HomeMy Public PortalAbout06686 O R D I N A N C E NO. 6686 AN ORDINANCE, repealing Ordinance No. 6575, adopted May 28, 1986, and enacting a new ordinance in lieu thereof, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Spanish Lake Wastewater Treatment Plant Interceptor Line (85086) to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County known as the Bissell Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by providing for the construction of sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 6575, adopted May 28, 1986, is hereby repealed. Section Two. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements for the use of sewer lines as hereinafter set forth, together with temporary easements for working room during the construction or reconstruction period and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: 3 SPANISH LAKE WWTP INTERCEPTOR 85086 Property of Pipefitters (Parcel #2) Four (4) permanent sewer easements, 15 feet in width, across a tract of land located in U. S. Survey 141, U. S. Survey 1840, part of Lot 3 and Lot 2 of D. D. St. Vrain's Land, Nicholas Noel Destrehan Estate, Plat C, Township 47 North, Range 7 East, St. Louis County, Missouri, and across property conveyed to Pipefitters Welfare and Educational Fund by deed recorded in Book 6029, Page 89, Book 6070, Page 540, Book 6073, Page 49, Book 6171, Page 632, and Book 6496, Page 1603, St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Permanent Sewer Easement #1 Commencing at the intersection of the west line of Columbia Bottom Road and the northerly line of Larimore Road; thence along the northerly line of Larimore Road, North 87 degrees 20 minutes 05 seconds West, a distance of 175.06 feet to a point; thence continuing along the northerly line of Larimore Road, North 65 degrees 44 minutes 02 seconds West, a distance of 165.39 feet to THE ACTUAL POINT OF BEGINNING of the centerline of said 15 foot wide Permanent Sewer Easement #1; thence North 23 degrees 38 minutes 44 seconds East, a distance of 15.09 feet to a point; thence North 60 degrees 26 minutes 49 seconds East, a distance of 47.93 feet to a point; thence South 82 degrees 45 minutes 06 seconds East, a distance of 237.93 feet to a point; thence North 56 degrees 55 minutes 38 seconds East, a distance of 51.92 feet to a point; thence North 16 degrees 36 minutes 12 seconds East, a distance of 301.43 feet to a point; thence North 07 degrees 36 minutes 57 seconds West, a distance of 401.91 feet to a point; thence North 04 degrees 30 minutes 28 seconds East, a distance of 140.00 feet to a point; thence North 20 degrees 34 minutes 03 seconds West, a distance of 250.00 feet to a point; thence North 29 degrees 39 minutes 39 seconds West, a distance of 144.70 feet to the beginning point of a curve; thence along a curve to the right whose radius point bears North 60 degrees 20 minutes 21 seconds East, 300 feet and whose arc distance is 109.51 feet to the point of ending of said 15 foot wide Permanent Sewer Easement #1, said point of ending being on the south line of property conveyed to Ronald C. & Marilyn A. Temporary construction easements for use in the construction or reconstruction of any sewer in the above described Permanent Sewer Easement #1. These temporary construction easements are to be 4 located on strips of land 35 feet in width along the westerly side and 35 feet in width along the easterly side and contiguous with the above described 15 foot wide Permanent Sewer Easement #1. Merk, by deed recorded in Book 7166 on page 1926 of the St. Louis County Recorder's Office; thence along the north line of the aforementioned tract of land North 82 degrees 12 minutes West, a distance of 216.37 feet to THE ACTUAL POINT OF BEGINNING of the centerline of said 15 foot wide permanent easement; thence North 02 degrees 47 minutes 57 seconds East, a distance of 478.22 feet to the point of ending of said 15 foot wide Permanent Sewer Easement #2, said point being on the south line of a tract of land conveyed to Lester A. and Elverda Schollmeir, by deed recorded in Book 6240 on page 396 of the St. Louis County Recorder's Office and being North 82 degrees 13 minutes 40 seconds West, a distance of 162.07 feet from the southeast corner of said Schollmeir tract. These temporary construction easements shall have the following centerline description for a 105 foot strip of land, 8 excluding the 15 foot wide permanent easement #4 described above. Survey 1840, Township 47 North, Range 7 East of a part of Lot 2 of the Subdivision of D.D. ST. VRAIN'S LAND, St. Louis County, Missouri, and across property conveyed to Ronald L. & Marilyn A. Merk along with Vernon W. & Dorothy L. Merk by deed recorded in Book 7166, Page 1926 of the St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Commencing at a stone set in the West Line of Columbia Bottom Rd. at its intersection with the North line of a 16 foot private road, said beginning point being also the Southeast corner of a 20 acre tract of land conveyed to Gus S. Davis and wife by Warranty Deed dated July 30, 1926, recorded in Book 810, Page 39 of the St. Louis County Records, thence along the North line of said private road north 82 degrees 12 minutes west, a distance of 222.95 feet to THE ACTUAL POINT OF BEGINNING of said 15 foot wide permanent sewer easement, said point being on a curve; thence along said curve to the right whose radius point bears north 81 degrees 25 minutes 16 seconds east, 300 feet and whose arc distance is 59.56 feet to a point of tangency; thence north 2 degrees 47 minutes 57 seconds east, 52.04 feet to the point of ending of said 15 foot wide permanent sewer easement, said point being north 82 degrees 12 minutes west, 216.37 feet from the northeast corner of the above described property. Wooton (Parcel #5) A permanent sewer easement, 15 foot in width, across a tract of land in U. S. Survey 1840, Township 47 North, Range 7 East, St. Louis County, Missouri, and across property conveyed to Ralph V. and Clarice C. Wooton by deed recorded in Book 3487, Page 237 of the St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Commencing at a point in the centerline of Columbia Bottom Rd. (40 feet wide) distant south 1 degree 03 minutes west, 100 feet from its intersection with the North line of U. S. Survey 1840; thence north 83 degrees west, a distance of 225.26 feet to the ACTUAL POINT OF BEGINNING of said 15 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, south 6 degrees 24 minutes 41 seconds east a distance of 102.28 feet to the point of ending of said 15 foot wide permanent sewer easement, said point being north 83 degrees 0 minutes west, 191.68 feet from the southeast corner of the above described property. 