AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING PROPERTY ADDRESSED AS 3328 BENNETT
LANE FROM RU RURAL TO PUD PLANNED UNIT DEVELOPMENT, APPROVAL OF
A PRELIMINARY AND FINAL PUD PLAN FOR SAID PROPERTY, AND ACCEPTING
AND APPROVING THE FINAL SUBDIVISION PLAT OF WOODLAND MONTESSORI
SCHOOL SUBDIVISION, A SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, It appears that the procedures set forth in the zoning code relating to
zoning have in all matters been complied with; and.
WHEREAS, F&F Development LLC, owners of the real estate hereinafter described,
having submitted to the City Council a plat of said real estate, being located in Jefferson
City, Cole County, Missouri, and described as: Part of the South Half of the Northeast
Quarter of Section 26, Township 44 North, Range 12 West, partially located in the City of
Jefferson, Cole County, Missouri, being more particularly described as follows: From the
southwest corner of the Southeast Quarter of the Northeast Quarter of said Section 26,
thence N2°40'48"E, along the Quarter Quarter Section Line, 190.36 feet to the
southeasterly corner of the property described in Book 195, page 495, as corrected by
Affidavit recorded in Book 439, page 664, Cole County Recorder's Office and the POINT
OF BEGINNING for this description; thence S84°03'16"W, along the southerly line of
said property described in Book 195. page 495, as corrected by Affidavit recorded in
Book 439, page 664, 683.28 feet to a point on the easterly right-of-way line of
Southwood Hills Road; thence N6028'03"W, along the easterly right-of-way line of
Southwood Hills Road. 60.00 feet to a point on the northerly line of the 10 foot strip
described in Book 439, page 666, Cole County Recorder's Office, being a point on the
southerly line of Don -Dee Estates, as recorded in Plat Book 12, page 255, Cole County
Recorder's Office; thence N84003'16"E, along the northerly line of said 10 foot strip and
the southerly line of said Don -Dee Estates, 692.92 feet to a point on the Quarter Quarter
Section Line; thence N2°40'48"E, along the Quarter Quarter Section Line 348.46 feet;
thence S87019'14"E, 298.57 feet to a point 30 feet (measured perpendicularly) from the
centerline of the 30 foot Ingress/Egress Easement (Bennett Lane), as described in
Survey Record Book B, page 771, Cole County Recorder's Office; thence parallel to and
30 feet equidistant from the centerline of said 30 foot Ingress/Egress Easement (Bennett
Lane) the following courses: southerly, on a curve to the left having a radius of 1030.00
feet, an arc distance of 152.68 feet (Ch=SO°21'26"W, 152.54 feet; thence southerly on a
curve to the right having a radius of 470.00 feet, an arc distance of 64.60 feet
(Ch=S0°02'53"W, 64.54 feet); thence S3059'07"W, 173.73 feet; thence southerly on a
curve to the right having a radius of 1970.00 feet, an arc distance of 30.42 feet
(Ch=S1°48'25"W, 30.42 feet); thence leaving the courses parallel to and 30 feet
equidistant from the centerline of said 30 foot Ingress/Egress Easement (Bennett Lane),
N78°38'45"W, 136.53 feet: thence northwesterly on a curve to the left having a radius of
370.00 feet, an arc distance of 111.72 feet (Ch=N87°17'45"W, 111.29 feet); thence
S84°03'16"W, 58.62 feet to the point of beginning. Containing 3.77 acres; and,
WHEREAS, It appears that said plat has been fully and properly signed and accepted
by the owner of said subdivision, known and referred to as the Final Subdivision Plat of
Woodland Montessori School Subdivision, that all taxes have been paid, that in all
respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully
complied with by the owner of said subdivision, and that in all respects the requirements
of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to
plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RU Rural to PUD
Planned Unit Development: Part of the South Half of the Northeast Quarter of Section
26, Township 44 North, Range 12 West, partially located in the City of Jefferson, Cole
County, Missouri, being more particularly described as follows: From the southwest
corner of the Southeast Quarter of the Northeast Quarter of said Section 26; thence
N2040'48"E, along the Quarter Quarter Section Line, 190.36 feet to the southeasterly
corner of the property described in Book 195, page 495, as corrected by Affidavit
recorded in Book 439, page 664, Cole County Recorder's Office and the POINT OF
BEGINNING for this description; thence N2040'48"E, continuing along the Quarter
Quarter Section Line 409.14 feet; thence S87019'14"E, 298.57 feet to a point 30 feet
(measured perpendicularly) from the centerline of the 30 foot Ingress/Egress Easement
(Bennett Lane), as described in Survey Record Book B, page 771, Cole County
Recorder's Office; thence parallel to and 30 feet equidistant from the centerline of said
30 foot Ingress/Egress Easement (Bennett Lane) the following courses: southerly, on a
curve to the left having a radius of 1030.00 feet, an arc distance of 152.68 feet
(Ch=S0021'26"W, 152.54 feet; thence southerly on a curve to the right having a radius of
470.00 feet, an arc distance of 64.60 feet (Ch=SO002'53"W, 64.54 feet); thence
S3059'07"W, 173.73 feet; thence southerly on a curve to the right having a radius of
1970.00 feet, an arc distance of 30.42 feet (Ch=S1°48'25"W, 30.42 feet); thence leaving
the courses parallel to and 30 feet equidistant from the centerline of said 30 foot
Ingress/Egress Easement (Bennett Lane), N78038'45"W, 136.53 feet; thence
northwesterly on a curve to the left having a radius of 370.00 feet, an arc distance of
111.72 feet (Ch=N87017'45"W, 111.29 feet); thence S84°03'16"W, 58.62 feet to the
point of beginning. Containing 2.82 acres, more or less.
Section 2. The Preliminary and Final PUD Plan, on file as Case No. P17023 in
the Jefferson City Planning Division, is hereby approved for the land referenced above.
Section 3. Permitted Land Uses. Permitted uses, outdoor lighting, and signage
shall be limited to that which is permitted within the C -O Office Commercial zoning
district.
Section 4. Common Areas and Public Land. No common areas are proposed
and no lands are dedicated to public use with this PUD Plan.
Section 5. That the Final Subdivision Plat of Woodland Montessori School
Subdivision, lying, being and situated within the corporate limits of the City of Jefferson,
Missouri, as shown by the said plat attached hereto and made a part of this ordinance, is
hereby approved and accepted by the City Council of the City of Jefferson, Missouri.
Section 6. The Mayor and City Clerk are hereby authorized and directed to
endorse acceptance of said plat hereon and to certify the approval of said plat under the
seal of the City of Jefferson.
Section 7. This ordinance shall be in full force and effect from and after its
passage and approval.

