AN ORDINANCE, transferring all funds in the Valley
Sewage Company Operating Fund and any monies received or to be
received by said Fund, to the Operating, Maintenance and
Construction Improvement Fund of Subdistrict No. 449 (Meramec
River Basin - MSD Southwest) and appropriating One Million Six
Hundred Ten Thousand Dollars ($1,610,000) from the Operating,
Maintenance and Construction Improvement Fund of Subdistrict No.
449 (Meramec River Basin - MSD Southwest) of which Three Hundred
Twenty-two Thousand Dollars ($322,000) is to be used to pay the
District's twenty percent (20%) share; a grant of Eight Hundred
Eighty-five Thousand Dollars ($885,000) is anticipated from the
Environmental Protection Agency, and a grant of Four Hundred Two
Thousand Dollars ($402,000) is anticipated from the Missouri
Department of Natural Resources for Contracts E-480 (Engineering
services during the design of the Yarnell Creek Interceptor), E-
596 (Engineering services during construction of the Yarnell Creek
Interceptor) and Contract Letting 85128, (Construction of the
Yarnell Creek Interceptor), Federal Project C-290875-28.
WHEREAS, the bid for the construction of the Yarnell
Creek Interceptor is One Million Three Hundred Twenty-five
Thousand Six Hundred Seventy-nine Dollars ($1,325,679), and the
cost of engineering, inspection, construction staking, advertising
and allowance for construction change orders is Two Hundred
Eighty-four Thousand Three Hundred Twenty-one Dollars ($284,321),
and
WHEREAS, the District anticipates a fifty-five percent
(55%) grant from the Environmental Protection Agency of the United
States to pay fifty-five percent (55%) of the cost of said
project, and
WHEREAS, a twenty-five percent (25%) grant is
anticipated from the Missouri Department of Natural Resources to
pay twenty-five percent (25%) of the cost of said project.
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation incurred herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. All funds in the Valley Sewage Company
Operating Fund and any monies received or to be received by said
Fund are hereby transferred to the Operating, Maintenance and
Construction Improvement Fund of Subdistrict No. 449 (Meramec
River Basin - MSD Southwest).
Section Two. The sum of Three Hundred Twenty-two
Thousand Dollars ($322,000) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Subdistrict No. 449 (Meramec River Basin - MSD Southwest) to pay
twenty percent (20%) of the cost for Contracts E-480 (Engineering
services during the design of the Yarnell Creek Interceptor), E-
596 (Engineering services during construction of the Yarnell Creek
Interceptor) and Contract Letting 85128 (Construction of the
Yarnell Creek Interceptor), Federal Project C-290875-28.
Section Three. The anticipated grant from the

Environmental Protection Agency of the United States amounts to
Eight Hundred Eighty-five Thousand Five Hundred Dollars
($885,500), which will be deposited in the Operation, Maintenance
and Construction Improvement Fund of Subdistrict No. 449 (Meramec
River Basin - MSD Southwest) and is to pay fifty-five percent
(55%) of the cost for Contracts E-480 (Engineering services during
the design of the Yarnell Creek Interceptor), E-596 (Engineering
services during construction of the Yarnell Creek Interceptor) and
Contract Letting 85128 (Construction of the Yarnell Creek
Interceptor); Federal Project C-290875-28 and said amount is
hereby appropriated to be used to make said payments when due and
payable under the terms of the contracts for said project.
Section Four. The anticipated grant from the Missouri
Department of Natural Resources amounts to Four Hundred Two
Thousand Five Hundred Dollars ($402,500), which will be deposited
in the Operation, Maintenance and Construction Improvement Fund of
Subdistrict No. 449 (Meramec River Basin - MSD Southwest), and is
to pay twenty-five percent (25%) of the cost for Contracts E-480
(Engineering services during the design of the Yarnell Creek
Interceptor), E-596 (Engineering services during construction of
the Yarnell Creek Interceptor) and Contract Letting 85128
(Construction of the Yarnell Creek Interceptor), Federal Project
C-290875-28; and said amount is hereby appropriated to be used to
make said payments when due and payable under the terms of the
contracts for said project.
Section Five. This Ordinance, being an appropriation
