HomeMy Public PortalAbout06127 O R D I N A N C E NO. 6127 AN ORDINANCE, declaring the necessity for the acquisition of certain property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of the Bissell Point Secondary Treatment Project (Part of Federal Project No. C-290641) to serve the needs of residents of the Mississippi River Basin (Bissell Point Watershed) and authorizing the acquisition of such property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as the Mississippi River Basin (Bissell Point Watershed) wherein live and work numerous people; and WHEREAS, the United States Environmental Protection Agency has issued an Administrative Order requiring the construction of secondary treatment facilities at the Bissell Point Wastewater Treatment Plant; and WHEREAS, site comparison studies have demonstrated that the area north of the existing treatment plant is the most suitable site for the construction of the secondary treatment facilities; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees hereby finds, determines and declares that in order to comply with the Administrative Order from the Environmental Protection Agency, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, property for the construction of secondary treatment facilities as hereinafter set forth, said property being more particularly described as follows: MARIANO DON COSTELLO AND DELORES R. COSTELLO - PARCEL #1 A tract of land located in City Blocks 3319 and 3330 of the City of St. Louis Missouri, being more particularly described as follows: Beginning at the intersection of the East line of Hall Street, 80 feet wide and the North line of East Grand Avenue, 60 feet wide; thence in an easterly direction on the North line of East Grand a distance of 110.00 feet; thence in a northerly direction and parallel to the East line of Hall Street a distance of 767.33 feet to a point on the South line of vacated Gano Avenue, 60 feet wide; thence in a westerly direction along the South line of vacated Gano Avenue a distance of 110.00 feet to a point on the easterly line of Hall Street, 80 feet wide; thence along the East line of Hall Street a distance of 767.33 feet to the point of beginning, containing 1.94 acres, more or less, together with all improvements thereon. Also, a tract of land located in City Block 3331 of the City of St. Louis, Missouri, being more particularly described as follows: Beginning at the intersection of the East line of Hall Street, 80 feet wide and the South line of East Prairie Street, 60 feet wide; thence along the South line of East Prairie Street a distance of 130.00 feet to a point; thence in a southerly direction parallel to the East line of Hall Street a distance of 330.00 feet to the centerline of vacated Gano Avenue, 60 feet wide; thence in a westerly direction along the centerline of vacated Gano Avenue a distance of 130.00 feet to the East line of Hall Street; thence in a northerly direction along the East line of Hall Street a distance of 330.00 feet to the point of beginning, excepting the area for rounding at the Northwest corner of tract, dedicated and recorded on November 4, 1960 for public use, containing 0.98 acres more or less, together with all improvements thereon. SLIGO, INC. - PARCEL #2 A tract of land located in all of Block 3333 and part of Blocks 3334, 3327 and 3328 of the City of St. Louis, Missouri being more particularly described as follows: Beginning at the intersection of the centerline of vacated Stockton Street and the Southeast line of East Prairie 3 Avenue 60.00 feet wide; thence Southeastwardly along the centerline of Stockton Street a distance of 517.09 feet to a point; thence Northeastwardly and parallel to the Southeast line of East Prairie Avenue a distance of 450.00 feet to a point; thence Southeastwardly and parallel to the Northeast line of Stockton Street a distance of 28.00 feet to a point; thence Northeastwardly and parallel to the Southeast line of East Prairie Avenue a distance of 20.00 feet to a point; thence Northwestwardly and parallel to the Northeast line of Stockton Street a distance of 185.00 feet to a point; thence Northeastwardly and parallel to the Southeast line of East Prairie Avenue a distance of 160.00 feet to point; thence Northwestwardly and parallel to the Northeast line of Stockton Street a distance of 360.09 feet to a point in the Southeast line of East Prairie Avenue; thence Southwestwardly along the Southeast line of East Prairie Avenue a distance of 630.00 feet to the point of beginning, containing 6.92 acres more or less, together with all improvements thereon. BURLINGTON NORTHERN RAILROAD PROPERTIES, INC./DUNDEE CEMENT CO. - PARCEL #3 A tract of land located in City Blocks 3323, 3326, 3327, 3334 and 3335 of the original subdivision of the City of St. Louis, Missouri, being more particularly described as follows: Beginning at a point in the southerly right-of-way line of East Prairie Street (60 feet wide) said point being 100 feet westerly of the west line of Powder Street (60 feet wide, now vacated) as measured along the south line of East Prairie Street; thence on a line running southerly parallel to and 100 feet from the westerly line of Powder Street a distance of 360.09 feet to the southerly line of Gano Avenue (60 feet wide, now vacated); thence on a line in a westerly direction along the southerly line of Gano Avenue a distance of 160 feet to a point; thence on a line in a southerly direction parallel to and 260 feet from the westerly line of Powder Street a distance of 185 feet to a point; thence on a line in a westerly direction parallel to Gano Avenue a distance of 20 feet to a point; thence on a line in a southerly direction parallel to Powder Street a distance of 202.6 feet to a point; thence on a line in an easterly direction parallel to the centerline of John Avenue (vacated) a distance of 310 feet to a point on the centerline of Powder Street; thence on a line in a southerly direction on the centerline of Powder Street a distance of 380.33 feet to a point on the northerly line of East Grand Avenue (60 feet wide); thence on a line in an easterly direction on the northerly line of East Grand Avenue a distance of 120 feet; thence on a line in a northwesterly direction at an angle of 45 degrees to the northerly line of East Grand a distance of 49.5 feet to a point; thence on a line in a northerly direction forming a deflection angle to the right with the last described line of 45 degrees for a distance of 305 feet to a point; thence on a line in a northwesterly direction forming a deflection angle to the left with the last described line of 4 degrees 00 minutes 15 seconds a 4 distance of 501.22 feet to a point; thence on a line in a northwesterly direction forming a deflection angle to the left with the last described line of 4 degrees 48 minutes 39 seconds a distance of 291.46 feet to a point in the southerly line of East Prairie Street; thence on a line in a westerly direction along the southerly line of East Prairie Street a distance of 135.74 feet to the point of beginning, containing 5.388 acres more or less, together with all improvements thereon. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. 5 The foregoing Ordinance was adopted July 10, 1985.
