CALL TO ORDER AND PLEDGE
Chairman Minnis called the Zoning Board of Appeals meeting to order at 7:00 p.m. and led the Pledge

APPROVAL OF MINUTES
Commissioner Valerga made a motion to approve the Minutes of Zoning Board of Appeals meeting held
on April 18, 2023 as presented. Second by Commissioner Nicholson. The motion carried unanimously by
voice vote:

DEVELOPMENT REPORT
Mr. Melrose provided an update on the massage special use.

Mr. Melrose provided an overview of the variance request.
Commissioner Valerga made a motion to open the public hearing. Second by Commissioner Nicholson.
The motion carried unanimously by voice vote:
Chairman Minns swore in Joe Broadus. Mr. Broadus explained why he was requesting the variances.
Chairman Minnis asked for public comments and there was no response.
There was discussion about what will be parked in the driveway, what the primary use of the garage will
be, and what is encroaching requiring the variance.
Commissioner Womack explained why he is not in support of the driveway variance and recommended
widening the driveway after the sidewalk and not the street. Mr. Broadus is agreeable.

The commission and applicant discussed what would be an agreeable solution to the driveway variance
since the commissioners feel the sidewalk width in the right-of-way would not meet the finds of fact. The
commission and the applicant agreed a driveway measuring 30 feet at the right-of-way would be
appropriate.
Commissioner Valerga made a motion to close the public hearing. Second by Commissioner Womack.
The motion carried unanimously by voice vote:
Commissioner Womack made a motion to adopt the findings of fact of staff as the findings of fact of
the Zoning Board of Appeals and recommend approval of a variance to permit a garage addition
encroaching two feet into the southern interior side yard for the property located at 13822 S. Teal
Court, contingent on the following:
1. Compliance with the requirements of the Village Engineer;
2. Compliance with the requirements of the Building Department; and
3. That the applicant will submit an elevation certificate demonstrating appropriate elevation
with the building permit application.
Second by Commissioner Nicholson. Chairman Minnis called for a vote by roll call. The motion is
carried 5:0.
Commissioner Valerga made a motion to adopt the findings of fact of staff as the findings of fact of
the Zoning Board of Appeals and recommend approval of a variance to permit a driveway measuring
30 feet at the right-of-way for the property located at 13822 S. Teal Court, contingent on the
following:
1. Compliance with the requirements of the Village Engineer; and
2. Compliance with the requirements of the Building Department.
Second by Commissioner Nicholson. Chairman Minnis called for a vote by roll call. The motion is
carried 5:0.

DISCUSSION
The applicant, Dollar Tree on behalf of Menards, is requesting a variance from Section 9-61 –
Table VI-1 to encroach almost fully into the required side yard setback of 15 feet for the existing
Planet Fitness. The total spacing between the buildings will be ~26.5 feet and the normal
spacing between buildings would typically be 30 feet or greater.
The Dollar Tree Final Plat of Subdivision
established a new northern lot line for Planet
Fitness. In most circumstances, if there is an
existing building typically that building’s lot
line is established and standard setbacks.
Unfortunately, that is not the case (see picture
of existing conditions) and as staff reviewed
the proposal for Dollar Tree this was not taken
into account. The Dollar Tree side yard
setback was in conformance but the newly
established northern lot line for the Planet
Fitness was not.
It is not uncommon for sub-anchor lots such as this to have in-line retailers with diminished or
nulled side yard setbacks; however, a variance should have been processed during final plat
approval as well to ensure the Planet Fitness lot would be conforming. Dollar Tree and Menards

were purposeful in their placement of the building to utilize the existing parking lot while still
providing existing parking for the Planet Fitness and a potential new user adjacent to their site
with some excess parking still available.
Dollar Tree is quite far along with their engineering review and any movement of the building to
accommodate requirements would be detrimental to the project. Menards is the owner of Planet
Fitness building/property and is selling Dollar Tree the 1.53 acres and is aware of the proposed
lot line placement.
The adjacent land uses, zoning, and street classifications are as follows:
• All adjacent properties to the requested variance are B3 Highway Business District.
FINDINGS OF FACT
In accordance with Section 9-33 of the Village’s Zoning Ordinance, the Zoning Board of
Appeals shall not recommend approval of, nor shall the Village Board grant a variance from the
regulations of the Zoning Ordinance unless it makes the following findings based on the
evidence presented:
a) The variance is in harmony with the general purpose and intent of this Zoning Ordinance;
The side yard setback variance will not have any negative impacts to the surrounding area and is
near the required total amount of combined building setback lines (3.5 feet less than required)
between the properties and provides sufficient spacing between the building.
It should be noted that is typically for these types of sub-anchor lots to the rear of commercial
developments to have one larger in-line building with multiple commercial stores which would
not have any spacing or need for light intrusion through the buildings.
Each of these buildings will have fire suppression and be line with all associated codes.
b) The plight of the owner is due to unique circumstances and thus strict enforcement of the
zoning ordinance would result in practical difficulties or impose exceptional hardships due
to the special and unusual conditions that are not generally found on other properties in
the same zoning district;
The Dollar Tree building placement was purposeful in relation to the parking lot access points,
utilities, and the like; unfortunately, the required setback lines were not sufficient for the existing
building.
c) The property cannot yield a reasonable use if permitted only under the conditions allowed by
the Zoning Ordinance; and
By decreasing the amount of the setback and properly placing a stand-alone building on the site
in the correct way, the remaining balance of the property will be able to be developed
appropriately.

d) The variance, if granted, will not alter the essential character of the locality and will not be a
substantial detriment to adjacent property.
As previously stated, the essential character of the locality will not be altered as sub-anchor lots
typically do not have separation between retailers.
RECOMMENDATION
In advance of public comments and discussion from the Zoning Board of Appeals, staff seeks the
Zoning Board of Appeals input for the subject variation. Should the Zoning Board of Appeals
support the variance requests, the following motion is offered for your consideration:
I move we adopt the findings of fact of staff as the findings of fact of the Zoning Board of
Appeals and recommend approval of a variance to permit a 15-foot encroachment of the
Planet Fitness into the northern side yard setback, contingent on the following:
1. Compliance with the requirements of the Village Engineer;
2. Compliance with the requirements of the Building Department; and
3. That the Dollar Tree cannot expand any further to the south within their building
setback line without Village Board approval.

DISCUSSION
The applicant, BWMY Plainfield, is proposing redeveloping two parcels on S Lincoln Highway, just south
of W Renwick Road: 15932 and 15936 S Lincoln Highway (PINs: 06-03-22-208-034-0000 and 06-03-22-
208-038-0000). The property is 2.2 acres and currently has several commercial structures. The proposed
development would involve demolishing all of the buildings, with the exception of the multi-tenant
building, and constructing a self-storage facility and stormwater management area. This proposal requires:
• Special Use for Planned Development
• Site Plan Review
• Final Plat of Subdivision
The request for Special Use for Planned Development requires a public hearing before the Plan
Commission. A public hearing was opened and held at the June 6, 2023 meeting of the Plan Commission.
At the request of the applicant, the public hearing was continued to the July 18, 2023 Plan Commission
meeting. At the July 18, 2023 meeting, the Plan Commission granted a continuance to the August 15, 2023
meeting. The applicant has since requested an additional continuance; staff has determined that, since it has
been over two months since the original public hearing, the applicant will be required to complete public
notice again and hold a new public hearing for this project. Therefore, staff recommends closing the current
public hearing, and offers the following motion if the Plan Commission concurs:
I move we close the public hearing for case 2011-050523.SU.SPR.FP.
