' Mayor Pro Tem Briggs called the regular meeting of the City Council to order at 7:30 P. M. and stated that Mayor Beckley was representing the City at the Coordinating Council dinner, and that Councilman Harker had been called to New York on business unexpectedly and was unable to be present. 2. :invocation was given by Rev. Gilbert Myers of the First Baptist Church, Baldwin Ave., Temple City, followed by the Pledge of 3. Allegiance to the Flag led by Mayor Pro Tem Briggs. 4. ROLL CALL: PRESENT: Councilmen- Merritt, Tyrell, Briggs ABSENT: Councilmen - Beckley, Harker ALSO PRESENT: City Manager Koski and City Attorney Martin , Planning Director Dragicevich & Public Works Director Pizzorno Approval of Minutes: A. Regular meeting of May 16, 1967. Mayor Pro Tem Briggs corrected the minutes of May 16, 1967, as follows: page 2, line 5 should read Councilman Merritt seconded. page 6, item 17, line 6 should read Councilman Merritt seconded. Councilman Tyrell moved to approve the minutes of May 16, 1967, as corrected, Councilman Merritt seconded, and the motion was unanimously carried. B. Adjourned meeting of May 22, 1967. Councilman Briggs moved to approve the minutes of the Adjourned Meeting of May 22, 1967, Councilman Tyrell seconded, and the motion carried unanimously. UNFINISHED BUSINESS: PUBLIC HEARING: 7:30 P. M. APPEAL FROM PLANNING COMMISSION DECISION: Re Abatement of Nuisance, 6329 Sultana Ave., Leiland R. Shaw - Owner (Resolution No. 67- 255PC) Councilman Tyrell stated that both Councilmen Beckley and Harker requested that they be present at this Hearing, and even though set for this time he felt it should: be continued to a date when they will be present and we would have a full Council. City Attorney Martin advised with three Councilmen present there was a quorum but the Council should determine whether to proceed or to continue the Hearing until another time. Councilman Tyrell felt it regrettable the Councilmen were de- tained but that the Public Hearing should be postponed until all Councilmen were present and that it was necessary in order that all parties will be satisfied with the outcome. He moved to continue the Public Hearing to the next meeting on June 20, 1967, at 7:30 P. M. and to so advise those present, Councilman Merritt seconded. Mayor Pro Tem Briggs asked Mr. Shaw if this would cause him any problem and was advised that it would not, and he would like to have all Councilmen present. The motion was unanimously carried. City Attorney Martin advised the audience that the Public Hear- ing was continued to June 20, 1967, at 7:30 P. M., and advised those interested to come back at that time and that no further notices would be sent out. Council Minutes, June 6, 1967, page 2 NEW BUSINESS: 6. SET PUBLIC HEARING: APPEAL FROM PLANNING COMMISSION DECISION: Variance Case #67 -222, 4800 Baldwin Ave., Ralph G. Sproul Councilman Tyrell moved to set the above Public Hearing for 7:30 P. M. on June 20, 1967, Councilman Merritt seconded, and the motion carried unanimously. 7 SET PUBLIC HEARING: SIDEWALKS: Baldwin. Ave., east side, between La Rosa and Green St. Councilman Tyrell moved to set the above for Public Hearing on June 20, 1967, at 7:30 P. M., Councilman Briggs seconded, and the motion was unanimously carried. 8. AGREEMENT BETWEEN CITY AND LOS ANGELES COUNTY FLOOD CONTROL DISTRICT: Re- Storm Drain Bond Issue Project #8001 -- deletion of catch basins and appurtenances to be constructed by the City in conjunction with widening of Temple City Blvd. The Public Works Director presented the above Agreement. Following discussion Councilman Tyrell moved to authorize the Mayor and City Clerk to sign the documents on behalf of the City when approved by the City Attorney, Councilman Merritt seconded, and the motion carried unanimously. 9. RESOLUTION NO. 67 -743: adopting a budget for expenditure of allocated State Highway Funds, Gas Tax 2107, supplemental budget 1966 -67, $7956.00. Public Works Director Pizzorno advised at the beginning of this fiscal year an estimated amount of the budget was approved and this represents the actual balance accrued at the end of the 1966 -67 fiscal year. Councilman Tyrell moved to adopt Resolution No. 67 -743, Councilman Merritt seconded, and the motion was unanimously carried. 10. TRACT #29569: Dnal Developers, Green St. Tract. Approval of Survey Monuments, and release of Faithful Performance Bond in the amount of $1130., National automobile & Casualty Insurance The Public Works Director presented the above for Council approval and advised the City Engineer has received evidence of payment to the private engineer and recommends approval and release of the Faithful Performance Bond. Councilman Merritt moved approval of the Survey Monuments and release of the Faithful Performance Bond in the amount of $1130., Councilman Tyrell seconded, and the motion carried unanimously. 11. RESOLUTION NO. 67 -745: re temporary employee in City Clerk Dept. City Manager Koski presented Resolution No. 67 -745 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPO- RARY EMPLOYEE. Councilman Merritt moved to adopt Resolution No. 67 -745, Councilman Tyrell seconded, and the motion carried un- animously. 