HomeMy Public PortalAbout06582 O R D I N A N C E NO. 6582 AN ORDINANCE, repealing Ordinance No. 6344, adopted January 22, 1986, and enacting a new Ordinance in lieu thereof, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Chesterfield Valley Force Main to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County within the Missouri River Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 6344, adopted January 22, 1986, is hereby repealed. Section Two. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements for the use of sewer lines as hereinafter set forth, together with temporary easements for working room during the construction or reconstruction period and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: 3 CHESTERFIELD VALLEY FORCE MAIN AND LIFT STATION 85129 Wilbur Fienup, Trustee, et al. (Parcel #3) Revised 5/23/86 A permanent sewer easement, 10 foot in width, across a tract of land in U. S. Survey 2031, Township 45 North, Range 4 East, being across a portion of property conveyed to Wilbur G. Fienup, Trustee, et al., by deed recorded in Book 7573, Page 1270 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide permanent sewer easement being more particularly described as follows: Commencing at the northeasternmost corner of said Fienup property; thence along the eastern line of said Fienup property, south 3 degrees 44 minutes 57 seconds west a distance of 39.31 feet to THE ACTUAL POINT OF BEGINNING of the centerline of said 10 foot wide permanent sewer easement; thence along said centerline, north 42 degrees 54 minutes 16 seconds west a distance of 39.31 feet to the point of ending of said 10 foot wide permanent sewer easement, said point being in the northern line of said Fienup property and being distant south 70 degrees 29 minutes 57 seconds west a distance of 31.15 feet from the northeasternmost corner of said Fienup property. Also, temporary construction easements for use in the construction or reconstruction of any sewer in the above described sewer easement and being located on a strip of land 30 feet in width along the southwest side and contiguous with the above described 10 foot wide permanent sewer easement and the temporary construction easement being located along the northeast side of said 10 foot wide permanent sewer easement, bounded on the southwest by said northeast side, northwest and southeast by the northern and eastern lines, respectively, of said Fienup property. 4 CHESTERFIELD VALLEY FORCE MAIN AND LIFT STATION 85129 Peter Willi (Parcel #4) Revised 5/23/86 Two (2) permanent sewer easements, 10 foot in width, across a tract of land located in Lots 8 and 9 of the HERMAN FICKE ESTATE SUBDIVISION and across part of Lot 3 of JAMES LONG ESTATE in U. S. Survey 2031, Township 45 North, Range 4 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri, being across property conveyed to Peter Willi by deed recorded in Book 1605, Page 96 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide permanent sewer easements being more particularly described as follows: Permanent Sewer Easement #1 Commencing at the intersection of the south line of State Highway No. 40, Traffic Relief or Olive Street Road and the west line of said Lot 8 of the HERMAN FICKE ESTATE SUBDIVISION, said west line being the west line of the aforesaid Peter Willi property; thence along the west line of said Lot 8 being the west line of said Willi property, south 00 degrees 47 minutes 13 seconds east a distance of 1,374.13 feet to THE ACTUAL POINT OF BEGINNING of the centerline of said 10 foot wide Permanent Sewer Easement #1; thence along the centerline of said Permanent Sewer Easement #1, north 77 degrees 39 minutes 29 seconds east a distance of 3.13 feet to a point; thence north 70 degrees 12 minutes 29 seconds east a distance of 389.33 feet to a point; thence south 42 degrees 54 minutes 16 seconds east a distance of 331.29 feet to the point of ending of said 10 foot wide Permanent Sewer Easement #1, said point of ending being in the north line of property conveyed to Wilbur G. Fienup, Trustee, et al., by deed recorded in Book 7573, Page 1270 of the St. Louis County Recorder's Office, said point being distant along said north line, south 70 degrees 29 minutes 57 seconds west a distance of 31.15 feet from the northeasternmost corner of said Fienup property. Permanent Sewer Easement #2 Commencing at the point of ending of said Permanent Sewer Easement #1; thence south 42 degrees 54 minutes 16 seconds east a distance of 39.35 feet to THE ACTUAL POINT OF BEGINNING of the centerline of said Permanent Sewer Easement #2, said point being in the eastern line of the aforementioned property conveyed to Wilbur G. Fienup, Trustee, et al., by deed recorded in Book 7573, Page 1270 of the St. Louis County Recorder's Office, said point being distant south 3 degrees 44 minutes 57 seconds west a distance of 39.31 feet from the