Case No. P17023 — 3328 Bennett Lane, Rezoning from RU to PUD, Preliminary & Final PUD
Plan, and Final Subdivision Plat. Request filed by F&F Development LLC, property owner, and
Jesse and Melissa Steck, applicants, for the following:
A. Rezoning of 3.77 acres addressed as 3328 Bennett Lane from RU Rural to PUD Planned
Unit Development.
B. Preliminary and Final PUD Plan to use the existing building as a daycare/Montessori
school.
C. Final Subdivision Plat for Woodland Montessori School Subdivision, consisting of 1 lot
and 3.77 acres.
The property is located on the northwest corner of the intersection of Bennett Lane and Rickman
Lane and is described as Part of the Northeast Quarter of the Southeast Quarter of Section 26,
Township 44 North, Range 12 West, Jefferson City, Missouri (Central Missouri Professional
Services, consultant).
Mr. Rotenberry described the proposal and explained that the property owner intends to split the
former church building from the surrounding property and transfer it to the new owner who would
convert it to a daycare/Montessori school. He stated that the subject property is part of a larger
piece of the former Rickman Center property. Mr. Rotenberry explained that in order to meet the
zoning regulations for the new use, the owner is proposing rezoning of property from RU Rural to
PUD Planned Unit Development and a PUD Plan outlining the daycare use. He stated that a Final
Subdivision Plat for a one lot subdivision is also proposed to accomplish the property transfer.
Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Samson distributed visuals depicting the subject property. He stated that
in order to meet the City's subdivision code, one of the requirements is that all new subdivided lots
have frontage on a publicly dedicated street. Mr. Samson explained that the only publicly dedicated

