HomeMy Public PortalAboutORD15763BILL NO. 2017- 108 SPONSORED BY COUNCILMAN Henry ORDINANCE NO. /5�/'(u 1S AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADDING A NEW ARTICLE GOVERNING THE USE OF ELECTRICAL POWER IN THE DOWNTOWN ELECTRICAL SERVICE AREA. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 32 (Streets and Sidewalks) Article XIII (Downtown Electrical Service Area) is created as follows: ARTICLE X111. DOWNTOWN ELECTRICAL SERVICE AREA Sec. 32-500. Purpose and intent. The purpose of this Article is toru ovide for the permissive use of electrical power from the City's electrical facilities located within the Downtown Electrical Service Area. Sec. 32-501. Downtown Electrical Service Area Established. There is hereby established the Downtown Electrical Service Area, which includes Capitol Avenue from Cherry Street to Adams Street; High Street from Washington Street to Adams Street; and Madison Street from Capitol Avenue to High Street. Sec. 32-502. Permit Required. Noep rson shall access the electrical power facilities located within the Downtown Electrical Service Area without first obtaining aep rmit from the department of nnblic works. If aep rmit is requested for an event, then the event organizer shall apply for and receive theep rmit for electrical power access for all of the event participants. Sec. 32-503. Permit Fee. The iLty administrator shall establish the fee for theep rmit to access electrical power in the Downtown Electrical Service Area as set forth in Appendix Y. Sec. 32-504. Permit Duration. Theep rmit shall be valid for unto five I consecutive calendar days. The permittee must obtain an additionalep rmit to use the electrical services for a duration longer than five days. Sec. 32-505. Usage Guidelines. The director of public works shall promulgate the guidelines and rules for the usage of electrical power within the Downtown Electrical Service Area. Any user who misuses the system shall pay a reimbursement fee to the City ofFifty Dollars $5( 0.00) per hour incurred by City personnel to re air the system or the actual charge of any contractor hired by the City to repair the system, whichever isreg ater. Sec. 32-506. Tampering with Electrical Facilities Prohibited. Downtown Electrical Service Area. A violation of this Section is an ordinance violation punishable by afine of uE to one thousand dollars ($1,000.00) or uj to one hundred eighty 0 80) days imprisonment, or both. Section 2. Appendix Y (Schedule of Administrative Fees, Permits, Licenses and Other Charges is amended as follows: Chapter Section Section Title Fee 32 503 Permit Fee Base Fee plus the following: $70 20 Amp Service: $5 for each circuit/location. $25 for each location 100 Amp Service: $100 per each location. 200 Amp Service: Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
