AN ORDINANCE, declaring the necessity for the
acquisition of certain property within The Metropolitan St. Louis
Sewer District for the purpose of permitting construction of the
Bissell Point Secondary Treatment Project (Part of Federal Project
No. C-290641) to serve the needs of residents of the Mississippi
River Basin (Bissell Point Watershed) and authorizing the
acquisition of such property, or interests therein, by purchase or
by the institution of condemnation proceedings.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area known as the Mississippi River Basin
(Bissell point Watershed) wherein live and work numerous people;
and
WHEREAS, the United States Environmental Protection
Agency has issued an Administrative Order requiring the
construction of secondary treatment facilities at the Bissell
Point Wastewater Treatment Plant; and
WHEREAS, site comparison studies have demonstrated that
the area north of the existing treatment plant is the most
suitable site for the construction of the secondary treatment
facilities;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Board of Trustees hereby finds,
determines, and declares that in order to comply with the
Administrative Order from the Environmental Protection Agency, it
is necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, property, or interests therein, for the
construction of secondary treatment facilities; specifically a
temporary construction easement for the duration of the project
over and across real estate more particularly described as
follows: A tract of land located in Blocks 3323, 3326, and 3335 of the original subdivision of the City of St. Louis, Missouri, being more particularly described as follows: Beginning at a point in the Southeast line of East Prairie Avenue, 60 feet wide, 5.74 feet Easterly of the centerline of vacated Powder Street; thence on a line in an Easterly direction along the Southeast line of East Prairie Avenue, a distance of 231.26 feet to a point; thence on a line in a Southerly direction parallel to former Powder Street. a distance of 330.09 feet to a point on the centerline of vacated Gano Avenue; thence on a line in an Easterly direction along the centerline of former Gano Avenue, a distance of 27.24 feet to a point; thence on a line bearing South 31 degrees 31 minutes 13 seconds East, a distance of 152.00 feet to a point; thence on a line bearing South 34 degrees 31 minutes 55 seconds East, a distance of 347.41 feet to a point; thence on a line bearing South 34 degrees 26 minutes 24 seconds East, a distance of 298.70 feet to a point on the North line of East Grand Avenue, 60 feet wide; thence on a line in a Westerly direction along the North line of East Grand Avenue, a distance of 155.94 feet to a point; thence on a line in a Northwesterly direction at an angle of 60 degrees 15 minutes 18 seconds to the North line of East Grand Avenue, a distance of 40.31 feet to a point; thence on a line in a Northerly direction forming a deflection angle to the right with the last described line of 29 degrees 44 minutes 42 seconds, a distance of 305.00 feet to a point; thence on a line in a Northwesterly direction forming a deflection angle to the left with the last described line of 4 degrees 00 minutes 15 seconds, a distance of 501.22 feet to a point; thence on a line in a Northwesterly direction forming a deflection angle to the left with the last described line of 4 degrees 48 minutes 24 seconds, a distance of 291.46 feet to the point of beginning in the Southeast line of East Prairie Avenue, containing 4.913 acres, more or less, including all improvements thereon.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District shall be and is hereby authorized to acquire by

purchase if possible, or to institute and prosecute an action in
condemnation pursuant to the provisions of the Plan of The
Metropolitan St. Louis Sewer District and the laws of the State of
Missouri for the appropriation of private property, or interests
therein, as hereinabove set out.