street is on Southwood Hills and Christy Drive since Bennett Lane and Rickman Lane are private
roads. He stated that in order to meet the subdivision code and maintain the publicly dedicated
frontage the flag lot was created. Mr. Samson explained that there are no additional plans for the
property other than the proposed daycare/Montessori School. He stated that the main access will
be from Bennett Lane and Christy Drive. Mr. Samson explained that staff recommended the PUD
zoning to dedicate the use as a daycare/Montessori School to protect the interests of the adjacent
neighborhood.
Ms. Melissa Steck, 18688 Factory Creek Road, Jamestown, MO spoke regarding this request
and explained that she is the future owner of this property. She stated that the subject property will
be used as a daycare/Montessori School. Ms. Steck explained that the proposed
daycare/Montessori School is a not for profit and will be named Woodland Montessori School. She
stated that the daycare/Montessori School will open at 7:30 a.m. and close at 5:30 p.m. Ms. Steck
explained that 24 children will attend the daycare/Montessori School.
No one spoke in opposition to this request and no correspondence was received.
Mr. Rotenberry gave the Planning Division staff report. Mr. Wade gave the Engineering Division
staff report.
Mr. Barron explained that an underlying zoning district of C -O Office Commercial will be assigned
within the PUD Plan for the purpose of determining uses, signage and outdoor lighting.
Ms. Cotten moved and Mr. Lester seconded to recommend approval to rezone 3.77 acres from
RU Rural to PUD Planned Unit Development, to the City Council. The motion passed 7-0 with the
following votes:
Aye: Cotten, Deeken, Lester, Mahoney, Markus, Vaughan, Yarnell
Abstain: Nunn
Ms. Cotten moved and Mr. Lester seconded to recommend approval of the Preliminary and Final
PUD Plan to use the existing building as a daycare/Montessori School with an underlying zoning of
C -O for the purpose of determining future permitted uses, signage, and outdoor lighting, to the City
Council. The motion passed 7-0 with the following votes:
Aye. Cotten, Deeken, Lester, Mahoney, Markus, Vaughan, Yarnell
Abstain: Nunn
Ms. Cotten moved and Mr. Lester seconded to recommend approval of the proposed Final
Subdivision Plat for Woodland Montessori School Subdivision subject to comments and technical
corrections of the Planning and Engineering Divisions, to the City Council. The motion passed 7-0
with the following votes:
Aye: Cotten, Deeken, Lester, Mahoney, Markus, Vaughan, Yarnell
Abstain: Nunn

and Final Subdivision Plat. Request filed by F&F Development LLC, property owner, and Jesse and
Melissa Steck, applicants, for the following:
A. Rezoning of 3.77 acres addressed as 3328 Bennett Lane from RU Rural to PUD Planned Unit
Development.
B. Preliminary and Final PUD Plan to use the existing building as a daycare/Montessori school.
C. Final Subdivision Plat for Woodland Montessori School Subdivision, consisting of I lot and 3.77
acres.
The property is located on the northwest corner of the intersection of Bennett Lane and Rickman Lane
and is described as Part of the Northeast Quarter of the Southeast Quarter of Section 26, Township 44
North, Range 12 West, Jefferson City, Missouri (Central Missouri Professional Services, consultant).
Nature of Request
The property owner intends to split the former church building from the surrounding property and transfer
it to the new owner who would convert it to a daycare/Montessori school. In order to meet the zoning
regulations for the new use, the owner is proposing rezoning of property from RU Rural to PUD Planned
Unit Development and a PUD Plan outlining the daycare use.
A Final Subdivision Plat for a one lot subdivision is also proposed to accomplish the property transfer.

The subject property was annexed into the city in 2000.

The site has vehicular access from two directions, from Christy Drive via Bennett Lane and from
Southwood Hills Road via Rickman Lane (a private road).
The building and parking areas are separated from the neighboring residential property to the west by
approximately 100 feet.
Woodland Montessori School is a not-for-profit organization and the day to day operations of the facility
would be by a director with oversight by a board of directors.
The minimum number of children identified within the application is 24. There is no maximum number
of children listed.
The Final Subdivision plat consists of a one lot subdivision. Rickman Lane, a private road that extends to
the west across the city limit line and connecting to Southwood Hills Road in unincorporated Cole
County, is part of the property and shown as being included with the new lot on the subdivision plat. A
private easement would be retained across Rickman Lane to ensure access to the rest of the former
Rickman Center property is maintained.

Staff Recommendation
Staff recommends approval of the requested rezoning, Preliminary and Final PUD plan, and Final
Subdivision Plat. The property is well suited for conversion to a daycare use and impacts on adjacent
property should be minimal. The one lot subdivision meets the requirements of the subdivision code.
Staff recommend assigning an underlying zoning of C -O Office Commercial within the PUD plan for the
purpose of determining future permitted uses, signage, and outdoor lighting.
Form of Motion
1. Motion to approve the proposed rezoning of the 3.77 acre property from RU Rural to PUD
Planned Unit Development.
2. Motion to approve the proposed Preliminary and Final PUD Plan to use the existing building as a
daycare/Montessori school with an underlying zoning of C -O for the purpose of determining
future permitted uses, signage, and outdoor lighting.
3. Motion to approve the proposed Final Subdivision Plat for Woodland Montessori School
Subdivision subject to comments and technical corrections of the Planning and Engineering
Divisions.

-A private sanitary sewer exists on the property to serve the existing building/ proposed lot.
No public improvements are proposed for the project.
Plat Technical Comments -
The proposed zoning will need to be noted on the plat. The new zoning boundaries will need to be
shown.
Label the private roadways, being Rickman Lane and Bennett Lane on the plat.
• A few minor, technical edits will need to be revised for the proposed plat. These items will be sent
to the consultant for consideration as soon as possible.
