HomeMy Public PortalAbout06345 O R D I N A N C E NO. 6345 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Park Place to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County within the Lower Meramec Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements for the use of sewer lines as hereinafter set forth, together with temporary easements for working room during the construction or reconstruction period and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: 3 PARK PLACE Van Courtland Place Trustees Property A permanent sewer easement, 10 foot in width, across a tract of land being part of "Van Courtland Place," a subdivision according to the plat thereof recorded as Daily No. 36 on September 23, 1971 in the St. Louis County Records in the Southwest Fractional One-quarter of Section 29, Township 45 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as: Beginning at a point on the North line of said "Van Courtland Place" being distant South 81 degrees 07 minutes 30 seconds West 422.51 feet from the Northeast corner thereof; thence South 22 degrees 45 minutes 03 seconds East 141.80 feet to a point; thence South 12 degrees 25 minutes 03 seconds East 39.73 feet to a point; thence South 45 degrees 53 minutes 36 seconds East 56.70 feet to a point; thence South 41 degrees 35 minutes 37 seconds West 39.04 feet to a point; thence South 5 degrees 15 minutes 25 seconds East 125.56 feet to a point; thence South 49 degrees 29 minutes 06 seconds East 156.73 feet to a point; thence South 8 degrees 53 minutes 04 seconds West 40.99 feet to a point; thence North 69 degrees 08 minutes 11 seconds East 33.29 feet to a point; thence South 20 degrees 51 minutes 49 seconds East 10.00 feet to a point; thence Northwestwardly along said Northeast line of Armstead Drive, 34 feet wide, along a curve to the left whose radius point bears South 67 degrees 46 minutes 02 seconds West 469.00 feet from the last mentioned point, a distance of 10.29 feet to a point; thence North 80 degrees 42 minutes 26 seconds East 79.08 feet to a point; thence North 8 degrees 53 minutes 04 seconds East 57.68 feet to a point; thence North 49 degrees 29 minutes 06 seconds West 155.21 feet to a point; thence North 5 degrees 15 minutes 25 seconds West 138.75 feet to a point on the Southeast line of Lot 31 of said "Van Courtland Place"; thence along the boundary lines of said Lot 31 of "Van Courtland Place" North 41 degrees 35 minutes 37 seconds East 18.66 feet and North 45 degrees 53 minutes 36 seconds West 29.02 feet to a point; thence North 12 degrees 25 minutes 03 seconds West 63.59 feet to a point; thence North 22 degrees 45 minutes 03 seconds West 143.37 feet to a point on aforesaid North line of "Van Courtland Place"; thence Eastwardly along said North line of "Van Courtland Place" North 81 degrees 07 minutes 30 seconds East 10.30 feet to the point of beginning, according to calculations by Volz Engineering & Surveying, Inc. on December 19, 1985. 4 Also, temporary construction easements for use in the construction or reconstruction of any sewer in the above described sewer easement and being located on a tract of land being part of "Van Courtland Place," a subdivision according to the plat thereof recorded as Daily No. 36 on September 23, 1971 in the St. Louis County Records in the Southwest Fractional One-quarter of Section 29, Township 45 North - Range 5 East, St. Louis County, Missouri, and being more particularly described as: Beginning at a point on the North line of said "Van Courtland Place" being distant South 81 degrees 07 minutes 30 seconds West 396.76 feet from the Northeast corner thereof; thence South 22 degrees 45 minutes 03 seconds East 137.88 feet to a point; thence South 12 degrees 25 minutes 03 seconds East 10.90 feet to a point; thence South 45 degrees 53 minutes 36 seconds East 113.72 feet to a point; thence South 41 degrees 35 minutes 37 seconds West 84.35 feet to a point; thence South 5 degrees 15 minutes 25 seconds East 75.10 feet to a point; thence South 49 degrees 29 minutes 06 seconds East 160.54 feet to a point; thence South 8 degrees 53 minutes 04 seconds West 63.71 feet to a point on the North line of Lot 11 of said "Van Courtland Place"; thence Westwardly along said North line of Lot 11 of "Van Courtland Place" South 69 degrees 08 minutes 11 seconds West 69.11 feet to a point; thence North 8 degrees 53 minutes 04 seconds East 64.48 feet to a point; thence North 49 degrees 29 minutes 06 seconds West 151.41 feet to a point; thence North 5 degrees 15 minutes 25 seconds West 125.47 feet to a point on the Southeast line of said "Van Courtland Place"; thence along the boundary lines of said Lot 31 of "Van Courtland Place" North 41 degrees 35 minutes 37 seconds East 52.93 feet and North 45 degrees 53 minutes 36 seconds West 74.34 feet to a point; thence North 12 degrees 25 minutes 03 seconds West 23.52 feet to a point; thence North 22 degrees 45 minutes 03 seconds West 147.28 feet to a point on aforesaid North line of "Van Courtland Place"; thence Eastwardly along said North line of "Van Courtland Place" North 81 degrees 07 minutes 30 seconds East 61.80 feet to the point of beginning, according to calculations by Volz Engineering & Surveying, Inc. on December 19, 1985 excepting therefrom the above described permanent sewer easement. 5 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted January 22, 1986.
