HomeMy Public PortalAbout06784 O R D I N A N C E NO. 6784 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to convey certain real property of the District in the City of Kirkwood, Missouri, known and numbered as 567 Leffingwell, to Frisch Masonry, Inc., and prescribing the terms for said conveyance. WHEREAS, by Resolution No. 1770, adopted June 11, 1986, said real property was declared as surplus in that it is no longer necessary for the operations of the District. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer are hereby authorized and directed on behalf of The Metropolitan St. Louis Sewer District to convey certain real property of the District in the City of Kirkwood, Missouri, known and numbered as 567 Leffingwell, to Frisch Masonry, Inc., said real property being described as follows: 2 LEFFINGWELL TREATMENT PLANT 24M-24-0022 A tract of land in Section 12, Township 44 North, Range 5 East, and Section 7, Township 44 North, Range 6 East, St. Louis County, Missouri and also being the northern portion of Lot 63 and 65 of the subdivision of EAST KIRKWOOD lying south of the Pacific Railroad, per the plat recorded in Plat Book 5, Page 32 of the St. Louis City Records, and being more particularly described as follows: Commencing at a point marking the southwestern corner of Lot 1 of LEFFINGWELL PARK per the plat recorded in Plat Book 134, Page 7 of the St. Louis County, Missouri Records, said point also being a point on the northern line of Leffingwell Avenue, 60 feet wide; thence south 68 degrees 18 minutes 30 seconds east along the said northern line of Leffingwell Avenue and also being the southern line of said LEFFINGWELL PARK, a distance of 94.54 feet to a point; thence south 49 degrees 36 minutes 25 seconds west across the aforementioned Leffingwell Avenue, a distance of 67.90 feet to a point on the southern right-of-way line of said Leffingwell Avenue, said point also being the "TRUE POINT OF BEGINNING" of the herein described tract of land; thence south 68 degrees 18 minutes 30 seconds east, along the southern line of the aforementioned Leffingwell Avenue, a distance of 320.00 feet to its point of intersection with the northern line of the Burlington Northern Railroad, 100 foot wide; thence south 72 degrees 36 minutes 46 seconds west, along the northern line of said Burlington Northern Railroad, a distance of 800.27 feet to its point of intersection with the centerline of Short Avenue, 60 feet wide, as vacated by Ordinance Number 5369 and recorded in Deed Book 6490, Page 1987, of the St. Louis County, Missouri Records; and also being a point on the southeastern line of property now or formerly of Carl E. Walker and Myrtle E. Walker per their deed recorded in Book 4572, Page 344 of the St. Louis County, Missouri Records; thence north 49 degrees 36 minutes 25 seconds east along the centerline of the said Short Avenue as vacated and the aforementioned Walker property, a distance of 502.72 feet to its point of intersection with the western line of the aforementioned Leffingwell Avenue; thence south 36 degrees 56 minutes 11 seconds east, along the said western line of Leffingwell Avenue, a distance of 30.05 feet to a point on the southern line of the aforementioned Leffingwell Avenue; thence north 49 degrees 36 minutes 25 seconds east along the said line of Leffingwell Avenue, a distance of 85.90 feet back to the "TRUE POINT OF BEGINNING" and containing 86,970 square feet or 1.996 acres (more or less) according to a survey by Kenneth Balk & Associates, Inc. completed in May, 1986. KBA Job No. 1-4286. 3 Section Two. The Executive Director and Secretary- Treasurer are hereby authorized and directed on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a General Warranty Deed to Frisch Masonry, Inc. for the above- described real property upon the receipt of Fifty-five Thousand Four Hundred Sixty-two Dollars ($55,462.00) from Frisch Masonry, Inc. for the purchase of said real property, and to further execute a Settlement Agreement and an Escrow Agreement with the City of Kirkwood, Missouri in settlement of a title dispute concerning said real property whereby the proceeds from the sale thereof will be placed in escrow and utilized, along with matching funds to be provided by the District, for construction of a stormwater drainage project within the City of Kirkwood. The foregoing Ordinance was adopted October 8, 1986.