northeasternmost corner of said Fienup 5 property; thence along the centerline of said 10 foot wide permanent sewer easement, south 42 degrees 54 minutes 16 seconds east a distance of 117.52 feet to the point of ending of said 10 foot wide Permanent Sewer Easement #2, said point being in the north line of the St. Louis Southwestern Railway, 100 foot wide, said point being distant south 79 degrees 31 minutes 11 seconds west a distance of 373 feet from the aforesaid east line of Lot 3 of the JAMES LONG ESTATE, being also the east line of property conveyed to Peter Willi by deed recorded in Book 1605, Page 96 of the St. Louis County Recorder's Office. Also, temporary construction easements for use in the construction and reconstruction of any sewer in the above described two (2) permanent sewer easements and being located on strips of land 30 feet in width along the north side and 30 feet in width along the south side and contiguous with the above described two (2) - ten (10) foot wide permanent sewer easements. 6 CHESTERFIELD VALLEY FORCE MAIN John Shillington, et al. (Parcel #5) A permanent sewer easement, 10 foot in width, across a tract of land in part of Lots 6 and 7 of the HERMAN FICKE TRACT in U. S. Surveys 125 and 2031, Township 45 North, Range 4 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri and being across property conveyed to Elizabeth Jones Shands, et al., being Parcel No. 2 as recorded by deed in Book 4127, Page 326 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide permanent sewer easement being more particularly described as follows: Commencing at the point of intersection of the south line of the Chesterfield Airport Road (100 feet wide) and the west line of said Shands, et al. property; thence along said west line. south 0 degrees 47 minutes 13 seconds east a distance of 1,543.30 feet to THE ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, north 77 degrees 39 minutes 32 seconds east a distance of 582.80 feet to the point of ending of said 10 foot wide permanent sewer easement and being a point in the east line of said Shands, et al. property being distant along said east line, south 0 degrees 47 minutes 13 seconds east a distance of 1,374.13 feet from the south line of State Highway No. 40, Traffic Relief or Olive Street Road. Surveys 125 and 2031, Township 45 North, Range 4 East, being across parcels No. 2, 3, 4 and 5 of property conveyed to the Peter Willi Trust by Cause No. 147545, Probate Court, City of St. Louis, Missouri and recorded in Deed Book 6842, Page 898 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide permanent sewer easement being more particularly described as follows: Commencing at the point of intersection of the south line of the Chesterfield Airport Road (100 Feet wide) and the west line of said Willi property; thence along said west line, south 0 degrees 47 minutes 13 seconds east, a distance of 1,751.13 feet to THE ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, north 77 degrees 28 minutes 49 seconds east a distance of 11.92 feet; thence south 12 degrees 31 minutes 11 seconds east a distance of 54.96 feet; thence north 77 degrees 44 minutes 41 seconds east a distance of 1,398.10 feet to the point of ending of said 10 foot wide permanent sewer easement and being a point in the east line of said Willi property, said point also being distant along said east line, south 0 degrees 47 minutes 13 seconds east a distance of 1,543.30 feet from the south line of said Chesterfield Airport Road, 100 feet wide. S. Survey 125, Township 45 North, Range 4 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri, and being across property conveyed to George Ruppel and Johanna Ruppel, his wife, by deed recorded in Book 162, Page 433, of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as follows: Commencing at the point of intersection of the south line of the Chesterfield Airport Road (100 feet wide) and the west line of said Ruppel property; thence along said west line, south 0 degrees 47 minutes 13 seconds east, a distance of 1,604.67 feet to the ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, south 54 degrees 59 minutes 13 seconds east a distance of 65.46 feet to a point of curvature; thence southeastwardly along an arc of a curve to the left having a radius of 929.93 feet and a chord bearing south 78 degrees 45 minutes 58 seconds east 749.92 feet, an arc distance of 771.89 feet to the point of tangency; thence north 77 degrees 27 minutes 17 seconds east a distance of 307.49 feet to the point of ending of said 10 foot wide permanent sewer easement and being a point in the east line of said Ruppel property, said point being distant along said east line, south 0 degrees 47 minutes 13 seconds east a distance of 1,751.13 feet from the south line of said Chesterfield Airport Road, 100 feet wide. S. Surveys 125 and 126, Township 45 North, Range 4 East of