22"E, 93.29 feet; thence

description; thence southwesterly on a curve to the left having a radius of 50.00 feet, an are

thence S10041'29"W, 26.94 feet; thence S86018'50"E, 260.73 feet to a point on the boundary
of said property described in Book 412, page 251, being a point on the westerly boundary of

to the southeasterly corner of the property described in Book 601, page 573, Cole County

corner of said property described on Book 320, page 259, being the most easterly corner of
the property described in Book 583, page 607, Cole County Recorder's Office; thence
S41050'21"W, along the southeasterly boundary of said property described in said Book
583, page 607, 75.00 feet to the point of beginning.
Containing 1.80 Acres.
The aforesaid conveyance and transfer of property is subject, however, to any reservations,
easements or restrictions of record and any zoning laws, regulations or ordinances affecting the
said property, as will not materially interfere with such use of the property as the Buyer might
reasonably expect to make in view of the general character of the area and neighborhood in which
the property is located.
2. The price to be paid by the Buyer to the Sellers for the above-described real property and
improvements and personal property located thereon shall be Sixty Thousand Dollars
($60,000.00).
3. The sale under this Agreement shall be closed within sixty (60) from the date last
executed by a party as indicated below, at the time and place as the parties may mutually agree.
4. Possession of the property shall be delivered to the Buyer at the time of closing.
5. It is understood and agreed that title herein required to be furnished is marketable title as
set forth in Title Standard 4 of the Missouri Bar. It is also agreed that any encumbrance or defect in
the title which is within the scope of any of the Title Standards of the Missouri Bar shall not
constitute a valid objection on the part of the Buyer, provided the Sellers furnish the affidavits, or
other title papers, if any, described in the applicable standard.
6. If the title to said real property be marketable in fact as called for herein, the Sellers shall
deliver for the Buyer at the office of said Sellers' agent a general warranty deed free and clear from
all liens and encumbrances whatsoever, except as herein provided, and the Buyer shall then and
there pay the purchase price to Seller by check.
7. The Buyer will be responsible for costs associated with surveying the property, splitting
the lot, and all other costs.
IN WITNESS WHEREOF, the parties hereto have executed this agreement the day and
year first above written and acknowledge receipt of one copy of the contract.
