PRESENT: Chairman Melanie Shirling, Member Dee Johnson, Member John Lott, Member
Roy Hobbs, Member Jake Lindsay, and Clerk Shara Roberts.
ABSENT: None
VISITORS: Michelle Smoley, Lynn & Betty McKinlay, Stan Gilgen, and Kevin Murray.
Chairman Melanie Shirling welcomed everyone and led with the Pledge of Allegiance.
Approval of Minutes: Member Dee Johnson moved to approve the minutes for April 13, 2016
with an edit to the spelling of Shane Harrigfeld's last name. Member John Lott seconded the
motion. All were in favor, motion carried.
Items of Business:
Bob & Melanie Hart/Stan Gilgen — Variance Application for Amended Plat located at 5287
East Owens Avenue, 5287 '/2 East Owens Avenue, and 5265 East Owens Avenue — Public
Hearing — 6:30 p.m.: Chairman Melanie Shirling explained the public hearing process and
asked representative to present the preliminary plat and variance application to the Commission,
Exhibit "A".
Realtor Kevin Murray with Keller Williams Real Estate located at 3525 Merlin Drive in Idaho
Falls explained he was representing Bob and Melanie Hart regarding this matter. He explained a
preliminary plat and variance was approved in the Fall of 2015. However, as the project has
progressed a surveyor came out to measure and prepare the land and found one of the
neighboring properties had an existing fence that was built a few inches onto the property. After
discussions with the neighbor it was determined the fence would stay there. As a result, they are
requesting to adjust the lot lines to match the existing fences on the lot which would change the
previously approved variance granting 80.25 feet of frontage down to 78.30 feet of frontage on
Lot 3-B.
Chairman Shirling opened the public portion of the hearing; those in favor, one; neutral, one;
opposed, none.
Stan Gilgen located at 3822 Summer Ridge Circle in Ammon commented he purchased the
property about 55 years ago and it was surveyed at the time. He discussed how the technology
for surveying land has improved tremendously since then, and clearly it's been wrong all this
time based on the most recent survey done by the Harts. He expressed he was in favor of the
Commission and the City Council approving the variance as he doesn't want to build a new
fence after all this time and at his age.
Lynn McKinlay located at 5315 Owens Avenue in Iona explained he owns the property to the
east of the property in question. He expressed based on Realtor Kevin Murray's explanation
from his presentation it is his understanding the preliminary plat and variance will not affect his
property lines. As a result, he expressed he was neutral towards the request. He commented if it

turns out Mr. Murray's statements are inaccurate he would be opposed.
Chairman Shirling closed the public portion.
Member Lindsay commented it appears the neighboring properties have worked this out.
Chairman Shirling entertained a motion. Member Lott moved to recommend to City Council the
variance be approved as outlined. Member Lindsay seconded the motion. A11 in favor, motion
carried.
Member Johnson inquired when the mobile home was scheduled to be removed per the
conditions which were imposed on the previous variance. Mr. Murray expressed they are in the
process of getting it taken care of.
Michelle Smoley — Conditional Use Permit to allow an in -home daycare located at 3032
Olsen Street — Public Hearing: Chairman Melanie Shirling explained the public hearing
process and asked applicant to present the application for a Conditional Use Permit to the
Commission, Exhibit B.
Michelle Smoley located 3044 Olsen Street in Iona explained she runs a small in home daycare
at her current residence. She has an approved Conditional Use Permit. However, the City Code
outlines they are non-transferrable from one property to another. Ms. Smoley explained she is
moving right next door to address 3032 Olsen Street.
Chairman Shirling opened the public portion of the hearing; those in favor, none; neutral, none;
opposed; none.
Chairman Shirling closed the public portion.
Member Lott asked if she owned the home or if it was a rental property. Ms. Smoley reported the
property was a rental. Chairman Shirling inquired if the landlord was aware of the business she
would be operating out of his home, and if he was okay with it. Ms. Smoley expressed she had
discussed it with the landlord and he was aware and supportive.
Member Hobbs asked what the parking arrangement would be for parents dropping off kids or
picking them up. Ms. Smoley indicated parking wouldn't be an issue as they have a large
driveway and she never has more than on parent at a time.
Member Lott asked Clerk Roberts if the City office had received any complaints. Clerk Roberts
reported the City office has not received any complaints for Ms. Smoley's in -home business.
Chairman Shirling entertained a motion. Member Johnson moved to recommend to City Council
to approve the Conditional Use Permit as presented. Member Hobbs second the motion. All in
favor, motion carried.
Area of Impact Discussion: Clerk Roberts reported she has no updates to share regarding the
letter sent to Bonneville's Planning and Zoning Commission about potential changes to the
current Area of Impact Agreement.

Discussion of Area of Impact Representative: Clerk Roberts reported Council President
Gubler contacted Shane Harrigfeld to inquire if he would be interested in representing the Area
of Impact on Iona's Planning and Zoning Commission and he accepted.
Chairman Shirling entertained a motion. Member Lott moved to recommend to City Council to
approve Shane Harrigfeld to serve on Iona's Planning and Zoning Commission. Member
Johnson seconded. All in favor, motion carried.
Reports:
Clerk Roberts reported she received the preliminary plat, and annexation/zoning application for
the new Rockwell Development north of Rushton Circle and explained the public hearing would
take place in June.

Re: Review of the Proposed Re -plat of the Hart Property Consisting of a Portion of Lot 3,
Block 2 in the City of Iona
Dear Shara:
Per City request, we have reviewed the revised re -plat proposal of the Hart Property along Iona
Road. It is apparent that under § 11-4-6-(A) of the Iona Code, that the minimum frontage allowed
in this zone is 85 feet. Lot 3-B would only have 78.30 feet if the City accepted the preliminary
plat. For acceptance of this requirement, Mr. Hart would have to apply for a variance under
Chapter 14, Title 11 of the City Code.
This revised plat does not include the City required language for the plat clauses: City's
Acceptance, Irrigation Disclosure and Owners Dedication requested in our August 26, 2015
letter. These clauses are attached to this letter. If the variance is approved, please have the
developer use the attached clauses on the final plat.
Our review letter of the original proposed re -plat dated August 26, 2015 contained other
elements that remain in force and should be addressed but are not repeated here.
