HomeMy Public PortalAbout06178 O R D I N A N C E NO. 6178 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Terri Robyn - Barnwood (S-2342) to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County within the Lower Meramec Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing sanitary relief sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements for the use of sewer lines as hereinafter set forth, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent easements being more particularly described as follows: 3 TERRI ROBYN - BARNWOOD S-2342 Herman Bussen Property A permanent sewer easement, 10 foot in width, across a tract of land in Section 35, Township 43 North, Range 6 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri, and across property conveyed to Herman W. Bussen by deed recorded in Book 117, Page 402 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as follows: Commencing at the northeast corner of the southeast quarter of the northwest quarter of said Section 35; thence westwardly along the east and west centerline of said northwest quarter of Section 35, a distance of 63.34 feet to its intersection with the northwest line of Christopher Road, 40 feet wide; thence along said northwest line of Christopher Road, south 16 degrees 35 minutes 00 seconds west a distance of 371.50 feet to a point; thence continuing along said northwest line, south 13 degrees 08 minutes 00 seconds west a distance of 72.34 Feet to THE ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, north 61 degrees 51 minutes 32 seconds west a distance of 247.90 feet to a point; thence north 68 degrees 45 minutes 34 seconds west a distance of 158.15 feet to a point; thence north 37 degrees 00 minutes 16 seconds west a distance of 272.99 feet to a point; thence north 48 degrees 40 minutes 35 seconds west a distance of 66.89 feet to the point of ending of said 10 foot wide permanent sewer easement, said point being in the aforementioned east and west centerline of the northwest quarter of Section 35, said point also being distant eastwardly a distance of 553.44 feet, as measured along said east and west centerline, from the northwest corner of the southeast quarter of the northwest quarter of said Section 35. Also, temporary construction easements for use in the construction or reconstruction of any sewer in the above-described sewer easement and being located on strips of land 20 feet in width along the southwestwardly side and 40 feet in width along the northeastwardly side and contiguous with the above described 10 foot wide permanent sewer easement. 4 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted August 28, 1985.