12 SPANISH LAKE WWTP INTERCEPTOR 85086 Property of Wayne C. & Cheryl Allen (Parcel #6) A permanent sewer easement, 15 foot in width, across a tract of land in U. S. Survey 1840, Township 47 North, Range 7 East, St. Louis County, Missouri, and across property conveyed to Wayne C. and Cheryl Allen by deed recorded in Book 7032, Page 1019 of the St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Commencing at the intersection of the centerline of Columbia Bottom Rd. (40 feet wide), with the North line of U. S. Survey 1840; thence along said survey line north 83 degrees 00 minutes west, a distance of 238.67 feet to the ACTUAL POINT OF BEGINNING of said 15 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, south 6 degrees 23 minutes 53 seconds east a distance of 102.29 feet to the point of ending of said 15 foot wide permanent sewer easement, said point being north 83 degrees 00 minutes west, 205.26 feet from the southeast corner of the above described property. 13 SPANISH LAKE WWTP INTERCEPTOR 85086 (Parcel #14) A permanent sewer easement, 15 foot in width across Lot 4 of KUHS ACRES NO. 3, a subdivision, according to the plat thereof recorded in Plat Book 127, Pages 86 & 87 of the St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Commencing at the southwest corner of said Lot 4; thence along the western line of Lot 4, north 8 degrees 18 minutes 15 seconds east a distance of 147.86 feet to the ACTUAL POINT OF BEGINNING of said 15 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, south 66 degrees 15 minutes 30 seconds east a distance of 323.28 feet to the point of ending of said 15 foot wide permanent sewer easement, said point being in the eastern line of said Lot 4, and being north 6 degrees 42 minutes 45 seconds west, 21.73 feet from the southeast corner of the above described Lot 4. Temporary construction easements for use in the construction or reconstruction of any sewer in the above described permanent sewer easement. These two temporary construction easements are located on strips of land immediately to the east of the westerly property line of the above described property and are described as follows: 1) A temporary construction easement located to the south of the above described 15 foot wide permanent sewer easement, being a strip of land 35 feet in width and 95.75 feet in length, along it's centerline, as well as contiguous with the above described 15 foot wide permanent sewer easement. 2) A temporary construction easement located to the north of the above described 15 foot wide permanent sewer easement, being a strip of land 55 feet in width and 111.96 feet in length, along its centerline, as well as contiguous with the above described 15 foot wide permanent sewer. 14 SPANISH LAKE WWTP INTERCEPTOR 85086 (Parcel #15) A permanent sewer easement, 15 foot in width across Lot 5 of KUHS ACRES NO. 3, a subdivision, according to the plat thereof recorded in Plat Book 127, Pages 86 & 87 of the St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Commencing at the southwest corner of said Lot 5; thence along the western line of Lot 5, north 8 degrees 18 minutes 15 seconds east, a distance of 237.33 feet to the ACTUAL POINT OF BEGINNING of said 15 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, south 66 degrees 15 minutes 30 seconds east a distance of 230.03 feet to the point of ending of said 15 foot wide permanent sewer easement, said point being in the eastern line of said Lot 5 and being north 8 degrees 18 minutes 15 seconds east, 147.86 feet from the southeast corner of the above described Lot 5. Survey 3097, Township 47 North, Range 7 East, St. Louis County, Missouri, and across property conveyed to Donald E. and Kathryn Roth by deed recorded in Book 7119, Page 1282 of the St. Louis County Recorder's Office, the centerline of said 15 foot wide sewer easement being more particularly described as follows: Commencing at an old stone set in the North line of said Survey being the Northeast corner of a tract of land containing 65.19 acres conveyed to John Todd and Thomas Haverlin by deed recorded in Book 326, Page 201 of the St. Louis City (former County) Records; thence south 8 degrees 15 minutes west, a distance of 695.77 feet to the ACTUAL POINT OF BEGINNING of said 15 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement, north 84 degrees 42 minutes 58 seconds west a distance of 179.55 feet to the point of ending of said 15 foot wide permanent sewer easement. Also, temporary construction easements for use in the construction or reconstruction of any sewer in the above described permanent sewer easement and being located on strips of land 45 feet in width along the northerly and southerly sides and 25 feet in width along the westerly side and contiguous with the above described 15 foot wide permanent sewer easement. 16 Section Three. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinafter set out. The foregoing Ordinance was adopted August 13, 1986.
