AN ORDINANCE, authorizing and directing the Executive
Director and Secretary-Treasurer on behalf of The Metropolitan St.
Louis Sewer District to convey certain real property of the
District in St. Louis County, Missouri, being partly in U.S.
Survey 904, Township 44 North, Range 7 East and partly in
Carondelet Commons, also being in part of ALLEN'S SUBDIVISION IN
THE CHOUQUETTE TRACT as recorded in Book 3, Page 60 of the St.
Louis County Records, being west of Hoffmeister Avenue, northeast
of Bolin Place Subdivision and south of Broadway as widened, to
Dennis W. Hurt and prescribing the terms for said conveyance.
WHEREAS, Resolution No. 1752, adopted November 27,
1985, declared said real property to be surplus,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-
Treasurer are hereby authorized and directed on behalf of The
Metropolitan St. Louis Sewer District to convey certain real
property of the District in St. Louis County, Missouri to Dennis
W. Hurt said real property being described as follows: A tract of land in St. Louis County, Missouri, being partly in U.S. Survey 904, Township 44 North, Range 7 East and partly in Carondelet Commons, also being in part of ALLEN'S SUBDIVISION IN THE CHOUQUETTE TRACT as recorded in Book 3, Page 60 of the St. Louis County Records, and being more particularly described as follows: Commencing at the point of intersection of the southeast line of Broadway Avenue, 60 feet wide, with the southwest line of property conveyed to The Metropolitan St. Louis Sewer District, a public corporation of the State of Missouri, by instrument recorded in Deed Book 6305, Page 1288 of the St. Louis County Records; thence south 35 degrees 43 minutes 00
seconds east a distance of 16.50 feet along the southwest line of said Sewer District property to THE ACTUAL POINT OF BEGINNING, said point being the southernmost corner of property conveyed to St. Louis County, Missouri, by deed recorded in Book 7748, Page 23 of the St. Louis County Recorder's Office; thence north 53 degrees 51 minutes 45 seconds east, along the southeast line of Broadway Avenue, as widened, a distance of 65.91 feet to a point of curvature; thence northeastwardly, eastwardly and southeastwardly along an arc of a curve to the right having a radius of 40.00 feet and chord bearing south 82 degrees 00 minutes 01 seconds east a distance of 55.71 feet, an arc distance of 61.63 feet to a point; thence south 37 degrees 51 minutes 48 seconds east a distance of 40.10 feet to a point of curvature; thence southeastwardly along an arc of a curve to the right having a radius of 545.00 feet and a chord bearing of south 28 degrees 30 minutes 19 seconds east 177.24 feet, an arc distance of 178.03 feet to a point of tangency; thence south 19 degrees 08 minutes 48 seconds east a distance of 256.09 feet to a point on the southwest line of said Sewer District property, said point being distant north 37 degrees 51 minutes 57 seconds west a distance of 1,351.83 feet from the southern corner of said Sewer District property; thence along said southwest line, north 37 degrees 51 minutes 57 seconds west a distance of 330.47 feet to the northwest corner of the aforementioned ALLEN'S SUBDIVISION IN THE CHOUQUETTE TRACT; thence continuing along said southwest line, north 35 degrees 43 minutes 00 seconds west a distance of 169.14 feet to the point of beginning.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized and directed on behalf of The
Metropolitan St. Louis Sewer District to execute and deliver a
general Warranty Deed to for the above described real property
upon the receipt of Eight Thousand Dollars ($8,000.00) from Dennis
W. Hurt for the purchase of said real property. The foregoing Ordinance was adopted December 18, 1985.
