HomeMy Public PortalAbout06235 O R D I N A N C E NO. 6235 AN ORDINANCE, vacating portions of sewer easements in Lots 10 and 14 of Bellerive Executive Park Plat 1, in St. Louis County, Missouri, WHEREAS, the owner of the subject property has requested this District to vacate the portions of subject easements, and this District has no further use for said portions, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of sewer easements are hereby vacated, to wit: Five parcels of land located in Bellerive Executive Park Plat 1, as recorded in Plat Book 170, Page 100 and Plat Book 165, Pages 62 and 63. Two parcels being a ten foot (10') wide easement recorded in Book 7110, Page 503 of the St. Louis County Records. Two parcels being part of a ten foot (10') wide easement recorded in Book 6924, Page 326 of the St. Louis County Records. One parcel being part of an easement recorded in Book 7000, Page 2057 of the St. Louis County Records. Parcel 1 - Part of an easement originally recorded in Deed Book 7110, Page 503 of the St. Louis County Records and described as: beginning at the Southwestern corner of Lot 10 of the Boundary Adjustment Survey, of Lots 10-14 of the Resubdivision of Lots 3, 4 and 5 of Bellerive Executive Park Plat 1, as recorded in Plat Book 170, Page 100 of the St. Louis County Records; thence North 01 degrees 03 minutes 30 seconds East along the Western line of Lot 10 a distance of ten and 00/100 feet (10.00') to a point; thence South 88 degrees 56 minutes 30 seconds East, along a line which is ten feet (10') North of and parallel to the South line of Lot 10, a distance of five and 00/100 feet (5.00') to the true point of beginning of the herein described tract of land; thence continue South 88 degrees 56 minutes 30 seconds East, along a line which is ten feet (10') North of and parallel to the South line of Lot 10, a distance of one hundred twenty-six and 21/100 (126.21') to a point; thence South 47 degrees 16 minutes 55 seconds East, through Lot 10, a distance of fifteen and 04/100 feet (15.04') to a point on the line of Lots 10 and 14; thence North 88 degrees 56 minutes 30 seconds West along the line between Lot 10 and 14, a distance of eighty-two and 88/100 feet (82.88') to a point; thence North 01 degrees 03 minutes 30 seconds East, through Lot 10, a distance of five and 00/100 feet (5.00') to a point; thence North 88 degrees 56 minutes 30 seconds West, along a line which is five feet (5') North of and parallel to the South line of Lot 10, a distance of fifty-four and 60/100 feet (54.60') to a point; thence North 01 degrees 03 minutes 30 seconds East, a distance of five and 00/100 feet (5.00') back to the true point of beginning. Parcel 2 - Part of an easement originally recorded in Deed Book 7110, Page 503 of the St. Louis County Records and described as: beginning at the Southwest corner of Lot 10 of the Boundary Adjustment Survey of Lots 10-14 of the Resubdivision of Lots 3, 4 and 5 of Bellerive Executive Park Plat 1, as recorded in Plat Book 170, Page 100 of the St. Louis County Records; thence South 88 degrees 56 minutes 30 seconds East along the lot line between Lots 10 and 14 a distance of one hundred fifty-seven and 52/100 feet (157.52') to the true point of beginning of the herein described tract of land; thence North 47 degrees 16 minutes 55 seconds West, through Lot 10, a distance of fifteen and 04/100 feet (15.04') to a point; thence South 88 degrees 56 minutes 30 seconds East, along a line which is ten feet (10') North of and parallel to the South line of Lot 10, a distance of sixty-two and 52/100 feet (62.52') to a point; thence South 01 degrees 03 minutes 30 seconds West; a distance of ten and 00/100 feet (10.00') to a point on the lot line between Lots 10 and 14; thence North 88 degrees 56 minutes 30 seconds West along the line between Lot 10 and 14, a distance of forty-seven and 48/100 feet (47.48') to the true point of beginning. Parcel 3 - Part of an easement originally recorded in Deed Book 6924, Page 326 of the St. Louis County Records and described as: beginning at the Northwest corner of Lot 14 of the Boundary Adjustment Survey of Lots 10-14 of the Resubdivision of Lots 3-5 of Bellerive Executive Park Plat 1, as recorded