AN ORDINANCE, authorizing and directing the Executive
Director and Secretary-Treasurer on behalf of The Metropolitan St.
Louis Sewer District to convey certain real property of the
District in St. Louis County, Missouri, known as MSD - Strecker
Road Lagoon No. 22 Property, to Thomas C. Shaw, Special Account,
and prescribing the terms for said conveyance.
WHEREAS, said real property was acquired by the
District through the Agreement of Purchase and Sale of the assets
of Fee Fee Trunk Sewer, Inc., and
WHEREAS, in the original deed through which Fee Fee
Trunk Sewer, Inc. acquired said real property, the grantor
reserved the right to reacquire said real property for Fifteen
Thousand Dollars ($15,000.00) in the event that said real property
would no longer be used or operated as a sewage treatment plant or
lagoon, and
WHEREAS, the right of reacquisition of said real
property has been ultimately assigned to Thomas C. Shaw, Special
Account, and said right is now being exercised, and
WHEREAS, by Resolution No. 1775, adopted July 9, 1986,
said real property was declared as surplus in that it is no longer
necessary for the operation of a sewage lagoon,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-
Treasurer are hereby authorized and directed on behalf of The
Metropolitan St. Louis Sewer District to convey certain real
property of the District in St. Louis County, Missouri, known as
MSD - Strecker Road Lagoon No. 22 Property, to Thomas C. Shaw,
Special Account, said real property being described as follows: A tract of land being part of Lot 1, as shown on plat attached to report of Commissioners in case of William J. Durdy vs. Malinda Hamilton in St. Louis Land Court, March term 1859, being in U. S. Survey 124, Township 45 North Range 3 and 4 East, a certified copy of which decree is recorded in Book 232, Page 148 of the St. Louis City (former County) records, St. Louis County, Missouri and being more particularly described as: Beginning at the intersection of the Southwest line of Church Road, 50 feet wide, as established, with the Northwest line of Strecker Road 40 feet wide, as established; thence in a Southwestwardly direction along said Northwest line, South 43 degrees 45 minutes West 249.40 feet and South 9 degrees 15 minutes West 115.26 feet to a point in Kehrs Creek; thence Southwestwardly within said creek South 42 degrees 55 minutes West 277.12 feet and South 54 degrees 25 minutes 30 seconds West 712.45 feet to a point; thence North 31 degrees 43 minutes 44 seconds West 478.79 feet to a point; thence North 35 degrees 06 minutes 44 seconds East 669.15 feet to a point; thence North 55 degrees 27 minutes 37 seconds East 625.46 feet to a point in said Southwest line of Church Road 50 feet wide, as established; thence Southeastwardly along said Southwest line, South 38 degrees 00 minutes East 504.93 feet to the point of beginning.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized and directed on behalf of The
Metropolitan St. Louis Sewer District to execute and deliver a
General Warranty Deed to Thomas C. Shaw, Special Account for the
above-described real property upon the receipt of Fifteen Thousand
Dollars ($15,000.00) from Thomas C. Shaw, Special Account for the
purchase of said real property.