the PETER STEFFAN ESTATE, according to the plat thereof recorded in Plat Book 216, Page 75 of the St. Louis County Recorder's Office, and across property conveyed to the Peter Willi Trust by Cause No. 147545, Probate Court, City of St. Louis, Missouri, and recorded in Deed Book 6842, Page 898 of the St. Louis County Recorder's Office and the centerline of said 10 foot wide permanent sewer easement being more particularly described as follows: Commencing at the point of intersection of the south line of the Chesterfield Airport Road (100 feet wide) and the west line of said adjusted Parcel B, being the west line of said Willi property; thence along the west line of said adjusted Parcel B, south 0 degrees 47 minutes 13 seconds east a distance of 1,293.85 feet to the ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, south 73 degrees 08 minutes 12 seconds east a distance of 273.26 feet to a point of curvature; thence southeastwardly along an arc of a curve to the right having a radius of 979.93 feet and a chord bearing south 64 degrees 03 minutes 42 seconds east 309.12 feet, an arc distance of 310.42 feet to the point of tangency; thence south 54 degrees 59 minutes 12 seconds east a distance of 137.15 feet to the point of ending of said 10 foot wide permanent sewer easement and being a point in the east line of said adjusted Parcel B, said east line being the east line of said Willi property, said point also being distant along said east line of adjusted Parcel B, south 0 degrees 47 minutes 13 seconds east a distance of 1,604.67 feet from the south line of the aforesaid Chesterfield Airport Road, 100 feet wide. S. Survey 126, Township 45 North, Range 4 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri, and being across property conveyed to Lydia S. Also, temporary construction easements for use in the construction or reconstruction of any sewer in the above described sewer easement and being located on a strip of land 30 feet in width along the south side and contiguous with the above described 10 foot wide permanent sewer easement and a temporary construction easement along the north side being bounded; south by the north side of the above described 10 foot wide permanent sewer easement, east and west by said Barnidge, et al. east and west property lines, respectively, north by the south line and its westward prolongation of property conveyed to the Chesterfield Fire Protection District and recorded in Deed Book 7314, Page 2229 of the St. Louis County Recorder's Office. 12 CHESTERFIELD VALLEY FORCE MAIN Chesterfield Industrial Investors (Parcel #13) A permanent sewer easement, 10 foot in width, across a tract of land in U. S. Surveys 419 and 1010, Township 45 North, Range 3 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri and being across property conveyed to Chesterfield Industrial Investors, by deed recorded in Book 7128, Page 2498, of the St. Louis County Recorder's Office, the centerline of said 10 foot wide permanent sewer easement being more particularly described as follows: Commencing at the point of intersection of the south line of the Chesterfield Airport Road (100 feet wide) and the west line of said Chesterfield Industrial Investors property; thence along said west line, south 12 degrees 29 minutes 30 seconds east a distance of 967.86 feet to the ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, north 77 degrees 27 minutes 56 seconds east a distance of 4.50 feet to a point of curvature; thence southeastwardly along an arc of a curve to the right having a radius of 406.97 feet and a chord bearing south 80 degrees 23 minutes 05 seconds east a distance of 306.88 feet, an arc distance of 314.66 feet to the point of tangency; thence south 58 degrees 14 minutes 06 seconds east a distance of 1,780.11 feet to the point of curvature; thence southeastwardly along an arc of a curve to the left having a radius of 356.97 feet and a chord bearing south 79 degrees 41 minutes 53 seconds east a distance of 261.23 feet, an arc distance of 267.44 feet to the point of tangency; thence north 78 degrees 50 minutes 20 seconds east a distance of 9.24 feet to the point of ending of said 10 foot wide permanent sewer easement and being a point in the east line of said Chesterfield Industrial Investors property, said point also being distant along said east line, south 12 degrees 29 minutes 30 seconds east a distance of 2,870.15 feet from the south line of said Chesterfield Airport Road, 100 feet wide. Also, temporary construction easements for use in the construction or reconstruction of any sewer in the above described sewer easement and being located on strips of land 30 feet in width along the south side and 30 feet in width along the north side and contiguous with the above described 10 foot wide permanent sewer easement. 13 Section Three. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted May 28, 1986.