in Plat Book 170, Page 100 of the St. Louis County Records; thence South 88 degrees 56 minutes 30 seconds East along the North line of Lot 14 a distance of five and 00/100 feet (5.00') to the true point of beginning of the herein described tract of land; thence North 01 degrees 03 minutes 30 seconds East, through Lot 10 a distance of five and 00/100 feet (5.00') to a point; thence South 88 degrees 56 minutes 30 seconds East along a line which is five feet (5') North of and parallel to the South line of Lot 10, a distance of seventy-seven and 26/100 feet (77.26') to a point; thence South 47 degrees 16 minutes 55 seconds East, through said Lot 10, a distance of seven and 52/100 feet (7.52') to a point on the line of Lots 10 and 14; thence continue South 47 degrees 16 minutes 55 seconds East, through Lot 14, a distance of seven and 52/100 feet (7.52') to a point; thence North 88 degrees 56 minutes 30 seconds West, along a line which is five feet (5') South of and parallel to the North line of Lot 3 14, a distance of eighty-eight and 50/100 feet to a point; thence North 01 degrees 03 minutes 30 seconds East, a distance of five and 00/100 feet (5.00') back to the point of beginning. Parcel 4 - Part of an easement originally recorded in Deed Book 6924, Page 326 of the St. Louis County Records and described as: beginning at the Northwest corner of Lot 14 of the Boundary Adjustment Survey of Lots 10-14 of the Resubdivision of Lots 3-5 of Bellerive Executive Park Plat 1, as recorded in Plat Book 170, Page 100 of the St. Louis County Records; thence South 88 degrees 56 minutes 30 seconds East along the lot line between Lots 10 and 14 a distance of one hundred two and 92/100 feet (102.92') to the true point of beginning of the herein described tract of land; thence North 47 degrees 16 minutes 55 seconds West, through the aforementioned Lot 10, a distance of seven and 52/100 feet (7.52') to a point; thence South 88 degrees 56 minutes 30 seconds East, along a line which is five feet (5') North of and parallel to the South line of Lot 10, a distance of two hundred twenty-six and 30/100 feet (226.30') to a point on the West line of a five foot (5') wide utility easement to St. Louis County Water Company as recorded in Plat Book 164, Pages 56 and 57; thence South 01 degrees 03 minutes 30 seconds West, along the Western line of the aforementioned five foot (5') wide utility easement, a distance of five and 00/100 feet (5.00') to a point on the lot line between Lots 10 and 14; thence continue South 01 degrees 03 minutes 30 seconds West, along the aforementioned West line of the five foot (5') wide utility easement, a distance of five and 00 feet (5.00') to a point; thence North 88 degrees 56 minutes 30 seconds West along a line which is five feet (5') South of and parallel to the North line of Lot 14, a distance of two hundred fifteen and 06/100 feet (215.06') to a point; thence North 47 degrees 16 minutes 55 seconds West, through Lot 14, a distance of seven and 52/100 feet (7.52') back to the point of beginning. Parcel 5 - Part of an easement originally recorded in Book 7000, Page 2057 of the St. Louis County Records and described as: at the Southwest corner of Lot 10 of the Resubdivision of Lots 3, 4 and 5 of Bellerive Executive Park Plat 1, as recorded in Plat Book 165, Pages 62 and 63 of the St. Louis County Records and adjusted by the Boundary Adjustment Survey recorded in Plat Book 170, Page 100 of the St. Louis County Records; thence South 88 degrees 56 minutes 30 seconds East a distance of five and 00/100 feet (5.00') to a point; thence North 01 degrees 03 minutes 30 seconds East, a distance of five and 00/100 feet (5.00') to the point of beginning; thence continuing North 01 degrees 03 minutes 30 seconds East, a distance of fifteen and 83/100 feet (15.83') to a point; thence South 88 degrees 03 minutes 16 seconds East, a distance of nine and 35/100 feet (9.35') to a point; thence South 43 degrees 56 minutes 30 seconds East, a distance of 4 twenty two and 14/100 feet (22.14') to a point; thence North 88 degrees 56 minutes 30 seconds West, a distance of twenty five and 00/100 feet (25.00') to the point of beginning. 5 The foregoing Ordinance was adopted October 23, 1985.