12. RESOLUTION NO. 67 -744: Warrants & Demands City Manager Koski presented Resolution No. 67 -744 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $31,616.87, DEMAND NOS. 9700 THROUGH NO. 9737. Councilman Merritt moved to adopt Resolution No. 67 -744, Councilman Tyrell seconded, and the motion carried unanimously. 13. ORDINANCE NO. 67 -236: 1st reading. Personnel Ordinance City Manager Koski presented Ordinance No. 67 -236 AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, ADDING A NEW CHAPTER 3.5 TO ARTICLE 11 OF THE TEMPLE CITY MUNICIPAL CODE, ESTABLISH- ING A PERSONNEL SYSTEM. Councilman Tyrell moved to waive further reading of Ordinance No. 67 -236, Councilman Merritt seconded, and the motion carried unanimously. As this was the first reading of the Ordinance no further action was taken. Council Minutes, June 6, 1967, page 3 14. ORDINANCE NO. 67 -235: 2nd reading. Gambling Amendment City Attorney Martin advised this was adopted as an urgency ordinance and he was now presenting it for second reading for regular adoption. Councilman Tyrell moved to waive further reading and to adopt Ordinance No. 67 -235, Councilman Merritt seconded, and the motion was unanimously carried. 15. COMMUNICATIONS: The City Manager presented a request from the Star Spangled Banner Flag House to proclaim June 11 -17 as National Flag Week. Councilman Tyrell moved to so proclaim, Councilman Merritt seconded, and the motion carried unanimously. The City Manager presented a request from the California Council of the Blind to sell tickets by telephone to business- men only for their annual Children's Variety Show to be held Sept. 30, for the benefit of their organization. Councilman Tyrell moved to approve, Councilman Merritt seconded, and the motion carried unanimously. 16. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward to speak at this time. 17. MATTERS FROM CITY OFFICIALS: The Public Works Director requested a assessment hearing_ .be set for curb, gutter and sidewalks, on the north side of Garibaldi, between Oak and St. James, for 6102 Oak Ave., amount $192.25 Councilman Tyrell moved to set the assessment hearing for June 20 at 7:30 P. M., Councilman Merritt seconded, and the motion carried unanimously. Public Works Director Pizzorno also requested an assessment hearing be set for the north side of Garibaldi Ave., between St. James and Primrose, 9517 Garibaldi, $188.61 Councilman Tyrell moved to set the assessment hearing for June 20, 1967, at 7:30 P. M., Councilman. Briggs seconded, and the motion was unanimously carried. The Public Works Director reported on the Mall construction on the south side of Las Tunas that they would start stripping on June 7 from Cloverly easterly, and that basing and paving the lots would start about the 19th of June. Mr. Pizzorno also reported on Flood Control Project #8001 that the bids are out, and are to be opened July 7, and they hope the work will commence in mid -July, with completion 210 days thereafter. Re the call for bids on sidewalks and tennis courts, Mr. Pizzorno advised the plans and specifications would be present- ed to the Council for approval on June 20. The bids will be opened July 17, and awarded on July 18 with the sidewalks to be finished before the start of school. The plans and speci- fications for tennis courts and annual contract for curb, gutter and sidewalks would go to the Council for approval June 20, and awarded on July 18. The City Manager recommended Al W. Millham and Robert Garvin be reappointed Planning Commissioners for two years with terms expiring on May 25, 1969. Councilman Merritt moved to make these two appointments, Councilman Tyrell seconded, and the motion carried unanimously. 1 1 Council Minutes, June 6, 1967, page 4. City Manager Koski requested authorization for preparation of plans and specifications and call for bids for air condition- ing at Live Oak Park at an estimated cost of $5000. Council- man Tyrell so moved, Councilman Merritt seconded, and the motion carried unanimously. City Manager Koski presented Resolution No. 67 -746 A RESOLUTION OF THE CITY OF TEMPLE CITY, CALIFORNIA, URGING THE STATE LEGIS- LATURE TO ADOPT LEGISLATION WHICH WOULD PERMIT GENERAL LAW CITIES TO LEVY A CIGARETTE TAX. Councilman Merritt moved to adopt Resolution No. 67 -746, Councilman Tyrell seconded, and the motion was unanimously carried. The City Manager advised that as of this date Mr. Shook has not applied for a building permit for necessary modifications to his building. He stated he had contacted Mr. Shook, and that the City Attorney had also contacted him, and that he has until July 10 to comply having used 30 of his 60 day time limit. Councilman Merritt asked when work would be commenced on Park- ing Districts No. 3 and No. 4 and was advised this would be started as soon as the south side is completed. The Chief Deputy City Clerk presented a request from Don Wienke, Pres. of the Sister City Committee, to sell coke at Temple City Park on June 18 at the Sister City party. Council- man Tyrell moved to approve, Councilman Merritt seconded, and the motion carried unanimously. 18. ADJOURNMENT: Councilman Tyrell moved to adjourn to a personnel session on June 8, 1967, at 7:30 P. M., Councilman Merritt seconded, and the motion carried unanimously. Council adjourned at 8 :59 P.M.
